Get answers to common questions about the interim processes for PTAB workload management
On March 26, 2025, the USPTO issued a memorandum on interim processes for PTAB workload management. The memorandum explained that the decision to institute inter partes reviews and post-grant reviews will be bifurcated between (i) discretionary considerations and (ii) merits and other non-discretionary considerations.
Today, in response to frequently asked questions about the interim processes, the USPTO has provided information on:
- Availability and timing
- Requirements for briefing
- Requests for rehearing
- Conflicts of interest
- New paper types for discretionary denial briefing
Additionally, the decision in NXP USA, Inc. v. Impinj, Inc., IPR2021-01556, Paper 13 (September 7, 2022), is no longer designated as precedential.
