USPTO extends deadline for comments on inventorship guidance for AI-assisted inventions

The United States Patent and Trademark Office (USPTO) is extending the comment period for the guidance titled “Inventorship Guidance for AI-Assisted Inventions” that was published in the Federal Register on February 13, 2024. After the comment period for the guidance closed, the USPTO became aware of some continued stakeholder interest in submitting comments on the guidance. Therefore, the USPTO is extending the guidance’s comment period, which originally ended on May 13, 2024, until June 20, 2024. In addition, the USPTO will treat as timely any comments received between May 13, 2024, and June 6, 2024, the publication date of the extension. The extension ensures that all stakeholders have a sufficient opportunity to submit comments on the guidance.
