Updates on the method for filing certain documents with the USPTO

As announced in the Federal Register, the United States Patent and Trademark Office (USPTO) will issue a final rule regarding the method for filing the following documents with the Director of the USPTO:

  • Notice of appeal to the United States Court of Appeals for the Federal Circuit
  • Notice of election to proceed by civil action in district court
  • Request for extension of time for filing a notice of appeal or commencing a civil action

These documents must be filed with the Director of the USPTO by email, and if they cannot be filed by email, they may be filed by Priority Mail Express. This will ensure that the Director of the USPTO receives and can act on these notices and requests reliably and promptly.
