Updated Patent Litigation Docket Reports Data

The United States Patent and Trademark Office's (USPTO) Office of the Chief Economist (OCE) has released an update to its Patent Litigation Docket Reports Data. The dataset now contains detailed patent litigation data on 96,966 unique U.S. district court cases filed between 1963 and 2020. OCE and partners at the University of San Diego Law School have added data on cases filed between January 1, 2017, and December 31, 2020. They have also provided updated data on cases filed prior to 2017, but that were still pending at the time of data collection for the prior release in December 2019.

The final output datasets, provided in six different files, include information on the litigating parties involved and their attorneys; the cause of action; the court location; important dates in the litigation history; and descriptions of all documents submitted in a given case, which cover more than 9 million separate documents contained in the case docket reports. There is also a sixth file with hand-coded information on patents-in-suit and case type for most cases filed between 2003 and 2020.
