Reminder: Request for comments regarding artificial intelligence and inventorship closes May 15

On February 14, the United States Patent and Trademark Office (USPTO) published a Request for Comments (RFC) seeking public comments on inventorship issues that may arise in view of advances in artificial intelligence (AI) technologies. The deadline to comment is May 15.

The USPTO has been actively engaging with stakeholders to help ensure our laws and policies continue to encourage and incentivize AI-enabled innovation without unduly locking up advances that can be readily discovered by using AI. 

The USPTO held two public listening sessions, one on the East Coast at USPTO headquarters on April 25 and the other on the West Coast at Stanford University on May 8, to hear from stakeholders on the questions posed in the RFC. The USPTO heard from 32 speakers who represented stakeholders from academia, industry, law practitioners, and advocacy groups.

Many speakers called for the USPTO to take action by providing clarity around AI-assisted inventions. We will carefully consider the remarks from the listening sessions, along with the comments received in response to the RFC, to help inform our next steps in this important policy area.
