Director Vidal issues a precedential Director review decision regarding the treatment of multiple dependent claims  

Nested Bean, Inc. v. Big Beings Pty Ltd., IPR2020-01234, Paper 42 (Feb. 24, 2023)

This decision grants rehearing and modifies the Patent Trial and Appeal Board's (PTAB or the Board) final written decision. The Decision interprets the language of the fifth paragraph of 35 U.S.C. § 112—pre-America Invents Act (AIA)—to require that the Board consider separately the limitations of each claim incorporated by reference into a multiple dependent claim.
