                          Prioritized Examination Fee

   The United States Patent and Trademark Office (USPTO) published a notice
in the Federal Register proposing changes to implement the Prioritized
Examination Track (Track I) of the Enhanced Examination Timing Control
Procedures (3-Track). See Changes to Implement the Prioritized Examination
Track (Track I) of the Enhanced Examination Timing Control Procedures, 76
Fed. Reg. 6369 (Feb. 7, 2011). The USPTO proposed, among other changes, a
fee for filing a request for prioritized examination under 37 CFR 1.102(e)
in the amount of $4,000.

   The USPTO is moving forward with a final rule that will establish a fee
for filing a request for prioritized examination under 37 CFR 1.102(e) in the
amount of $4,000. The total in fees due (in addition to the applicable filing
fees) for an applicant to request prioritized examination will be $4,430.00,
including the prioritized examination of $4,000.00, the publication fee of
$300.00, and the processing fee of $130.00.

   If legislation is passed providing a fifty percent fee reduction for
prioritized examination for small entities and providing that the prioritized
examination fees be set to recover the estimated cost of the prioritized
examination program, the USPTO will issue a final rule that will establish a
fee for filing a request for prioritized examination under 37 CFR 1.102(e)
in the amount of $4,800 for non-small entities ($2,400 for small entities).
The total in fees due (in addition to the applicable filing fees) for an
applicant to request prioritized examination will be $5,230 for non-small
entities ($2,830 for small entities), including the prioritized examination
of $4,800.00 ($2,400 for small entities), the publication fee of $300.00, and
the processing fee of $130.00.

   This is the notice establishing the fee for prioritized examination
required by 35 U.S.C. 41(g) (which provides that "[n]o fee established by the
Director under this section shall take effect until at least 30 days after
notice of the fee has been published in the Federal Register and in the
Official Gazette of the Patent and Trademark Office").
