               Patent Cooperation Treaty (PCT) Information

   For general information concerning PCT member States, see the PCT
Applicant's Guide on the website of the World Intellectual Property
Organization (WIPO) at http://www.wipo.int/pct/en/appguide/.

   For information relating to International Searching Authorities (ISA)
under the PCT, including information on subject matter under Rule 39 that a
particular ISA is not required to search, see Annex D of the PCT
Applicants' Guide.

   The following information is provided in relation to the ISAs (other
than the United States Patent and Trademark Office (USPTO)) available for
international applications filed under the PCT with the USPTO as receiving
Office (RO/US).

European Patent Office as Searching and Examining Authority

   The European Patent Office (EPO) may act as the International Searching
Authority (ISA) or the International Preliminary Examining Authority (IPEA)
for an international application filed with the United States Receiving
Office or the International Bureau (IB) as Receiving Office where at least
one of the applicants is either a national or resident of the United States
of America. The EPO, effective January 1, 2015, no longer has any
limitations concerning its competency to act as an ISA. The announcement
appears in the Official Gazette at 1412 O.G. 61 on March 10, 2015.
Previously, the EPO would not act as an ISA and would not carry out an
international search for any application which contained one or more claims
relating to the field of business methods. As of January 1, 2015, U.S.
applicants filing their international applications with the USPTO or the IB
as receiving Office may select the EPO to act as the ISA without
restrictions. In applications containing claims relating to business
methods where the subject matter of the application also contains technical
features, the EPO will perform a search for those parts of the application
which are more than mere business methods. However, the EPO may issue a
declaration under PCT Rule 17(2)(a) that no ISR will be established
whenever an application relates only to a business method as such. The EPO
will act as an IPEA only if it also acted as the ISA.

Korean Intellectual Property Office as Searching and Examining Authority

   The Korean Intellectual Property Office may act as the ISA or the IPEA
for an international application filed with the United States Receiving
Office or the International Bureau (IB) as Receiving Office where at least
one of the applicants is either a national or resident of the United States
of America. The announcement appears in the Official Gazette at 1302 O.G.
1261 on January 17, 2006.

Australian Patent Office as Searching and Examining Authority

   The Australian Patent Office (IP Australia) may act as the ISA or the
IPEA for an international application filed with the United States
Receiving Office or the International Bureau (IB) as Receiving Office where
at least one of the applicants is either a national or resident of the
United States of America. The announcement appears in the Official Gazette
at 1337 O.G. 265, on December 23, 2008. However, the use of IP Australia is
restricted. IP Australia will not act as an ISA if it has received more
than 250 international applications from the USPTO during a fiscal quarter,
as indicated in the Official Gazette at 1409 O.G. 302 on December 30, 2014.
IP Australia will act as an IPEA only if it also acted as the ISA.

The Federal Service on Intellectual Property, Patents & Trademarks of
Russia as Searching and Examining Authority

   The Federal Service on Intellectual Property, Patents & Trademarks of

Russia (Rospatent) may act as the ISA or the IPEA for an international
application filed with the United States Receiving Office or the
International Bureau (IB) as Receiving Office where at least one of the
applicants is either a national or resident of the United States of
America. The announcement appears in the Official Gazette at 1378 O.G. 162
on May 8, 2012.

Israel Patent Office as Searching and Examining Authority

   The Israel Patent Office (ILPO) may act as the ISA or the IPEA for an
international application filed with the United States Receiving Office or
the International Bureau (IB) as Receiving Office where at least one of the
applicants is either a national or resident of the United States of
America. The announcement appears in the Official Gazette at 1408 O.G. 52
on November 4, 2014. Previously, the ILPO would not act as an ISA for
applications with one or more claims relating to a business method as
defined by certain International Patent Classification classes nor would
the ILPO act as an ISA where it had received more than 75 international
applications from the USPTO during a fiscal quarter, as indicated in the
Official Gazette at 1408 O.G. 52 on November 4, 2014. As of April 10, 2016,
U.S. applicants filing their international applications with the USPTO or
the IB as receiving Office may select the ILPO to act as the ISA without
restriction as to subject matter. Additionally, the quarterly limit
accepted by the ILPO has been increased to 100 international applications
during a fiscal quarter. See the Official Gazette at 1432 O.G. 264 on
November 22, 2016. The ILPO will act as an IPEA only if it also acted as
the ISA.

Japan Patent Office as Searching and Examining Authority

   The Japan Patent Office (JPO) may act as the ISA or the IPEA for an
international application filed with the United States Receiving Office or
the International Bureau (IB) as Receiving Office where at least one of the
applicants is either a national or resident of the United States of
America. The announcement appears in the Official Gazette at 1417 O.G. 63
on August 4, 2015. Previously, the JPO would act as an ISA for applications
only where the claims of the application were directed to the field of
green technology as defined by certain International Patent Classification
classes and where the JPO had not received more than 5,000 international
applications from the USPTO during the 3 year period from July 1, 2015 to
June 30, 2018, and not more than 300 applications per quarter during the
first year, and not more than 475 application per quarter during the second
and third years, as indicated in the Official Gazette at 1417 O.G. 63 on
August 4, 2015. As of July 1, 2018, U.S. applicants filing their
international applications with the USPTO or the IB as receiving Office may
select the JPO to act as the ISA without restriction as to subject matter.
Additionally, the numerical limitations have been revised in that the JPO
will act as an ISA where the JPO has not received more than 8,400
international applications from the USPTO during the 5-year period from
July 01, 2018, to June 30, 2023, and not more than 300 applications per
quarter during the first and second years, and not more than 500
applications per quarter during the third, fourth, and fifth years. See the
Official Gazette at 1454 O.G. 51 on September 04, 2018. The JPO will act
as an IPEA only if it also acted as the ISA.

Intellectual Property Office of Singapore as Searching and Examining
Authority

   The Intellectual Property Office of Singapore (IPOS) may act as the ISA
or the IPEA for an international application filed with the United States
Receiving Office or the International Bureau (IB) as Receiving Office where
at least one of the applicants is either a national or resident of the
United States of America. The announcement appears in the Official Gazette
at 1425 O.G. 190 on April 19, 2016. The IPOS will act as an IPEA only if it
also acted as the ISA.

                    Notice of Maintenance Fees Payable

   Title 37 Code of Federal Regulations (CFR), Section 1.362(d) provides
that maintenance fees may be paid without surcharge for the six-month
period beginning 3, 7, and 11 years after the date of issue of patents
based on applications filed on or after Dec. 12, 1980. An additional
six-month grace period is provided by 35 U.S.C. 41(b) and 37 CFR 1.362(e)
for payment of the maintenance fee with the surcharge set forth in 37 CFR
1.20(h), as amended effective Dec. 16, 1991. If the maintenance fee is
not paid in the patent requiring such payment the patent will expire on
the 4th, 8th, or 12th anniversary of the grant.

   Attention is drawn to the patents that were issued on June 13, 2017
for which maintenance fees due at 3 years and six months may now be paid

   Patent owners must establish small or micro entity status according to
37 CFR 1.27 or 1.29 if they have not done so and if they wish to pay the

in the most recently amended provisions in 37 CFR 1.20(e)-(g). To obtain

   35 U.S.C. 41 and 37 CFR 1.362(g) provide that if the required
maintenance fee and any applicable surcharge are not paid in a patent
requiring such payment, the patent will expire at the end of the 4th, 8th
or 12th anniversary of the grant of the patent depending on the first

   This notice concerns John E. Gibson, a registered patent attorney
(Registration No. 52,944). The Director of the United States Patent and
Trademark Office ("USPTO" or "Office") has accepted Mr. Gibson's affidavit
of resignation and ordered his exclusion on consent from practice before
the Office in patent, trademark, and non-patent law.

   Mr. Gibson voluntarily submitted his affidavit at a time when
disciplinary investigations were pending against him. The investigations
concerned neglect of clients' provisional and non-provisional patent
applications, failure to explain to clients the distinction between
provisional and non-provisional patent applications, failure to respond to
reasonable client inquiries and otherwise keep clients informed of the
status of their matters, failure to safe keep property, failure to take
reasonable steps to protect client interests in terminating representation,
conduct involving dishonesty, fraud, deceit, or misrepresentation, and
conduct prejudicial to the administration of justice. Mr. Gibson
acknowledged that the OED Director was of the opinion that his conduct
violated 37 C.F.R. §§ 11.101 (duty of competence), 11.102 (scope of
representation-and allocation of authority between client and
practitioner), 11.103 (duty of diligence), 11.104 (duty of communication),
11.105(b) (duties regarding communicating scope of representation, fees,
and expenses), 11.115 (duties to safe keep property and maintain required
records), 11.116 (duties in terminating representation), 11.804(c)
(proscribing conduct involving dishonesty, fraud, deceit, or
misrepresentation), 11.804(d) (proscribing conduct prejudicial to the
administration of justice), and 11.804(i) (proscribing other conduct that
adversely reflects on the practitioner's fitness to practice before the
Office).

   While Mr. Gibson did not admit to violating any of the disciplinary
rules of the USPTO Rules of Professional Conduct as alleged in the pending
investigations, he acknowledged that, if and when he applies for
reinstatement, the OED Director will conclusively presume, for the limited
purpose of determining the application for reinstatement, that (i) the
facts set forth in the OED investigations against him are true, and (ii) he
could not have successfully defended himself against the allegations
embodied in the opinion of the OED Director that he violated 37 C.F.R.
§§ 11.101 (duty of competence), 11.102 (scope of representation and
allocation of authority between client and practitioner), 11.103 (duty of
diligence), 11.104 (duty of communication), 11.105(b) (duties regarding
communicating scope of representation, fees, and expenses), 11.115 (duties
to safe keep property and maintain required records), 11.116 (duties in
terminating representation), 11.804(c) (proscribing conduct involving
dishonesty, fraud, deceit, or misrepresentation), 11.804(d) (proscribing

May 2020 Update Regarding Certain Patent-Related Timing Deadlines under the
   Coronavirus Aid, Relief, and Economic Security Act and Other Relief
            Available to Applicants, Patent Owners, and Others

   In accordance with section 12004 of the Coronavirus Aid, Relief, and
Economic Security Act (CARES Act), the United States Patent and Trademark
Office (USPTO or Office) further extends the time to file certain patent-
related documents or fees that would otherwise have been due on or after
March 27, 2020.

   For small and micro entities only, pursuant to the CARES Act Notice
dated April 28, 2020, filings that would have been deemed timely filed if
filed by June 1, 2020, will now be deemed timely filed if filed by July 1,
2020. After May 31, 2020, large entities should seek relief on a case-by-
case basis, through the filing of a petition for an extension of time or a
petition to revive, accompanied by any required fee.

   For all entities, the USPTO continues to provide relief in the form of a
waiver of the 37 CFR § 1.17(m) petition fee for filing a petition under
37 CFR § 1.137(a) for the revival of applications (and reexamination
proceedings) that became abandoned (or terminated or limited) on or before
June 30, 2020, with a statement that the delay in filing or payment was due
to the COVID-19 outbreak, as set forth in section (I)(1)(b) of the
April 28, 2020 CARES Act Notice.

   All patent applicants and patentees are reminded that extensions of time
under 37 CFR § 1.136 are available for filing replies to Office actions and
notices issued during patent processing or examination; petitions under
37 CFR § 1.137 to revive an application are available if any of the patent-
related documents or fees in section (I)(1)(a) of the April Notice not
being filed or paid by its due date has resulted in the abandonment of an
application; and petitions under 37 CFR § 1.378 to accept a delayed
maintenance payment are available if a maintenance fee has not been paid by
its due date.

   The USPTO recognizes that the COVID-19 pandemic continues to impose
various hardships, especially on small businesses and individual inventors,
and will continue to evaluate the evolving situation around the COVID-19
outbreak and the impact on the USPTO's operations and stakeholders.

   The United States Patent and Trademark Office (USPTO) considers the
effects of the COVID-19 outbreak to be an "extraordinary situation" within
the meaning of 37 CFR 1.183. In accordance with this notice, the USPTO will
permit the filing of initial patent term extension applications pursuant to
35 U.S.C. 156 via the USPTO patent electronic filing systems (EFS-Web or
Patent Center).

   According to the "Legal Framework for Patent Electronic System"
(https://www.uspto.gov/patents-application-process/filing-online/legal-
framework-efs-web), certain documents are prohibited from being filed via
the USPTO patent electronic filing systems. See section B2 of the "Legal
Framework for Patent Electronic System" for the full list of documents.
Item number 4 on the list is "Initial submissions for patent term extension
under 35 U.S.C. 156." Additionally, MPEP 502.05 indicates that "[i]f any of
the documents listed [in section B2] is submitted via EFS-Web, the document
will not be accorded a date of receipt and it will not be considered
officially filed in the USPTO. Furthermore, no benefit will be given to a
certificate of transmission under 37 CFR 1.8 on the document."

   Due to the COVID-19 outbreak, the prohibition against filing initial
patent term extension applications in accordance with 37 CFR 1.740 or
37 CFR 1.790 via the USPTO patent electronic filing systems is hereby
waived until further notice. In addition, for USPTO patent electronic
filing system filings only, the requirements in 37 CFR 1.740(b) and
37 CFR 1.790(b) for two additional copies of the initial extension
application are waived until further notice.

   The following must be provided in order to be entitled to a filing date
for an initial patent term extension application filed via the USPTO patent
electronic filing systems:

     1. An appropriate document description:

        a. "Patent Term Extension Application Under 35 USC 156" (Doc Code
           TERM.REQ) must be selected for an initial submission under
           35 U.S.C. 156(d)(1) (governed by 37 CFR 1.740), or

        b. "PTE Interim Patent Extension filed" (Doc Code TERM.REQ.ITM)
           must be selected for an initial submission under 35 U.S.C. 156
           (d)(5) (governed by 37 CFR 1.790);

     2. An email address in the contact information to facilitate contact
         with the applicant's representative; and

     3. The applicable fee:

        a. the fee set forth in 37 CFR 1.20(j) for submission of an initial
           application for patent term extension under 37 CFR 1.740, or

        b. the fee set forth in 37 CFR 1.20(j) for submission of an initial
           application for interim patent term extension under
           37 CFR 1.790.

   Should any of the attachments exceed the system filing limits of the
USPTO patent electronic filing systems, such document can be split into
smaller files to permit uploading. Any document that is an attachment to
the initial application for patent term extension must use the document
description "Appendix to the Specification" (Doc Code APPENDIX). This
waiver is effective only until the USPTO provides further notice. Such
notice may occur by publication in the Official Gazette or Federal Register
or on the USPTO's website. However, the USPTO is continuing its efforts to

modify the Patent Center, the new electronic filing and retrieval system,
so that patent term extension applications can be filed electronically on a
permanent basis.

   Thus, in accordance with this notice, applicants may now submit initial

37 CFR 1.790 to the USPTO three ways, via: (1) the USPTO patent electronic
filing systems (EFS-Web or Patent Center); (2) the United States Postal
Service by Priority Mail Express(r) under 37 CFR 1.10 (MPEP 513) or with a
certificate of mailing under 37 CFR 1.8 (MPEP 512); or (3) by hand-delivery
to the Customer Service Window (MPEP 501).

             Reference Collections of U.S. Patents Available for
             Public Use in Patent and Trademark Resource Centers

The following libraries, designated as Patent and Trademark Resource Centers
(PTRCs), provide public access to patent and trademark information received
from the United States Patent and Trademark Office (USPTO). This
information includes all issued patents, all registered trademarks, the
Official Gazette of the U.S. Patent and Trademark Office, search tools such
as the Cassis CD-ROM suite of products and supplemental information in a
variety of formats including online, optical disc, microfilm and paper.
Each PTRC also offers access to USPTO resources on the Internet and to
PubWEST (Web based examiner search tool), a system used by patent examiners
that is not available on the Internet.

Staff assistance and training is provided in the use of this information.
All information is available free of charge. However, there may be charges
associated with the use of photocopying and related services. Hours of
service to the public vary, and anyone contemplating use of these
collections at a particular library is urged to contact that library in
advance about its services and hours to avoid inconvenience.
