		  Patent Cooperation Treaty (PCT) Information

   For information concerning PCT member countries, see the notice
appearing in the Official Gazette at 1325 O.G. 4, on December 4, 2007.

European Patent Office as Searching and Examining Authority

   The European Patent Office (EPO) may act as the International Searching
Authority (ISA) for an international application filed with the	United
States Receiving Office or the International Bureau (IB) as Receiving
Office where at least one of the applicants is either a national or
resident of the United States of America. However, the EPO is no longer
a competent ISA, within the meaning of PCT Article 16(3), for
international applications filed by U.S. residents or nationals on or
after 01 March 2002 in the USPTO or IB as a Receiving Office, and where
the application contains one or more claims directed to the field of
business methods. For the definition of what the EPO considers to be
precluded subject matter in the field of business methods, applicants
should see the "Notice from the President of the European Patent
Office", dated 26 November 2001, and which was published as Annex A in
the "Notice Concerning EPO Competence to Act as PCT Authority" in
the Official Gazette at 1255 O.G. 878, on February 19, 2002.

   The European Patent Office may act as the International
Preliminary Examining Authority (IPEA) for an international application
filed in the United States Receiving Office or the International Bureau
as Receiving Office where at least one of the applicants is either a
national or resident of the United States of America, provided that the
European Patent Office acted as the International Searching Authority.
However, the EPO is no longer a competent IPEA, within the meaning of
PCT Article 32(3), for international applications filed by U.S.
residents or nationals in the USPTO or IB as a Receiving Office where
the corresponding demand is filed with the EPO on or after 01 March
2002, and where the application contains one or more claims directed to
the fields of business methods.

   The EPO resumed its competence as an International Searching
Authority and International Preliminary Examining Authority, effective
January 1, 2004, for international applications filed by nationals or
residents of the United States of America where the application
contains one or more claims relating to the field of biotechnology.
This change was announced in the Official Gazette at 1277 O.G. 230, on
December 30, 2003.

   The EPO resumed its competence as an International Preliminary
Examining Authority, effective July 1, 2004, for demands filed by U.S.
residents or nationals on or after July 1, 2004, for international
applications filed by nationals or residents of the United States of
America where the application contains one or more claims relating to
the field of telecommunications. This change was announced in the
Official Gazette at 1277 O.G. 230, on December 30, 2003.

   The search fee of the European Patent Office was increased,
effective April 1, 2008, and was announced in the Official Gazette
at 1329 O.G. 172, on April 22, 2008.

Korean Intellectual Property Office as Searching and Examining Authority

   For use of the Korean Intellectual Property Office as an International
Searching Authority and International Preliminary Examining Authority for
international applications filed in the United States Receiving Office,
see the notice appearing in the Official Gazette at 1302 O.G. 1261 on
January 17, 2006.

   The search fee of the Korean Intellectual Property Office was increased,
 April 22, 2008 US PATENT AND TRADEMARK OFFICE 1329 OG 115 

effective January 1, 2008, and was announced in the Official Gazette at
1327 O.G. 64, on February 12, 2008.

Fees

   The search fee for the USPTO was increased, effective November 9, 2007,
and was announced in the Federal Register on September 10, 2007.

   International filing fees were increased, effective January 1, 2008,
and were announced in the Official Gazette at 1325 O.G. 4, on December 4,
2007.

   The schedule of PCT fees (in U.S. dollars), as of January 1, 2008,
is as follows:

		       Patent Cooperation Treaty Update

   The International Bureau of the World Intellectual Property Organization
has informed the United States Patent and Trademark Office that an increased
dollar amount has been established for the search fee required by the
European Patent Office with effect from April 1, 2008.  The dollar amount of
the search fee required by the European Patent Office when acting as an
International Searching Authority will be $2,496 beginning April 1, 2008.

		       Patent Cooperation Treaty Update

   The International Bureau of the World Intellectual Property Organization
has informed the United States Patent and Trademark Office, that due to
changes in the exchange rate of the U.S. dollar with regard to the Swiss
franc, the dollar amount of certain fees for international applications
filed in the United States Receiving Office have been changed, effective
May 15, 2008.

The amount of these fees will be:

   Title 37 Code of Federal Regulations (CFR), Section 1.362(d) provides
that maintenance fees may be paid without surcharge for the six-month
period beginning 3, 7, and 11 years after the date of issue of patents
based on applications filed on or after Dec. 12, 1980. An additional
six-month grace period is provided by 35 U.S.C. 41(b) and 37 CFR 1.362(e)
for payment of the maintenance fee with the surcharge set forth in 37 CFR
1.20(h), as amended effective Dec. 16, 1991. If the maintenance fee is
not paid in the patent requiring such payment the patent will expire on
the 4th, 8th, or 12th anniversary of the grant.

   Attention is drawn to the patents that were issued on April 12, 2005
for which maintenance fees due at 3 years and six months may now be paid.
The patents have patent numbers within the following ranges:

   	Utility Patents 6,877,167 through 6,880,171
	Reissue Patents based on the above identified patents.

   Attention is drawn to the patents that were issued on April 10, 2001
for which maintenance fees due at 7 years and six months may now be paid.
The patents have patent numbers within the following ranges:

      	Utility Patents 6,212,683 through 6,216,267
      	Reissue Patents based on the above identified patents.

   Attention is drawn to the patents that were issued on April 8, 1997
for which maintenance fees due at 11 years and six months may now be paid.
The patents have patent numbers within the following ranges:

        Reissue Patents based on the above identified patents.

   No maintenance fees are required for design or plant patents.

   Payments of maintenance fees in patents may be submitted electronically
over the Internet at www.uspto.gov. Click on the "Site Index" link at the
top of the homepage (www.uspto.gov), and then scroll down and click on the
"Maintenance Fees" link for more information.

   Payments of maintenance fees in patents not submitted electronically
over the Internet should be mailed to "United States Patent and Trademark
Office, P.O. Box 979070, St. Louis, MO 63197-9000".

   Correspondence related to maintenance fees other than payments of
maintenance fees in patents is not to be mailed to P.O. Box 979070,
St. Louis, MO 63197-9000, but must be mailed to "Mail Stop M
Correspondence, Director of the U.S. Patent and Trademark Office, P.O.
Box 1450, Alexandria, VA 22313-1450".

   Patent owners must establish small entity status according to 37 CFR
1.27 if they have not done so and if they wish to pay the small entity
amount.

   The current amounts of the maintenance fees due at 3 years and six
months, 7 years and six months, and 11 years and six months are set
forth in the most recently amended provisions in 37 CFR 1.20(e)-(g).

   35 U.S.C. 41 and 37 CFR 1.362(g) provide that if the required

First Action Interview Pilot Program
		     First Action Interview Pilot Program

Summary: The United States Patent and Trademark Office (USPTO) is
initiating a pilot program in which, in certain art areas, applicants who
comply with the requirements set forth in this notice will receive the
results of a prior art search conducted by the examiner, via a condensed
Pre-Interview Communication, and then be permitted to conduct an interview
with the examiner to discuss the cited prior art references, before the
examiner issues an Office action on the merits that sets forth the
rejections. An interview under this pilot program would advance prosecution
of the application because it would enhance the interactions between the
applicant and the examiner, provide applicant the opportunity to resolve
patentability issues one-on-one with the examiner at the beginning of the
prosecution process, and facilitate possible early allowance. Currently,
granting an interview before first action on the merits of a new
application is within the discretion of the examiner, who has not yet
searched the case, and a showing may be required to justify the granting of
the interview. See MPEP § 713.02. The pilot program provides a procedure
which, if followed, makes the granting of an interview non-discretionary.

For those applicants who are eligible and wish to participate in the pilot
program, applicants must file a request electronically.1  When the
application is taken up for examination, the examiner will conduct a prior
art search and provide applicant a Pre-Interview Communication that
includes citations to prior art references from the prior art search
(similarly to a search report) and an identification of any potential
rejections and/or objections, if any claim is not allowable. Once the
applicant reviews the prior art references, applicant must either file a
request to not have a first action interview with the examiner, or schedule
the interview and file a proposed amendment or remarks (arguments), within
one month or thirty days from the issue date2 of the Pre-Interview
Communication. If applicant chooses not to have a first action interview, a
First Action Interview Office Action will be promptly issued and applicant
will have one month or thirty days, whichever is longer, to reply. If an
interview is scheduled, applicant must be prepared to discuss issues
related to the patentability of the claims. If the applicant and the
examiner reach agreement during the interview on all claims at issue in
regard to patentability, a Notice of Allowability and Notice of Allowance
and Fees Due will be issued promptly after the interview. If agreement is
not reached on all claims in regard to patentability, at the conclusion of
the interview, applicant may be	given a courtesy copy of a First Action
Interview Office Action (before mailing), which will set forth any
requirements, objections, and rejections. Once mailed the First Action
Interview Office Action, coupled with the interview and accompanying
interview summary form, will be considered a first Office action on the
merits. Applicant will be given one month or thirty days, whichever is
longer, from the issue date of the First Action Interview Office Action to
reply, with limited extensions of time.

Requirements section of this notice are satisfied.

Group II as outlined below may be eligible for the First Office Action

   (1) Filed on or before September 1, 2005, and prior to a first action on
   the merits;

   (2) Classified in Class 709 (Electrical Computers and Digital Processing

   (3) Assigned to an art unit in either working group 2140 (group art unit
   214x) or 2150 (group art unit 215x).

GrouII:

   (1) Filed on or before November 1, 2006, and prior to a first action on
   the merits;

   (2) Classified in Class 707 (Data Processing: Database and File
   Management or Data Structures); and

   (3) Assigned to an art unit in working group 2160 (group art unit 216x).

Requirements: A request for a first action interview will be granted in an

(3) The request for a first action interview must be filed electronically

form PTO/SB/413C, which is available on the USPTO web site at
http://www.uspto.gov/web/forms/index.html.

(4) The request must be filed at least one day before a first Office action
on the merits of the application appears in the Patent Application
Information Retrieval (PAIR) system (at least one day prior to the date
when a first Office action on the merits, notice of allowability or
allowance, or action under Ex parte Quayle, 1935 Dec. Comm'r Pat. 11
(1935), appears in the PAIR system). Applicant may check the status of the
application using the PAIR system.

(5) Applicant must agree not to file a request for a refund of the search
fee and any excess claim fees paid in the application after the issue date
of the Pre-Interview Communication. Any petition for express abandonment
under 37 CFR 1.138(d) to obtain a refund of the search fee and any excess
claim fees paid or request for a refund of any excess claim fees will not
be granted. No search fee and excess claim fees will be refunded after the
issue date of a Pre-Interview Communication. The request must include a
statement that applicant agrees not to file a request for a refund of the
search fee and any excess claim fees paid in the application after the
issue date of the Pre-Interview Communication. See form PTO/SB/413C.

The application under the First Action Interview Pilot Program will not be
advanced out of turn for examination, but most likely will be taken up for
examination in the order of its effective United States filing date in

accordance with MPEP § 708. Thus, a petition to make special under 37 CFR
1.102(c) is not required for an application to be eligible for the First
Action Interview Pilot Program.

Requirement for Restriction: If the application contains two or more
independent and distinct inventions, the examiner may make a requirement
for restriction in accordance with current restriction practice prior to
conducting a search. The examiner will contact the applicant and follow the
procedure for the telephone restriction practice set forth in MPEP §
812.01. Applicant is encouraged to make an election without traverse during
the telephone interview in order to expedite examination. If applicant
cannot make an election over the phone, or the examiner cannot reach the
applicant after a reasonable effort (not to exceed three business days),
the examiner will issue a restriction requirement in accordance with
current policy and practice. See MPEP § 814 et seq. After an appropriate
election is made in an application with a compliant request for a first
action interview, the examiner will proceed with the preparation of the
Pre-Interview Communication.

Improper Requests for First Action Interviews: If applicant files a request
for a first action interview that does not comply with the requirements set
forth in this notice, the Office will notify the applicant of the
deficiency by issuing a Notice of Non-Compliant First Action Interview
Request (PTOL-413NC). If applicant still wishes to participate in the First
Action Interview Pilot Program, applicant must file a proper request and
make appropriate corrections within one month or 30 days, whichever is
longer. This time period for reply is not extendable under 37 CFR 1.136(a).
If applicant fails to correct the deficiency indicated in the Notice of
Non-Compliant First Action Interview within the time period set forth
therein, the application will not be eligible for the First Action
Interview Pilot Program and the examiner will proceed with the preparation
of a first Office action on the merits of the application in due course.

Pre-Interview Communication: If the application contains only one invention
or applicant has elected one invention, the examiner will conduct a prior
art search for the claimed invention under consideration. If the examiner
determines that the application is in condition for allowance or the
application could be placed in condition for allowance with minor
corrections or a possible amendment or submission, a first action interview
under the pilot program will not be necessary. The examiner may allow the
application, or contact the applicant and conduct a regular interview in
accordance with MPEP § 713 to discuss any possible amendment or submission
to place the application in condition for allowance. Otherwise, the
examiner will prepare a Pre-Interview Communication (PTOL-413FP) and a
Notice of References Cited (PTO-892) citing the prior art references and
identifying potential rejections or objections.

The Pre-Interview Communication (PTOL-413FP) will set forth a time period
of one month or 30 days, whichever is longer, within which applicant must
file either: (1) a letter requesting to not have a first action interview,
or (2) an Applicant Initiated Interview Request Form (PTOL-413A)
accompanied by a proposed amendment or arguments, to avoid the abandonment
of the application. This time period for reply is not extendable under 37
CFR 1.136(a).

The examiner's typical working schedule will also be provided with the
Pre-Interview Communication (PTOL-413FP) so applicant will be aware of the
examiner's availability when scheduling the interview.

Once a Pre-Interview Communication (PTOL-413FP) has been issued in an
application, applicant no longer has a right to amend the application until
the first action interview is conducted and the First Action Interview
Office Action is mailed. Any amendment other than a proposed amendment
filed after the issue date of the Pre-Interview Communication (PTOL-413FP),
but before the interview and/or issue date of a First Action Interview
Office Action (PTOL-413FA), will not be entered, unless approved by the

examiner. This is because the examiner has devoted a significant amount of
time to the preparation of the Pre-Interview Communication before the
amendment will be received. See 37 CFR 1.115(b) and MPEP § 714.01(e). The
Office may enter the amendment if it is clearly limited to: cancellation of
claims; adoption of examiner suggestions; placement of the application in
prima facie condition for allowance; and/or correction of informalities
(similar to the treatment of an after-final amendment). Amendments will be
entered solely at the examiner's discretion.

Request to Not Have a First Action Interview: If applicant files a letter
requesting to not have a first action interview within one month or 30
days, whichever is longer, from the issue date of the Pre-Interview
Communication (PTOL-413FP), a first action interview will not be conducted.
The examiner will then set forth the requirements, objections, and
rejections in the First Action Interview Office Action (PTOL-413FA) in due
course.

The First Action Interview Office Action (PTOL-413FA) is the first Office
action on the merits because it sets forth all requirements, objections and
grounds of rejection including the identification of the prior art
references, statutory basis for the rejection, and the claims being
objected to or rejected. Because the requirements, objections and grounds
of rejection are provided in the Pre-Interview Communication (PTOL-413FP)
and the First Action Interview Office Action (PTOL-413FA), applicant has
sufficient notice of the requirements, objections and grounds of rejection.
To avoid abandonment of the application, applicant must, within one month
or 30 days, whichever is longer, from the issue date of the First Action
Interview Office Action (PTOL-413FA), file a reply in compliance with 37
CFR 1.111. This time period for reply is extendable under 37 CFR 1.136(a)
for only one additional month.

Applicant Must Timely Schedule the Interview: Upon review of the
Pre-Interview Communication (PTOL-413FP), if applicant still wants a first
action interview with the examiner, applicant must file within one month
or 30 days, whichever is longer, an Applicant Initiated Interview Request
Form (PTOL-413A), or an equivalent paper. Applicant must designate a
proposed date for the interview accompanied by a proposed amendment or
remarks (arguments) as an attachment to the request, to schedule the first
action interview. The applicant's proposed date for the interview can be no
more than two months or 60 days, whichever is longer, from the issue date
of the Pre-Interview Communication (PTOL-413FP). Applicants should consult
the examiner's work schedule provided in the PTOL-413FP and discuss with
the examiner the best date for conducting the interview. The applicant's
failure to conduct an interview within two months or 60 days from the issue
date will be treated as a failure to respond to the Pre-Interview
Communication. The interview may be in person, telephonic or
video-conferenced. Applicant must provide written authorization to conduct
any Internet e-mail communications with the examiner. See MPEP § 502.03 for
more information.

Inventor Participation: Inventor participation in the interview process is
encouraged, as it may assist in the resolution of outstanding rejections
and/or objections.

Failure to respond to Pre-Interview Communication: Failure to timely
respond to the Pre-Interview Communication either by not submitting a
request not to conduct the first action interview or to schedule the
interview will result in abandonment of the application.

Preparation for the Interview: Applicant must be prepared to fully discuss
the prior art of record, any of the relevant interview talking points and
any potential rejections or objections with the intent to clarify and
resolve all issues with respect to patentability during the interview.
Applicant must also be prepared to discuss any proposed amendment or
remarks (arguments) previously submitted and discuss and resolve any

Applicant may file a proposed amendment or remarks (arguments) for
discussion during the interview. Multiple proposed amendments or sets of
remarks (arguments) are not permitted. The proposed amendment or remarks
(arguments) must be clearly labeled as "PROPOSED" at the header or footer
of each page of the proposed amendment or remarks (arguments) and filed as
an attachment to the Applicant Initiated Interview Request Form
(PTOL-413A), or an equivalent paper. The proposed amendment or remarks
(arguments) will not be entered as a matter of right. The examiner, based
upon discussions, feedback and agreement with applicant during the
interview may at his or her discretion enter the amendment into the record
if found sufficient to advance prosecution on the merits. See MPEP §§
713.01 III and 713.04; see also MPEP §§ 714 and 1302.04.

A non-exhaustive listing of potential topics for discussion in a first
action interview will be made available to the public and the patent
examining corps to assist and facilitate comprehensive and effective first
action interviews. See the list of topics provided in the Interview Talking
Points posted on the USPTO web site at

First Action Interview: The interview will be conducted in accordance with
the procedure provided in MPEP § 713 except as otherwise provided in this
notice. The interview should focus on and include:

   1. A discussion to assist the examiner in developing a better
      understanding of the invention;

   2. A discussion to establish the state of the art at the time the
      invention was made, including the prior art references cited by the
      applicant and the examiner; and

   3. A discussion of the features of the claimed subject matter which make
      the invention patentable, including any proposed amendments to the
      claims.

An agreement is reached: At the conclusion of the interview, if applicant
and the examiner reach agreement that the application is in condition for
allowance, the examiner must complete an Interview Summary (PTOL-413),
enter and attach any necessary amendments or arguments (e.g., the proposed
amendment and/or an examiner's amendment), generate a notice of
allowability (PTOL-37) and attach a copy of the completed Applicant
Initiated Interview Request Form (PTOL-413A). In a personal interview, a

I. Background

   The United States Patent and Trademark Office (USPTO) has established a
21st Century Strategic Plan to transform the USPTO into a more quality-
focused, highly productive, responsive organization supporting a market-
driven intellectual property system. One of the specific action items of
the 21st Century Strategic Plan is to share search results with other
intellectual property offices. By relying on the search results obtained
via partnerships with other intellectual property offices, the USPTO can
reduce duplication of efforts and decrease workload.

   From July 2006 to January 2008, the USPTO partnered with the Japan
Patent Office (JPO) to establish the first Patent Prosecution Highway pilot
program (PPH). The PPH leverages accelerated examination procedures
already available in both offices to allow applicants in both offices to
obtain corresponding patents faster and more efficiently. The PPH also
permits each office to benefit from the work previously done by the other
office, in turn helping to reduce workload and improve patent quality. The
USPTO and the JPO began full implementation of the PPH program starting
January 4, 2008.

   USPTO has also commenced separate PPH pilot programs with the Canadian
Intellectual Property Office (CIPO), the Korean Intellectual Property
Office (KIPO), and the United Kingdom Intellectual Property Office (UK
IPO), based on the same framework as the PPH between the USPTO and JPO.

   Following on these partnerships, the USPTO and IP Australia (IPAU) have
agreed to launch a PPH pilot program similar to the PPH pilot programs
noted above.

II. Patent Prosecution Highway Pilot Program

   The PPH was established to enable an applicant whose claims are
determined to be allowable in the Office of first filing (OFF) to have the
corresponding application filed in the Office of second filing (OSF)
advanced out of turn for examination while at the same time allowing the OSF
to exploit the search and examination results of the OFF.

   Where the USPTO is the OFF and the U.S. application contains claims
that are determined to be allowable, the applicant may likewise request
accelerated examination at IPAU for the corresponding application filed
with IPAU as the OSF. The procedures and requirements for filing a
request with IPAU for participation in the PPH pilot program are available
from the IPAU web site at:  www.ipaustralia.gov.au. Where IPAU is the OSF,
applicant may provide IPAU with the necessary documents for requesting
participation in the PPH pilot program, or request that IPAU obtain the
necessary documents for requesting participation in the PPH pilot program
from the USPTO Public PAIR system. In those rare situations where the U.S.
application has not been published, and therefore the U.S. file wrapper
is not available via Public PAIR, applicant will be responsible for
providing the necessary documents to IPAU.

   Where the USPTO is the OSF and the corresponding application filed with
IPAU as the OFF contains claims that are determined to be allowable, the
applicant may request participation in the PPH pilot program in the USPTO
and petition to make the U.S. application special under the PPH pilot
program. Note that the procedures for a petition to make special under the
accelerated examination program set forth in MPEP 708.02(a) do NOT apply to
a petition to make special under the PPH pilot program. The procedures and
requirements for filing a request in the USPTO for participation in the
PPH pilot program are set forth below.

A. Trial Period for the PPH Pilot Program

   The PPH pilot program will commence on April 14, 2008, for a period of
one year ending on April 14, 2009. The trial period may be extended for up
to an additional year if necessary to adequately assess the feasibility of
the PPH program. The USPTO and IPAU will evaluate the results of the pilot
program to determine whether and how the program should be fully implemented
after the trial period. The Offices may also terminate the PPH pilot
program early if the volume of participation exceeds manageable level, or
for any other reason. Notice will be published if the PPH pilot program
will be terminated before the April 14, 2009 date.

B. Requirements for Requesting Participation in the PPH Pilot Program
in the USPTO

   In order to be eligible to participate in the PPH pilot program, the
following conditions must be met:

      (1) The U.S. application is
	(a) a Paris Convention application which either
	   (i) validly claims priority under 35 U.S.C. 119(a) and
	   37 CFR 1.55 to one or more applications filed with IPAU, or
	   (ii) validly claims priority under 35 U.S.C. 119(a)/365(a) to a
           PCT application that contains no priority claims,

	or

	(b) a national stage application under the PCT (an application
	which entered the national stage in the U.S. from a PCT
	international application after compliance with 35 U.S.C. 371),
	which PCT application
	   (i) validly claims priority under 35 U.S.C. 365(b) to an
	   application filed with IPAU, or
	   (ii) validly claims priority under 35 U.S.C. 365(b) to a PCT
	   application that contains no priority claims, or
	   (iii) contains no priority claim,

	or

	(c) a so-called bypass application filed under 35 U.S.C. 111(a)
	which validly claims benefit under 35 U.S.C. 120 to a PCT
	application, which PCT application
	   (i) validly claims priority under 35 U.S.C. 365(b) to an
	   application filed with IPAU, or
	   (ii) validly claims priority under 35 U.S.C. 365(b) to a PCT
	   application that contains no priority claims, or
	   (iii) contains no priority claim.

   Provisional applications, plant and design applications, reissue
applications, reexamination proceedings, and applications subject to a
secrecy order are excluded and not subject to participation in the PPH.

   (2) The IPAU application(s) has at least one claim that was determined
by IPAU to be allowable. Applicant must submit a copy of the allowable
claims from the IPAU application(s). If the IPAU office action does not
explicitly state that a particular claim is allowable, applicant must
include a statement in the request for participation in the PPH pilot
program that no rejection has been made in the IPAU office action regarding
that claim and therefore, the claim is deemed allowable by IPAU.

   (3) All the claims in each U.S. application for which a request for
participation in the PPH pilot program is made must sufficiently correspond
or be amended to sufficiently correspond to the allowable claims in the
IPAU application(s). Claims will be considered to sufficiently correspond
where, accounting for differences due to claim format requirements, the
claims are of the same or similar scope. Applicant is also required to
submit a claims correspondence table in English. The claims correspondence
table must indicate how all the claims in the U.S. application correspond
to the allowable claims in the IPAU application(s).

   (4) Examination of the U.S. application for which participation in the
PPH pilot program is requested has not begun.

   (5) Applicant must file a request for participation in the PPH pilot
program and a petition to make the U.S. application special under the PPH
pilot program. A sample request/petition form (PTO/SB/20AU) is available
from the USPTO web site at http://www.uspto.gov on April 14, 2008.
Applicants are encouraged to use the USPTO request/petition form. A petition
fee under 37 CFR 1.17(h) for the petition to make special under 37 CFR
1.102(d) is required and must be submitted.

   (6) Applicant must submit a copy of all the office actions (which are
relevant to patentability) from each of the IPAU application(s) containing
the allowable claims that are the basis for the request. In addition,
applicant must submit copies of any office actions (which are relevant to
patentability) from the IPAU application(s) issued after the grant of the
request for participation in the PPH pilot program in the USPTO (especially
where IPAU might have reversed a prior holding of allowability).

   (7) Applicant must submit an information disclosure statement (IDS)
listing the documents cited by the IPAU examiner in the IPAU office action
(unless such an IDS has already been filed in the U.S. application).
Applicant must submit copies of all the documents cited in the IPAU office
action (unless the copies have already been filed in the U.S. application)
except U.S. patents or U.S. patent application publications.

   The request for participation in the PPH pilot program and all the
supporting documents must be submitted to the USPTO via EFS-Web and indexed
with the following document description: "Petition to make special under
Patent Pros Hwy."  Information regarding EFS-Web is available at
http://www.ustpo.ogv/ebc/efs_help.html. Any preliminary amendments and IDS
submitted with the PPH documents must be separately indexed as a preliminary
amendment and IDS, respectively.

   Where the request for participation in the PPH pilot program and special
status are granted, applicant will be notified and the U.S. application will
be advanced out of turn for examination. In those instances where the
request for participation in the PPH pilot program does not meet all the
requirements set forth above, applicant will be notified and the defects in
the request will be identified. Applicant will be given one opportunity to
perfect the request in a renewed request for participation (which must be
submitted via EFS-Web and indexed accordingly as noted above). Note that
action on the application by the examiner will NOT be suspended
(37 CFR 1.103) awaiting a reply by the applicant to perfect the request in
a renewed request for participation. That is, if the application is picked
up for examination by the examiner after applicant has been notified
of the defects in the request, any renewed request will be dismissed.
If the renewed request is perfected and examination has not begun, the
request and special status will be granted, applicant will be notified and
the U.S. application will be advanced out of turn for examination. If not
perfected, applicant will be notified and the application will await action
in its regular turn.

   (8) Request for participation in the PPH pilot program and special
status granted in a parent application will not carry over to a continuing
application. Continuing applications must separately fulfill the conditions
set forth above.

   If any of the documents identified in items (2), (6) and (7) above have
already been filed in the U.S. application prior to the request for
participation in the PPH pilot program, it will not be necessary for
applicant to resubmit these documents with the request for participation.
Applicant may simply refer to these documents and indicate in the request
for participation in the PPH pilot program when these documents were
previously filed in the U.S. application.

C. Special Examining Procedures

   Once the request for participation in the PPH pilot program and special
status have been granted to the U.S. application, the U.S. application will
be taken up for examination by the U.S. examiner before all other categories
of applications except those clearly in condition for allowance, those with
set time limits, such as examiner's answers, and those that have been
granted special status for "accelerated examination."

   Any claims amended or added after the grant of the request for
participation in the PPH pilot program must sufficiently correspond to one
or more allowable claims in the IPAU application(s). Applicant is required
to submit a claims correspondence table along with the amendment (see B.(3)
above). If the amended or newly added claims do not sufficiently correspond
to the allowable claims in the IPAU application(s), the amendment will not
be entered and will be treated as a non-responsive reply.

   The PPH program does not absolve applicants of all their duties under
37 CFR 1.56 and 37 CFR 10.18. By complying with requirements B.(6) and
B.(7) identified above, applicants would be considered to have complied
with their duties to bring to the attention of the USPTO any material prior
art cited in the corresponding foreign application(s) (see MPEP
§ 2001.06(a)). Applicants still have a duty of candor and good faith,
including providing to the USPTO other information known to them to be
material to patentability.

Background - Public PAIR(1) data mining affects United States Patent and
Trademark Office systems

   Regular users of Public PAIR observed that system availability and
response time were erratic from November 2007 through January 2008.
Bulk downloads of massive amounts of data were impeding service to
individuals who regularly use the system, including members of law firms
and corporations and independent inventors.

   After several unsuccessful attempts to prevent disruptive bulk
downloading, the USPTO implemented a reCAPTCHA(tm)(2) security response in
Public PAIR(3).   Public PAIR users are now required to manually enter a
two-word verification code into the reCAPTCHA(tm) security screen before
accessing Public PAIR data. The reCAPTCHA(tm) deployment was a short-term
response, not the long-term solution to bulk download.

The Electronic Official Gazette of the U.S. Patent and Trademark Office - Patents (eOG:P) provides the information contained in the paper version of the Official Gazette in electronic format on CD-ROM. Similar to the paper OG, the eOG:P is published every Tuesday and includes bibliographic information, a representative claim, and a drawing (if applicable) of each patent issued that week. Patents are accessible by type of patent (utility, plant, etc.), classification (class or class/subclass), patentee name, and geographical location. Links enable users to "jump" to a specific patent from these various indexes. The eOG:P is sold as an annual subscription or as single copies.
