United States Patent and Trademark Office OG Notices: 29 October 2002

                              Notice of Exclusion

   Walter R. Mybeck, II, of Gilbert, AZ, and Wailuku, HI,
Registration Number 39,526. An Administrative Law Judge entered an
initial decision on default dated August 15, 2002, ordering Mybeck be
excluded for having engaged in professional misconduct in violation of
37 CFR   10.23(b)(1) (violating a disciplinary rule),   10.23(c)(5)
(conduct prejudicial to the administration of justice),   10.23(c)(14)
(failing to advise the OED Director of any change that would preclude
continued registration under   10.6),   10.23(c)(16) (refusing to
report or reveal knowledge or evidence),   10.77(c) (neglect),
10.84(a)(1) ((failing to seek a client's lawful objectives), and
10.84(a)(2) (failing to carry out a contract) arising from charges
alleging that Mybeck did not prepare and file a patent application for
a client. No appeal has been filed. Failure to appeal is deemed to be
both acceptance by Mybeck of the initial decision and waiver of the
right to further administrative or judicial review. 37 CFR
10.155(d). Mybeck has been excluded, as of Saturday, September 15,
2002, from practice before the United States Patent and Trademark
Office in patent, trademark, and other non-patent law. This action is
taken pursuant to 35 U.S.C.   32, and 37 CFR    10.155(d), and
10.159(b).
