Patent Term Extended Under 35 U.S.C. ú 156 An interim extension of the term of U.S. Patent No. Re. 34,617 has been granted under 35 U.S.C. 156(e)((2) for a period of one year from the extended expiration date of the patent. The patent has twice been extended for one year under 35 U.S.C. 156(d)(5). See 1159 OG 77, February 22, 1994, and 1171 OG 32, February 14, 1995. An application for patent term extension was filed, on January 24, 1996, by The Procter and Gamble Company, based on approval of the food additive product "olestra" by the Food and Drug Administration (FDA) on January 24, 1996. The initial PTO review of the application to date indicates that the patent would now be eligible for a maximum extension of the patent term for a period of two years from the date of approval by the FDA (January 24, 1996) under 35 U.S.C. 156(g)(6)(C) and (d)(5)(E)(ii).
