Supporting the Implementation Roadmap for the U.S. Government National Standards Strategy for Critical and Emerging Technology
To support the objectives of the Implementation Roadmap, the USPTO plans to continue engaging with foreign governments to provide balance and efficiency around fair, reasonable, and non-discriminatory (FRAND) licensing. Additionally, we've committed to develop and deliver educational training for small and medium-sized enterprises. These trainings will be specific to intellectual property rights pertaining to standards development and implementation.
“Raising awareness and strengthening public-private coordination on standards as they relate to AI and other critical and emerging technology ensures we remain a global innovation leader,” said Kathi Vidal, Under Secretary of Commerce for Intellectual Property and Director of the USPTO. “We are proud to play a role in the National Standards Strategy as we work with foreign partners on global alignment on standard essential patents (SEP) to advance a vibrant and competitive SEP market.”
The USPTO continues to collaborate with foreign partners to forge alliances and work toward enhanced efficiencies in standard essential patents licensing markets. So far, the USPTO has signed a Memorandum of Understanding (MOU) with the United Kingdom Intellectual Property Office to this effect on June 3, 2024. The agency has also partnered with the World Intellectual Property Organization on dispute resolution efforts related to standard essential patents via an MOU signed July 20, 2022.
