Public comment sought on upcoming treaty negotiations on intellectual property, genetic resources, and traditional knowledge

The United States Patent and Trademark Office (USPTO) seeks comments from the public regarding certain text-based negotiations undertaken by the World Intellectual Property Organization’s Intergovernmental Committee (WIPO IGC) on Intellectual Property and Genetic Resources, Traditional Knowledge, and Folklore.
In 2024, WIPO plans to hold a diplomatic conference to conclude a treaty on intellectual property (IP), genetic resources, and traditional knowledge associated with genetic resources. The USPTO is responsible, in consultation with other U.S. government agencies, for developing U.S. positions on these matters.
The diplomatic conference will be considering provisions on genetic resources and associated traditional knowledge. These negotiations may result in changes to requirements for filing patent applications and grounds for challenging patent rights. Also, the WIPO IGC is undertaking text-based negotiations on IP, traditional knowledge, and traditional cultural expressions. Input from U.S. stakeholders will assist the USPTO as it represents the United States in both negotiations.
