PTAB Releases Frequently Asked Questions about the implications of SAS on AIA trial proceedings

We have released a series of “Frequently Asked Questions (FAQs)” about the implications of SAS on AIA trial proceedings. These FAQs were based upon questions received from the public and are grouped into five categories as follows:

A.      Effect of SAS on AIA proceedings generally.

B.      Effect of SAS on on-going partially-instituted proceedings.

C.      Effect of SAS on instituted challenges previously denied for statutory reasons.

D.      Effect of SAS on future challenges that could be denied for statutory reasons.

E.      Content of institution decisions post-SAS.

F.      For additional questions about SAS.

The FAQs are intended to provide additional information about how the agency is applying SAS to AIA trial proceedings. These SAS FAQs will be updated periodically, so please continue to submit your questions to trials@uspto.gov.
