Highlights of TEAS 5.2 and TEASi 2.3 Release

The following significant changes to TEAS and TEASi are tentatively scheduled to be implemented on August 23, 2014. If you have any questions or concerns regarding the release, please contact TEAS@uspto.gov.

All Forms

  • Timeliness Validation: To prevent users from erroneously filing late documents, the forms will be enhanced to verify form timeliness when the Pay/Submit button is clicked at the conclusion of the filing process.
  • Notification Text Box: The first page of each form will be enhanced to include a notification text box, which will appear only when there are important notifications, such as TEAS updates, announcements, and system outage information.
  • Cross-Over Data Warning: A warning will now appear in all forms, notifying users of a possible cross-over data problem if multiple versions of a form are left open in Internet Explorer. The warning will read as follows. WARNING: The system has detected that multiple windows sharing the same session might be open or that you improperly used the browser's back or refresh button rather than the "Go Back" button at the bottom of the page. It is recommended that you close this window by clicking the "Close this window" button and begin a new, discreet session. If you choose to continue by clicking the "Continue" button, you should verify at the point of validation that all data is correct for this intended submission, as it very possible that an interchange of data has taken place between the windows sharing the same session.
  • Help Section: The text that appears in the help section will be revised for clarity, consistency, and to correct typographical errors. Additionally, the "Help" web pages will be migrated to a new software program to ensure edits are possible without a TEAS maintenance release.
  • Form OMB Information: To allow the USPTO to edit PTO form numbers, OMB numbers, form expiration dates, and burden/privacy statements without a TEAS maintenance release, the storage of these data will be migrated to a new location.
  • Status Codes/Due Date Calculator: Form status codes and the timeliness calculator will be moved to a configuration file to facilitate modifications, allowing the form due dates to be reprogrammed to accept delayed filings in the event of an office closure and eliminating the need for customers to use cumbersome workaround procedures.
  • Email Address Validator: The file that validates email addresses entered into the form has been updated to feature more email addresses, including .tel.

Sound and Multimedia Files

Expanded Ability to Upload Sound/Multimedia Files: Currently, for new applications on the Principal Register, sound marks and sound/motion/multi-media specimens can be submitted directly through TEAS. However, the submission of such files for forms other than new applications requires a cumbersome workaround approach that involves sending the sound or motion file as an e-mail attachment directly to TEAS Support, who then manually uploads the files. The following TEAS forms will be enhanced to allow users to submit sound and/or multimedia files directly through TEAS.

The file must be in .wav, .wmv, .wma, .mp3, .mpg, or .avi format and should not exceed 5 MB in size for audio files and 30 MB for video files.

Other forms will be enhanced at a later time to permit direct submissions through TEAS. Until this enhancement is implemented, the specimen and evidence submission for other forms must be done through the workaround approach available at http://www.uspto.gov/trademarks/teas/teas_faq.jsp#TEASsoundspec.

Letter of Protest Form

Field Structured Form: The current letter of protest form will be replaced with a "regular" (field structured) form that will allow for the automatic and therefore faster uploading of data into the official record.

Response to Suspension Inquiry Form

New Checkboxes: The Response to Suspension Inquiry form will be enhanced to allow users to request removal of the application from suspension for the examining attorney to consider a submission, such as an amendment and/or consent agreement.

Intent-to-Use and Petition Forms

Miscellaneous Statement Field: A "Miscellaneous Statement" section will be added to the Request for Extension of Time to File a Statement of Use and Petition to Revive Abandoned Application - Failure to File Timely Statement of Use or Extension Request forms. This section will allow users to enter information for which no other section of the form is appropriate and to upload attachments.

A new note will be added to both forms stating that ownership changes must be separately explained in the "Miscellaneous Statement" portion of the form.

Change of Owner's Address Form

Owner Email Address: The form will be enhanced to allow for the updating and/or removal of an owner email address. Additionally, the form will be enhanced to allow a user to file a change of owner address for an application/registration that has multiple owners.

Madrid Protocol (TEASi) Forms

  • Form OMB Information: To allow the USPTO to edit PTO form numbers, OMB numbers, form expiration dates, and burden/privacy statements without a TEASi maintenance release, the storage of these data will be migrated to a new location.
  • New Mark Image Selection Feature: The free text version of the Application for International Registration form will be enhanced to provide users with the option of choosing a mark image file from images submitted with the basic application.
  • Notification Text Box: The first page of each form will be enhanced to include a notification text box, which will appear only when there are important notifications, such as TEAS updates, announcements, and system outage information.
  • Help Section: The text that appears in the help section will be revised for clarity, consistency, and to correct typographical errors. Additionally, the "Help" web pages will be migrated to a new software program to ensure edits are possible without a TEASi maintenance release.
  • Country Codes: The TEASi forms will be enhanced to move the country codes to a new storage location to allow the USPTO to edit the data without a TEASi maintenance release.
  • Representative Contact Information: The forms have been enhanced to validate the applicant's representative contact information to ensure that a complete address has been provided. Additionally, the correspondence address fields for representatives will be enhanced to specify the character limit for each field.
