USPTO Hour: Updates on Subject Matter Eligibility Under 35 U.S.C. 101

  • A memorandum issued in August 2025 reminding examiners about important aspects of the USPTO’s subject matter eligibility guidance.
  • A recently issued Appeal Review Panel decision (Ex parte Desjardins, 2024-00567) reversing a new ground of rejection under 35 U.S.C. 101.
