Learn about the interim Director review process following U.S. v. Arthrex, Inc.

The recent Supreme Court decision in U.S. v. Arthrex, Inc. provided the Director of the United States Patent and Trademark Office (USPTO) the authority to review a Patent Trial and Appeal Board (PTAB) final decision in an inter partes review by rehearing. The USPTO has implemented an interim procedure for Director review consistent with this decision.
