| 1. A method for expressing a nucleotide sequence in a plant, said method comprising introducing into a plant a DNA construct,
said DNA construct comprising a promoter and operably linked to said promoter a heterologous nucleotide sequence of interest,
wherein said promoter comprises a nucleotide sequence selected from the group consisting of:
a) a nucleotide sequence comprising the sequence set forth in SEQ ID NO: 1;
b) a nucleotide sequence comprising the plant promoter sequence of the plasmid designated as Patent Deposit No. PTA-6275;
and
c) a nucleotide sequence comprising at least 800 contiguous nucleotides of the sequence set forth in SEQ ID NO: 1, wherein
said nucleotide sequence initiates transcription in said plant.
