| 1. A method for determining a data rate for data transmission from a UE to a Node B in a mobile communication system, the
method comprising the steps of:
determining a preliminary data rate in consideration of a quantity of data waiting for transmission;
comparing the preliminary data rate with a previous data rate used for previous data transmission;
outputting a rate request message “UP” when the determined preliminary data rate is higher than the previous data rate, outputting
a rate request message “DOWN” when the determined preliminary data rate is lower than the previous data rate, and outputting
a rate request message “KEEP” when the determined preliminary data rate is equal to the previous data rate;
setting a UE pointer according to the rate request message; and
determining the data rate using a selection probability for grant of the data rate received through a broadcast channel according
to a result of the comparing step.
