ANIMAL HUSBANDRY; CARE OF BIRDS, FISHES, INSECTS; FISHING; REARING OR BREEDING ANIMALS, NOT OTHERWISE PROVIDED FOR; NEW BREEDS OF ANIMALS
Definition statement
This subclass covers:

Relationship between large subject matter areas

Whilst A01K provides for equipment and methods associated with the care, nurturing, handling and rearing of all animals, and the harvesting of their products, devices and accessories for milking are classified in A01J. Furthermore, shoes for animals (e.g. horses, oxen and other solipeds) and associated accessories are classified in A01L. Devices for maintaining the appearance and welfare of animals (e.g. washing and grooming devices, shearing equipment, dehorners, horn trainers) are classified here, whilst veterinary equipment and methods for the medical treatment of animals are classified in A61D. A01K provides for fastening and tethering/restraining equipment for animals (e.g. halters, neck-bars, leads, collars), yet equine or similar harnesses and devices used in connection therewith are classified in B68B. A01K provides for new breeds of animals, irrespective of the manner of their production, including new breeds of multicellular animals, e.g. transgenic animals. It also provides for processes of obtaining such new animals. Processes and methods for genetic engineering and mutation per se are classified in C12N. Where genetic engineering or mutation techniques are used to produce new breeds of animals, multi-aspect classification in A01K 67/00 and C12N 15/00 should be applied. Breeding of animals not otherwise provided for is covered by A01K 67/00, whilst instruments or methods for reproduction or fertilisation (e.g. artificial insemination) is classified in A61D 19/00.

Documents relating to new peptides or new DNA or its corresponding mRNA encoding for peptides, and their use for the obtention of transgenic animals, are classified in subclass C07K or in group C12N 9/00 according to the peptides, with the appropriate Indexing Codes]

New breeds of vertebrates
Definition statement
This subgroup covers:

The germline of animals can be altered by introduction and/or deletion of genetic material. Such genetically modified animals can be used e.g. for the production of heterologous proteins or as models for disease. This subgroup covers transgenic vertebrates (A01K 67/0275-A01K 67/0278) and invertebrates (A01K 67/033+).

In addition, the following animals which do not necessarily comprise a modified germline are classified here: chimeric animals comprising somatic cells from another individual or species (A01K 67/0271), and cloned animals (A01K 67/0273)

Relationship between large subject matter areas

Symbols in the A01K 67/027-A01K 67/033 range are used in combination with C12N 15/8509 and subgroups if a meaningful disclosure of the vector (system) for transgenesis is given. Processes of producing embryos, including cloning of animals, are additionally indicated by C12N 15/873-C12N 15/877 symbols.

References relevant to classification in this subclass/group
This subgroup does not cover:

Breeding of animals

Preservation of embryos

Embryonic and germ cells per se

Special rules of classification within this subclass/group

Modified animals are classified in A01K 67/027-A01K 67/033 (animals), C12N 15/8509, C12N 15/873, C12N 15/877 (relating to vectors and methods for producing such animals) and the following ranges of symbols must be given (i.e. compulsory) to indicate further aspects thereof.

A01K 2207/00 relates to modifications that do not affect the germline.

A01K 2217/00 indicates various technical aspects of genetic modification.

A01K 2227/00 defines the species of the (genetically modified) animal.

A01K 2267/00 indicates the purpose of the (genetically modified) animal.

Whereas symbols in the A01K 2217/00 range are restricted to genetically modified animals, the symbols in the A01K 2207/00, A01K 2227/00 and A01K 2267/00 ranges are used for all modified animals covered by A01K 67/027-A01K 67/033, C12N 15/8509, C12N 15/73 and C12N 15/877. Please note that multiple symbols from each category may be required to cover all disclosed aspects.

Genetically modified animals

When a genetically modified animal is actually made, A01K 67/0275-A01K 67/0278, A01K 67/033 or a subgroup thereof needs to be given, whereby the last place rule applies. If a vector for transgenesis is disclosed, additionally the C12N 15/8509 symbol needs to be given. The specific aspects of the animal are to be indicated with symbols in the A01K 2217/00, A01K 2227/00 and A01K 2267/00 ranges, which must always be given. When a human transgene is introduced, A01K 2207/15 is to be added.

Special elements of the vectors are indicated using symbols in the C12N 2800/00-C12N 2840/00 ranges, whereby A01K 2217/203 takes precedence over C12N 2830/001-C12N 2830/006, and A01K 2217/206 takes precedence over C12N 2830/008. The C12N 2830/001 to C12N 2830/008 symbols are only to be given if the invention actually resides in these elements.

If the transgene can be meaningfully indicated, C07K 14/00 and/or C12N 9/00 symbols are to be given. If a viral vector is used for transgenesis, the relevant symbol from the C12N 2710/00-C12N 2795/00 range combining the taxonomy of the virus with the ending 43 (for use as a genetic vector), must be given.

Chimeric animals

Chimeric animals (A01K 67/0271) may result from combining cells at the embryonic stage (e.g. the sheep-goat chimera 'geep'), or from exogenously added cells later in development, for instance transfer of functional immune system cells to immuno-compromised mice, or transplantation of tumor cells to form a tumor model.

The specific species (from the A01K 2227/00 series) and purpose (from the A01K 2267/00 series) of the chimeric animal must be indicated. When human cells are introduced, A01K 2207/15 is to be added.

When a chimeric animal is disclosed, which does not relate to the core of the invention, A01K 2207/12 is to be given.

Cloned animals

Documents relating to methods of producing cloned mammals (C12N 15/877 and subgroups) should also be classified in A01K 67/0273 if cloned animals have actually been obtained. In addition, the appropriate A01K 2227/00 symbol should be given to indicate the species, and where relevant, the purpose (A01K 2267/00). When manipulation of (germ) cells is involved, C12N 5/00 symbols should also be considered, following the classification rules of said field.
