She agreed that this letter relative to the proposed amendments of rules in 1328 00 200-205 could be faxed to her. As I explained to her, I do not have Internet service or address. Page 24 of the April 2008 issue of the AARP Bulletin sets forth that the Pew Internet & American Life Project stated that 92% of Americans ages 18-29 use the Internet, 85% of those 30-49 use the Internet, 72% of those 50-64, and 37% of those 65- plus. Since I am 81 and still practicing as a sole practitioner. I imagane that my age would be even less than 37%. The FTC Notices can no longer be purchased from the government Printing Office because the FTC ceased to provide any issue beyond December 24, 2007 to it even though it indicated in 2008 that subscriptions were being offered until my congressman advised it after helping me. Accordingly, I go to the University of Kentucky law school library and receive help from a reference librarian to obtain a copy of each weekly issue since I cannot click the mouse correctly. The Web site also has been changed at least once according to the reference librarian since I have been going there weekly. Therefore, it is submitted that the refusal to transmit at least by fax is discriminating against at least older sole attorneys in view of the Pew article. In fact, the most recent TMEP (5th edition) does not have any of the forms mentioned in the proposed rules to be amended. It was my understanding from Ms. Hannon that copies of the forms could not be obtained off the Internet, but only filled out and sent to the FTC by Internet. Reconsideration of the proposed rule is respectfully requested at least as to a fax since it is discriminatory against older sole practitioners incapable of using the Internet and a fax provides proof of receipt.
