• Effective prior art date of published applications under amended 35 U.S.C. § 102(e)(1):

• A patent application publication resulting from an application filed under 35 U.S.C. § 111(a) (non-PCT) is prior art as of its filing date

  • even if the patent application publication resulted from voluntary publication of an application filed before November 29, 2000
