Request for Continued Examination (RCE)

• Requirements:

• Prosecution in the application must be closed

• Requires the filing of a request (RCE), a submission, and fee prior to earliest of:

  • Payment of the issue fee (unless 37 CFR 1.313 petition granted)
  • Abandonment
  • Filing of court action (unless terminated)
