Request for Continued Examination (RCE)

• 35 U.S.C. § 132(b) provides for the continued examination of an application at the request of the applicant

• USPTO may require a fee for such continued examination

  • the fee is subject to a fifty percent reduction for small entities

• Fee amount set to be the same as the basic filing fee for a utility application
