                  Patent Cooperation Treaty (PCT) Information

   For information concerning PCT member countries, see the notice
appearing in the Official Gazette at 1393 O.G. 58, on August 13, 2013.

   For information on subject matter under Rule 39 that a particular
International Searching Authority will not search, see Annex D of the PCT
Applicants' Guide.

European Patent Office as Searching and Examining Authority

   The European Patent Office (EPO) may act as the International Searching
Authority (ISA) or the International Preliminary Examining Authority (IPEA)
for an international application filed with the United States Receiving
Office or the International Bureau (IB) as Receiving Office where at least
one of the applicants is either a national or resident of the United States
of America. However, the use of the EPO is restricted. The EPO will not act
as an ISA for applications with one or more claims directed to a business
method. For the definition of what the EPO considers to be precluded
subject matter in the field of business methods, see PCT Applicants's
Guide, Annexes D(EP), E(EP) and the Official Notices (PCT Gazette) dated
May 6, 2010, page 94
(http://www.wipo.int/pct/en/official_notices/index.html). The EPO will act
as an IPEA only if it also acted as the ISA.

   The search fee of the European Patent Office was decreased, effective
January 1, 2013, and was announced in the Official Gazette at 1385 O.G. 176,
on December 25, 2012.

Korean Intellectual Property Office as Searching and Examining Authority

The Korean Intellectual Property Office may act as the ISA or the IPEA for
an international application filed with the United States Receiving Office
or the International Bureau (IB) as Receiving Office where at least one of
the applicants is either a national or resident of the United States of
America. The announcement appears in the Official Gazette at 1302 O.G.
1261 on January 17, 2006.

   The search fee of the Korean Intellectual Property Office was increased,
effective January 1, 2013, and was announced in the Official Gazette at
1385 O.G. 176, on December 25, 2012.

Australian Patent Office as Searching and Examining Authority

   The Australian Patent Office (IP Australia) may act as the ISA or the
IPEA for an international application filed with the United States
Receiving Office or the International Bureau (IB) as Receiving Office where
at least one of the applicants is either a national or resident of the
United States of America. The announcement appears in the Offical Gazette
at 1337 O.G. 265, on December 23, 2008. However, the use of IP Australia is
restricted. IP Australia will not act as an ISA for applications with one
or more claims directed to the fields of business methods or mechanical
engineering or analogous fields of technology as defined by specified areas
of the International Patent Classification System, as indicated in the
Official Gazette at 1337 O.G. 261 on December 23, 2008, in Annex A to the
agreement between the USPTO and IP Australia. IP Australia will act as an
IPEA only if it also acted as the ISA.

   The search fee of IP Australia was decreased, effective September 1,
2013, and was announced in the Official Gazette at 1393 O.G. 170, on
August 27, 2013.

The Federal Service on Intellectual Property, Patents & Trademarks of
Russia as Searching and Examining Authority

   The Federal Service on Intellectual Property, Patents & Trademarks of
Russia (Rospatent) may act as the ISA or the IPEA for an international
application filed with the United States Receiving Office or the
International Bureau (IB) as Receiving Office where at least one of the
applicants is either a national or resident of the United States of
America. The announcement appears in the Official Gazette at 1378 O.G. 162,
on May 8, 2012.

   The search fee of Rospatent was increased, effective January 1, 2013,
and was announced in the Official Gazette at 1385 O.G. 176, on December 25,
2012.

Fees

   The fee for filing a request for the restoration of the right of
priority was changed, effective March 19, 2013, and was announced in the
Federal Register on January 18, 2013. The transmittal fee for the USPTO
was changed to include a basic portion and a non-electronic filing fee
portion, effective November 15, 2011, and was announced in the Federal
Register on November 15, 2011. Search fees for the USPTO were changed,
effective January 12, 2009, and were announced in the Federal Register on
November 12, 2008.

   International filing fees were increased, effective January 1, 2013,
and were announced in the Official Gazette at 1385 O.G. 176, on December 25,
2012.

                   Notice of Maintenance Fees Payable

   Title 37 Code of Federal Regulations (CFR), Section 1.362(d) provides
that maintenance fees may be paid without surcharge for the six-month
period beginning 3, 7, and 11 years after the date of issue of patents
based on applications filed on or after Dec. 12, 1980. An additional
six-month grace period is provided by 35 U.S.C. 41(b) and 37 CFR 1.362(e)
for payment of the maintenance fee with the surcharge set forth in 37 CFR
1.20(h), as amended effective Dec. 16, 1991. If the maintenance fee is
not paid in the patent requiring such payment the patent will expire on
the 4th, 8th, or 12th anniversary of the grant.

   35 U.S.C. 41 and 37 CFR 1.362(g) provide that if the required

           Implementation of the Global and IP5 Patent Prosecution
            Highway (PPH) Pilot Programs with Participating Offices

I. Background

   Beginning in July 2006, the United States Patent and Trademark Office
(USPTO) has partnered with several other offices in Patent Prosecution
Highway (PPH) programs. The PPH enables an applicant who receives a
positive ruling on patent claims from one participating office to request
accelerated prosecution of corresponding claims in another participating
office, which allows the applicant to obtain a patentability decision in
the second office more quickly. Furthermore, the PPH promotes patent
application processing efficiency by allowing the examiner in the office
of later examination (OLE) to reuse the search and examination results
from the office of earlier examination (OEE), thereby reducing workload
and duplication of effort.

   Since its inception, various enhancements to the original PPH program
have been introduced. For instance, a requirement that the OEE be the
office of first filing was eliminated under the "MOTTAINAI" program. See,
for example, the notice available at

Also, the scope of eligible search and examination results was expanded
to include Patent Cooperation Treaty (PCT) work products under the PCT-PPH
program. See, for example, the notice available at
http://www.uspto.gov/web/offices/com/sol/og/2010/week08/TOC.htm#ref17.
Additionally, the requirements for requesting participation in the PPH
were simplified under the PPH 2.0 program. See, for example, the notice
available at
http://www.uspto.gov/web/offices/com/sol/og/2012/week10/TOC.htm#ref15.

   As the work sharing benefits provided by the PPH have become apparent,
participation in the PPH program in its various forms has grown rapidly.
However, because the above-described modifications to the PPH program have
not been universally implemented by the different participating offices,
the administration of multiple PPH programs, each having particular
requirements, has become increasingly cumbersome. Recognizing the need and
opportunity for greater efficiency, the USPTO and several other offices
seek to consolidate and replace existing PPH programs, with the goal of
streamlining the PPH process for both offices and applicants. To this end,
the USPTO and other offices have established the Global PPH pilot program
and the IP5 PPH pilot program.

   The Global PPH and IP5 PPH pilot programs are running concurrently and
are substantially identical, differing only with regard to their respective
participating offices. The USPTO is participating in both the Global PPH
pilot program and the IP5 PPH pilot program. A list of the other offices
currently participating in the Global PPH pilot program is available at
http://www.uspto.gov/patents/init_events/pph/. The European Patent Office
(EPO), Japan Patent Office (JPO), Korean Intellectual Property Office
(KIPO), and State Intellectual Property Office of the People's Republic of
China (SIPO) are participating in the IP5 PPH pilot program.

   Because the USPTO has elected to participate in both the Global PPH
pilot program and the IP5 PPH pilot program, a PPH request may be filed in
the USPTO based on the work product of any office participating in either
pilot program. Furthermore, because the respective requirements for the
Global PPH and IP5 PPH pilot programs are equivalent, USPTO applicants
need not specify which pilot program is being utilized. For USPTO
applications, the Global PPH and IP5 PPH pilot programs supersede any prior
PPH program between the USPTO and each Global PPH and IP5 PPH participating
office. Any existing PPH programs between the USPTO and offices that are
not participating in either the Global PPH pilot program or the IP5 PPH
pilot program remain in effect.

II. Trial Period for the Global PPH and IP5 PPH Pilot Programs

   The Global PPH and IP5 PPH pilot programs commenced on January 6, 2014.
The Global PPH pilot program will run for a period of one year ending on
January 5, 2015. The IP5 PPH pilot program will run for a period of three
years ending on January 5, 2017. The trial period for each pilot program
may be extended if necessary to adequately assess the feasibility of the
PPH program. The participating offices will continually evaluate the
results of the Global PPH and IP5 PPH pilot programs to determine whether
and how the programs should be fully implemented. The offices also may
terminate either the Global PPH pilot program or the IP5 PPH pilot program
early if the volume of participation exceeds a manageable level, or for any
other reason. Notice will be published if either the Global PPH pilot
program or the IP5 PPH pilot program will be terminated.

III. Requirements for Requesting Participation in the Global PPH or IP5 PPH
     ("Global/IP5 PPH") Pilot Program in the USPTO

A. Eligibility

   In order to be eligible to participate in the Global/IP5 PPH pilot
program at the USPTO, the following requirements must be met:

   (1) The U.S. application for which participation in the Global/IP5 PPH
pilot program is requested must have the same earliest date, whether this
is the priority date or filing date, as that of a corresponding national or
regional application filed with another Global/IP5 PPH participating
office, or a corresponding PCT international application for which one of
the Global/IP5 PPH participating offices was the International Searching
Authority (ISA) or the International Preliminary Examining Authority
(IPEA).

   (2) The corresponding application has at least one claim indicated by
the OEE in its capacity as a national or regional Office, ISA, or IPEA to
be allowable/patentable. A claim determined as novel, inventive, and
industrially applicable by the ISA or IPEA has the meaning of
allowable/patentable for the purposes of this program.

   (3) All claims in the U.S. application for which participation in the
Global/IP5 PPH pilot program is requested must sufficiently correspond to
the allowable/patentable claims in the corresponding OEE application. A
claim is considered to sufficiently correspond where, accounting for
differences due to claim format requirements, the claim is of the same or
similar scope as an allowable/patentable claim in the corresponding OEE
application. A claim in the U.S. application that is narrower in scope than
the claims indicated as allowable/patentable in the OEE application will
sufficiently correspond if presented as a claim dependent upon a claim
that is of the same or similar scope as a claim indicated as
allowable/patentable in the OEE application. In this regard, a claim that
is narrower in scope occurs when an OEE claim is amended to be further
limited by an additional feature that is supported by the written
description of the U.S. application. Additionally, a claim in the U.S.
application that introduces a new/different category of claims than those
indicated to be allowable/patentable by the OEE is not considered to
sufficiently correspond. For example, where the OEE application contains
only claims relating to a process of manufacturing a product, then any
product claims in the U.S. application are not considered to
sufficiently correspond, even if the product claims are dependent on
process claims which sufficiently correspond to allowable/patentable claims
in the OEE application.

   (4) Substantive examination of the U.S. application for which
participation in the Global/IP5 PPH pilot program is requested has not
begun.

B. Required Documents

   For participation in the Global/IP5 PPH pilot program at the USPTO, the
applicant must submit:

   (1) A request for participation in the Global/IP5 PPH pilot program and
a request that the U.S. application be advanced out of turn for examination
by order of the Director to expedite the business of the Office under 37
CFR 1.102(a). A request form is available from the USPTO Web site at
http://www.uspto.gov/patents/init_events/pph/. A petition fee under 37 CFR
1.17(h) is NOT required. See Notice Regarding the Elimination of the Fee
for Petitions To Make Special Filed Under the Patent Prosecution Highway
(PPH) Programs, 75 Fed. Reg. 29312 (May 25, 2010).

   (2) A claims correspondence table in English, indicating how and
certifying that all the claims in the U.S. application correspond to
allowable/patentable claims in the OEE application.

   (3) A copy of the office action issued just prior to the "Decision to
Grant a Patent" (e.g., the latest "Notification of Reasons for Refusal") in
the OEE national/regional application, along with an English translation
thereof, if applicable, or the latest work product in the international
phase of the OEE PCT application (e.g., the Written Opinion of the ISA or,
where a demand under PCT Chapter II has been filed, the Written Opinion of
the IPEA or the International Preliminary Examination Report), along with
an English translation thereof, if applicable. Note that if the office
action or PCT work product is already present in the U.S. application or
is available via the Dossier Access System Web site at
http://www.jpo.go.jp/ppph-portal/filewrapper.htm or the PATENTSCOPE system
of the World Intellectual Property Organization (WIPO), the applicant must
identify the document but need not supply a copy thereof.

   (4) An information disclosure statement (IDS) listing the documents
cited in the office action or PCT work product submitted under item
III.B.(3) above along with copies of all documents except U.S. patents and
U.S. patent application publications. Note that any IDS or document copies
submitted in the U.S. application prior to the Global/IP5 PPH request need
not be resubmitted.

   The above-listed documents must be submitted via EFS-Web and indexed
with the document description "Petition to make special under the Patent
Pros Hwy," except that any preliminary amendment or IDS submitted with the
PPH request must be separately indexed as a preliminary amendment or an
IDS, respectively.

IV. Special Examining Procedures

   Where the request for participation in the Global/IP5 PPH pilot program
and special status is granted, the applicant will be notified and the U.S.
application will be advanced out of turn for examination. In those
instances where the request for participation in the Global/IP5 PPH pilot
program does not meet all the requirements set forth above, the applicant
will be notified and the defects in the request will be identified. The
applicant will be given one opportunity to perfect the request in a renewed
request for participation. Note that action on the application by the USPTO
will NOT be suspended (37 CFR 1.103) awaiting a renewed request for
participation. That is, if the application is picked up for examination
after the applicant has been notified of the defects in the request, any
renewed request will be dismissed. If the renewed request is perfected and
examination has not begun, the request and special status will be granted,
the applicant will be notified, and the U.S. application will be advanced
out of turn for examination. If the request is not perfected, the applicant
will be notified and the application will await action in its regular turn.

   Although a request for participation in the Global/IP5 PPH pilot program
and special status granted in an application carries over to a request for
continued examination (RCE) of the application, a request for participation

in the Global/IP5 PPH pilot program and special status granted in a parent
application will not carry over to a continuing application. The applicant
must fulfill all the conditions set forth above in order for special status
to be granted in a continuing application.

   Any claims amended or added after the grant of the request for
participation in the Global/IP5 PPH pilot program must sufficiently
correspond to one or more allowable/patentable claims in the OEE
application. The applicant is required to submit, along with the amendment,
a statement certifying that the amended or newly added claims sufficiently
correspond to the allowable/patentable claims in the OEE application. If
the certification statement is omitted, the amendment will not be entered
and will be treated as a non-responsive reply.

   The Global/IP5 PPH pilot program does not absolve applicants of all
their duties under 37 CFR 1.56 and 37 CFR 11.18. By complying with
requirements III.B.(3) and (4) identified above, the applicant would be
considered to have complied with the duty to bring to the attention of the
USPTO any material prior art cited in corresponding foreign applications
(see MPEP § 2001.06(a)). The applicant still has a duty of candor and good
faith, including providing to the USPTO other information known to be
material to patentability.

                      Extension of Comment Period on the
                         Proposed Changes to Require
                     Identification of Attributable Owner

AGENCY: United States Patent and Trademark Office, Commerce.

ACTION: Notice of public hearings and extension of comment period.

SUMMARY: The United States Patent and Trademark Office (Office)
published a notice on January 24, 2014, proposing changes to the rules
of practice to require that the attributable owner, including the
ultimate parent entity, be identified during the pendency of a patent
application and at specified times during the life of a patent, and
seeking written comments on the proposed changes. This initiative is
one of a number of executive actions issued by the Administration that
are designed to ensure issuance of the highest-quality patents, enhance
competition by providing the public with more complete information
about the competitive environment in which innovators operate, improve
market efficiency for patent rights by making patent ownership
information more readily and easily available, reduce abusive patent
litigation by helping the public defend itself against frivolous
litigation, and level the playing field for innovators. The Office is
conducting two public hearings to discuss these proposed changes. The
public hearings are an additional way for the Office to introduce the
proposed changes and directly receive feedback from the public. The
Office also is extending the period for public comment on the proposed
changes until April 24, 2014, to provide interested members of the
public with additional time to submit written comments.

DATES: Public Hearing Dates: The first public hearing will take place
on March 13, 2014, from 1 p.m. Eastern Daylight Time (EDT) until 4 p.m.
EDT, in Alexandria, Virginia.
   The second public hearing will take place on March 26, 2014, from 9
a.m. Pacific Daylight Time (PDT) until noon PDT, in San Francisco,
California.
   Requests to Provide Oral Testimony: Those wishing to provide oral
testimony at either public hearing must submit a request to do so in
writing no later than February 28, 2014. Members of the public who wish
to attend solely to observe need not submit a request to attend.
   Comment Deadline Date: To be ensured of consideration, written
comments on the proposed changes to the rules of practice to require
identification of the attributable owner must be received on or before
April 24, 2014.

SUPPLEMENTARY INFORMATION: The Office recently published a notice of
proposed rulemaking proposing to require the disclosure of ownership
information about patents and applications and requesting comments
about the voluntary reporting of licensing offers and commitments and
making them available online. See Changes to Require Identification of
Attributable Owner, 79 FR 4105 (Jan. 24, 2014). The Office is conducting
two public hearings to discuss these proposed changes and receive feedback
from the public. The Office also is extending the period for public comment
on the proposed changes until April 24, 2014, to provide interested
members of the public with additional time to submit written comments.
   Members of the public who wish to provide oral testimony at either
public hearing must submit a timely request (i.e., must submit a
request to provide oral testimony no later than February 28, 2014).
Requests to provide oral testimony at either public hearing must
indicate the following information: (1) The name of the person desiring
to speak; (2) the person's contact information (telephone number and
electronic mail address); (3) the organization(s) the person
represents, if any; and (4) the hearing location where the person
prefers to speak. A person must be physically present at the hearing
location to provide oral testimony; virtual testimony via telephone or
webcast is not available. Based on the requests received, an agenda of
scheduled speakers will be sent to those speaking and posted on the
Office's Internet Web site at http://www.uspto.gov. The number of
speakers and time allotted to each speaker may be limited to ensure
that all persons speaking will have a meaningful chance to do so.
   Members of the public who wish to attend solely to observe need not
submit a request to attend. The Office also plans to make the public
hearings available via Web cast. Web cast information will be available
on the Office's Internet Web site closer to the public hearing dates. A
transcript of the public hearings will be available for viewing via the
Office's Internet Web site at http://www.uspto.gov, and will be
available for public inspection at the Office of the Commissioner for
Patents, currently located in Madison East, Tenth Floor, 600 Dulany
Street, Alexandria, Virginia 22314, upon request.
   The public is welcome to submit written comments in response to the
proposed changes in addition to, or lieu of, presenting oral testimony
at these public hearings. The Office is extending the period for public

comment on the proposed changes to provide interested members of the
public with additional time to submit written comments. Written
comments in response to the proposed changes must be received on or
before April 24, 2014.
   Under the proposed rulemaking, the Office plans to collect information
on the "attributable owner" of a patent or application, which includes the
titleholders, entities with rights to enforce the patent, and entities
with effective control over anyone reported in the first two categories,
called the "ultimate parent entities." This information would be made
available to the public under the proposed rulemaking at the same time a
patent application is published or when a patent issues. The Office also
seeks public comment on whether to permit patent applicants and owners to
voluntarily report licensing offers and related information that the Office
will make available to the public. The Office currently permits patent
owners to request that their patents be listed in the Official Gazette as
available for license or sale, and the Office would like public input on
whether the Office should expand on this program to allow for the
submission of more licensing information and make this information
available in an accessible online format.
   The Office welcomes comments on all aspects of the proposed rulemaking,
but highlights the following areas (which are also highlighted in the
notice of proposed rulemaking) for receipt of public input:
   (1) The proposal sets forth a definition for attributable owner.
The Office invites public comment on whether changes could be made to
the scope of the information proposed to be collected while still
achieving the objectives of the Office as set forth in the proposal.
   (2) Part of the current proposed definition of attributable owner
incorporates by reference the definition of ultimate parent entity set
forth in 16 CFR 801.1(a)(3). The Office welcomes comments on how this
definition might be modified for use at the Office. The Office
recognizes that corporations sometimes transfer patents and patent
applications within the corporation for legitimate reasons, such as tax
savings purposes, and also welcomes comments on the impact of the
proposed changes on this practice.
   (3) The proposal sets forth when attributable owner information
must be supplied to the Office. The Office invites public comments as
to whether and when attributable owner information should be collected.
For example, are there additional times during prosecution (e.g., with
each reply to an Office action) when the applicant should be required
to update or verify attributable owner information? Is requiring
updates on changes during prosecution within three months of any change
in attributable owner the appropriate time frame (i.e., should the time
frame be more or less than three months?).
   (4) The Office plans to work with its user community to implement
the attributable owner information reporting system in a user-friendly
manner and welcomes input on how this can best be accomplished. Subject
to financial and resource constraints, for example, the Office would
like to explore means to allow for the bulk processing of changes to
attributable owner for portfolios of applications and patents. The
Office also welcomes input on how the updating or verifying by the
applicant or owner should be structured in conjunction with the payment
of maintenance fees, particularly in light of the practice of
outsourcing payment of maintenance fees to third parties.
   (5) The Office further seeks comments on whether the Office should
expand the current Official Gazette practice of allowing patent owners
to list patents as available for license or sale to permit all patent
applicants and owners to voluntarily report additional licensing
information for the Office to make available to the public in an
accessible online format. The Office welcomes input on what such
licensing information should include (i.e., willingness to license, as
well as licensing contacts, license offer terms, commitments to license
the patent, e.g., on royalty-free or reasonable and non-discriminatory
terms) and the interface of the online system.

The following libraries, designated as Patent and Trademark Resource Centers
(PTRCs), provide public access to patent and trademark information received
from the United States Patent and Trademark Office (USPTO). This
information includes all issued patents, all registered trademarks, the
Official Gazette of the U.S. Patent and Trademark Office, search tools such
as the Cassis CD-ROM suite of products and supplemental information in a
variety of formats including online, optical disc, microfilm and paper.
Each PTRC also offers access to USPTO resources on the Internet and to
PubWEST (Web based examiner search tool), a system used by patent examiners
that is not available on the Internet.

Staff assistance and training is provided in the use of this information.
All information is available free of charge. However, there may be charges
associated with the use of photocopying and related services. Hours of
service to the public vary, and anyone contemplating use of these
collections at a particular library is urged to contact that library in
advance about its services and hours to avoid inconvenience.
