                  Patent Cooperation Treaty (PCT) Information

   For information concerning PCT member countries, see the notice
appearing in the Official Gazette at 1382 O.G. 61, on September 11, 2012.

   For information on subject matter under Rule 39 that a particular
International Searching Authority will not search, see Annex D of the PCT
Applicants' Guide.

European Patent Office as Searching and Examining Authority

   The European Patent Office (EPO) may act as the International Searching
Authority (ISA) or the International Preliminary Examining Authority (IPEA)
for an international application filed with the United States Receiving
Office or the International Bureau (IB) as Receiving Office where at least
one of the applicants is either a national or resident of the United States
of America. However, the use of the EPO is restricted. The EPO will not act
as an ISA for applications with one or more claims directed to a business
method. For the definition of what the EPO considers to be precluded
subject matter in the field of business methods, see PCT Applicants's
Guide, Annexes D(EP), E(EP) and the Official Notices (PCT Gazette) dated
May 6, 2010, page 94
(http://www.wipo.int/pct/en/official_notices/index.html). The EPO will act
as an IPEA only if it also acted as the ISA.

   The search fee of the European Patent Office was decreased, effective
January 1, 2013, and was announced in the Official Gazette at 1385 O.G. 176,
on December 25, 2012.

Korean Intellectual Property Office as Searching and Examining Authority

The Korean Intellectual Property Office may act as the ISA or the IPEA for
an international application filed with the United States Receiving Office
or the International Bureau (IB) as Receiving Office where at least one of
the applicants is either a national or resident of the United States of
America. The announcement appears in the Official Gazette at 1302 O.G.
1261 on January 17, 2006.

   The search fee of the Korean Intellectual Property Office was increased,
effective January 1, 2013, and was announced in the Official Gazette at
1385 O.G. 176, on December 25, 2012.

Australian Patent Office as Searching and Examining Authority

   The Australian Patent Office (IP Australia) may act as the ISA or the
IPEA for an international application filed with the United States
Receiving Office or the International Bureau (IB) as Receiving Office where
at least one of the applicants is either a national or resident of the
United States of America. The announcement appears in the Offical Gazette
at 1337 O.G. 265, on December 23, 2008. However, the use of IP Australia is
restricted. IP Australia will not act as an ISA for applications with one
or more claims directed to the fields of business methods or mechanical
engineering or analogous fields of technology as defined by specified areas
of the International Patent Classification System, as indicated in the
Official Gazette at 1337 O.G. 261 on December 23, 2008, in Annex A to the
agreement between the USPTO and IP Australia. IP Australia will act as an
IPEA only if it also acted as the ISA.

   The search fee of IP Australia was increased, effective January 1, 2013,
and was announced in the Official Gazette at 1385 O.G. 176, on December 25,
2012.

The Federal Service on Intellectual Property, Patents & Trademarks of
Russia as Searching and Examining Authority

   The Federal Service on Intellectual Property, Patents & Trademarks of
Russia (Rospatent) may act as the ISA or the IPEA for an international
application filed with the United States Receiving Office or the
International Bureau (IB) as Receiving Office where at least one of the
applicants is either a national or resident of the United States of
America. The announcement appears in the Official Gazette at 1378 O.G. 162,
on May 8, 2012.

   The search fee of Rospatent was increased, effective January 1, 2013,
and was announced in the Official Gazette at 1385 O.G. 176, on December 25,
2012.

Fees

   The transmittal fee for the USPTO was changed to include a basic portion
and a non-electronic filing fee portion, effective November 15, 2011, and
was announced in the Federal Register on November 15, 2011. Search fees for
the USPTO were changed, effective January 12, 2009, and were announced in
the Federal Register on November 12, 2008. The fee for filing a request for
the restoration of the right of priority was established, effective
November 9, 2007, and was announced in the Federal Register on September
10, 2007.

   International filing fees were increased, effective January 1, 2013,
and were announced in the Official Gazette at 1385 O.G. 176, on December 25,
2012.

   The schedule of PCT fees (in U.S. dollars), as of January 1, 2013, is

                   Notice of Maintenance Fees Payable

   Title 37 Code of Federal Regulations (CFR), Section 1.362(d) provides
that maintenance fees may be paid without surcharge for the six-month
period beginning 3, 7, and 11 years after the date of issue of patents
based on applications filed on or after Dec. 12, 1980. An additional
six-month grace period is provided by 35 U.S.C. 41(b) and 37 CFR 1.362(e)
for payment of the maintenance fee with the surcharge set forth in 37 CFR
1.20(h), as amended effective Dec. 16, 1991. If the maintenance fee is
not paid in the patent requiring such payment the patent will expire on
the 4th, 8th, or 12th anniversary of the grant.

   Attention is drawn to the patents that were issued on January 26, 2010
for which maintenance fees due at 3 years and six months may now be paid

   Correspondence related to maintenance fees other than payments of
maintenance fees in patents is not to be mailed to P.O. Box 979070,
St. Louis, MO 63197-9000, but must be mailed to "Mail Stop M
Correspondence, Director of the U.S. Patent and Trademark Office, P.O.
Box 1450, Alexandria, VA 22313-1450".

   Patent owners must establish small entity status according to 37 CFR
1.27 if they have not done so and if they wish to pay the small entity
amount.

   The current amounts of the maintenance fees due at 3 years and six
months, 7 years and six months, and 11 years and six months are set forth
in the most recently amended provisions in 37 CFR 1.20(e)-(g). To obtain

   35 U.S.C. 41 and 37 CFR 1.362(g) provide that if the required
maintenance fee and any applicable surcharge are not paid in a patent
requiring such payment, the patent will expire at the end of the 4th, 8th
or 12th anniversary of the grant of the patent depending on the first
maintenance fee which was not paid.

             Extension of the Extended Missing Parts Pilot Program

AGENCY: United States Patent and Trademark Office, Commerce.

ACTION: Notice.

SUMMARY: The United States Patent and Trademark Office (USPTO) implemented
a pilot program (Extended Missing Parts Pilot Program) in which an
applicant, under certain conditions, can request a twelve-month time period
to pay the search fee, the examination fee, any excess claim fees, and the
surcharge (for the late submission of the search fee and the examination
fee) in a nonprovisional application. The Extended Missing Parts Pilot
Program benefits applicants by permitting additional time to determine if
patent protection should be sought--at a relatively low cost--and by
permitting applicants to focus efforts on commercialization during this
period. The Extended Missing Parts Pilot Program benefits the USPTO and the
public by adding publications to the body of prior art, and by removing
from the USPTO's workload those nonprovisional applications for which
applicants later decide not to pursue examination. The USPTO is extending
the Extended Missing Parts Pilot Program until December 31, 2013, to better
gauge whether the Extended Missing Parts Program offers sufficient benefits
to the patent community for it to be made permanent.

DATES: Duration: The Extended Missing Parts Pilot Program will run through
December 31, 2013. Therefore, any certification and request to participate
in the Extended Missing Parts Pilot Program must be filed before December
31, 2013. The USPTO may further extend the pilot program (with or without
modifications) depending on the feedback received and the continued
effectiveness of the pilot program.

SUPPLEMENTARY INFORMATION: The USPTO implemented a change to missing parts
practice in certain nonprovisional applications as a pilot program (i.e.,
Extended Missing Parts Pilot Program) after considering written comments
from the public. See Pilot Program for Extended Time Period To Reply to a
Notice to File Missing Parts of Nonprovisional Application, 75 FR 76401
(Dec. 8, 2010), 1362 Off. Gaz. Pat. Office 44 (Jan. 4, 2011). The USPTO
extended the Extended Missing Parts Pilot Program until December 31, 2012.

   The USPTO is extending the Extended Missing Parts Pilot Program until
December 31, 2013. The USPTO may further extend the Extended Missing Parts
Pilot Program, or may discontinue the pilot program after December 31,
2013, depending on the results of the program. The requirements of the
program are reiterated below. Applicants are strongly cautioned to review
the pilot program requirements before making a request to participate in
the Extended Missing Parts Pilot Program.

   The USPTO cautions all applicants that, in order to claim the benefit
of a prior provisional application, the statute requires a nonprovisional

application filed under 35 U.S.C. 111(a) to be filed within twelve months
after the date on which the corresponding provisional application was
filed. See 35 U.S.C. 119(e). It is essential that applicants understand
that the Extended Missing Parts Pilot Program cannot and does not change
this statutory requirement.

   I. Requirements: In order for an applicant to be provided a twelve-month
(non-extendable) time period to pay the search and examination fees and any
required excess claims fees in response to a Notice to File Missing Parts
of Nonprovisional Application under the Extended Missing Parts Pilot
Program, the applicant must satisfy the following conditions: (1) Applicant
must submit a certification and request to participate in the Extended
Missing Parts Pilot Program with the nonprovisional application on filing,
preferably by using Form PTO/AIA/421 titled "Certification and Request for
Extended Missing Parts Pilot Program;" (2) the application must be an
original (i.e. not a Reissue) nonprovisional utility or plant application
filed under 35 U.S.C. 111(a) within the duration of the pilot program; (3)
the nonprovisional application must directly claim the benefit under 35
U.S.C. 119(e) and 37 CFR 1.78 of a prior provisional application filed
within the previous twelve months; the specific reference to the
provisional application must be in an application data sheet under 37 CFR
1.76 (see 37 CFR 1.78(a)(5)); and (4) applicant must not have filed a
nonpublication request.

   As required for all nonprovisional applications, applicant will need to
satisfy filing date requirements and publication requirements. In
accordance with 35 U.S.C. 122(b), the USPTO will publish the application
promptly after the expiration of eighteen months from the earliest filing
date to which benefit is sought. Therefore, the nonprovisional application
should also be in condition for publication as provided in 37 CFR 1.211(c).
The following are required in order for the nonprovisional application to
be in condition for publication: (1) The basic filing fee; (2) the executed
inventor's oath or declaration in compliance with 37 CFR 1.63 or an
application data sheet containing the information specified in 37 CFR
1.63(b); (3) a specification in compliance with 37 CFR 1.52; (4) an
abstract in compliance with 37 CFR 1.72(b); (5) drawings in compliance with
37 CFR 1.84 (if applicable); (6) any application size fee required under 37
CFR 1.16(s); (7) any English translation required by 37 CFR 1.52(d); and
(8) a sequence listing in compliance with 37 CFR 1.821-1.825 (if
applicable). The USPTO also requires any compact disc requirements to be
satisfied, and an English translation of the provisional application to be
filed in the provisional application if the provisional application was
filed in a non-English language and a translation has not yet been filed.
If the requirements for publication are not met, applicant will need to
satisfy the publication requirements within a two-month extendable time
period.

   As noted above, applicants should request participation in the Extended
Missing Parts Pilot Program by using Form PTO/AIA/421. For utility patent
applications, applicant may file the application and the certification and
request electronically using the USPTO electronic filing system, EFS-Web,
and selecting the document description of "Certification and Request for
Missing Parts Pilot" for the certification and request on the EFS-Web
screen. Form PTO/AIA/421 is available on the USPTO Web site at
http://www.uspto.gov/forms/aia0421.pdf. Information regarding EFS-Web is
available on the USPTO Web site at http://www.uspto.gov/ebc/index.jsp.

   The utility application including the certification and request to
participate in the pilot program may also be filed by mail (e.g., by
"Express Mail" in accordance with 37 CFR 1.10) or hand-carried to the
USPTO. However, applicants are advised that, effective November 15, 2011,
as provided in the Leahy-Smith America Invents Act, a new additional fee of
$400.00 for a non-small entity ($200.00 for a small entity) is due for any
nonprovisional utility patent application that is not filed by EFS-Web. See
Public Law. 112-29, § 10(h), 125 Stat. 283, 319 (2011). This non-electronic
filing fee is due on filing of the utility application or within the

two-month (extendable) time period to reply to the Notice to File Missing
Parts of Nonprovisional Application. Applicants will not be given the
twelve-month time period to pay the non-electronic filing fee. Therefore,
utility applicants are strongly encouraged to file their utility
applications via EFS-Web to avoid this additional fee.

   For plant patent applications, applicant must file the application
including the certification and request to participate in the pilot program
by mail or hand-carried to the USPTO since plant patent applications cannot
be filed electronically using EFS-Web. See Legal Framework for Electronic
Filing System Web (EFS-Web), 74 FR 55200 (Oct. 27, 2009), 1348 Off. Gaz.
Pat. Office 394 (Nov. 24, 2009).

   II. Processing of Requests: If applicant satisfies the requirements
(discussed above) on filing of the nonprovisional application and the
application is in condition for publication, the USPTO will send applicant
a Notice to File Missing Parts of Nonprovisional Application that sets a
twelve-month (non-extendable) time period to submit the search fee, the
examination fee, any excess claims fees (under 37 CFR 1.16(h)-(j)), and the
surcharge under 37 CFR 1.16(f) (for the late submission of the search fee
and examination fee). The twelve-month time period will run from the
mailing date, or notification date for e-Office Action participants, of the
Notice to File Missing Parts. For information on the e-Office Action

applicant files a timely reply to the Notice to File Missing Parts within
the twelve-month time period and the nonprovisional application is
completed, the nonprovisional application will be placed in the examination
queue based on the actual filing date of the nonprovisional application.

   III. Important Reminders: Applicants are reminded that the disclosure of
an invention in a provisional application should be as complete as possible
because the claimed subject matter in the later-filed nonprovisional
application must have support in the provisional application in order for
the applicant to obtain the benefit of the filing date of the provisional
application.

   Furthermore, the nonprovisional application as originally filed must
have a complete disclosure that complies with 35 U.S.C. 112(a) which is
sufficient to support the claims submitted on filing and any claims
submitted later during prosecution. New matter cannot be added to an
application after the filing date of the application. See 35 U.S.C. 132(a).
In order to be accorded a filing date, a nonprovisional application must
include a specification concluding with at least one claim as prescribed by
35 U.S.C. 112 and a drawing as prescribed by 35 U.S.C. 113. See 35 U.S.C.
111(a). While only one claim is required in a nonprovisional application
for filing date purposes and applicant may file an amendment adding
additional claims later during prosecution, applicant should consider the
benefits of submitting a complete set of claims on filing of the
nonprovisional application. This would reduce the likelihood that any
claims added later during prosecution might be found to contain new matter.
Also, if a patent is granted and the patentee is successful in litigation
against an infringer, provisional rights to a reasonable royalty under 35
U.S.C. 154(d) may be available only if the claims that are published in the
patent application publication are substantially identical to the patented
claims that are infringed, assuming timely actual notice is provided. Thus,
the importance of the claims that are included in the patent application
publication should not be overlooked.

   Applicants are also advised that the extended missing parts period does
not affect the twelve-month priority period provided by the Paris
Convention for the Protection of Industrial Property (Paris Convention).
Thus, any foreign filings must still be made within twelve months of the
filing date of the provisional application if applicant wishes to rely on
the provisional application in the foreign-filed application or if
protection is desired in a country requiring filing within twelve months of
the earliest application for which rights are left outstanding in order to
be entitled to priority.

SUMMARY: The United States Patent and Trademark Office (USPTO) is seeking
to improve the quality of issued patents. In this notice, the USPTO is
focusing on potential practices that applicants can employ at the drafting
stage of a patent application in order to facilitate examination and bring
more certainty to the scope of issued patents. To that end, the USPTO is
requesting input from interested members of the public on the specific
practices set forth in the "Topics for Public Comment" section below. While
this notice is directed to potential practices that applicants can employ,
the USPTO also plans to issue a separate notice building on internal
initiatives and further identifying potential practices the Office can
employ to also facilitate examination and bring more certainty to the scope
of issued patents. The USPTO intends to publish the separate notice
subsequent to its review of comments received responsive to the present
notice.

   On January 3, 2013, the USPTO published a notice announcing the
formation of a partnership with the software community to enhance the
quality of software-related patents (Software Partnership). See Request for
Comments and Notice of Roundtable Events for Partnership for Enhancement of
Quality of Software-Related Patents, 78 FR 292 (Jan. 3, 2013). The Software
Partnership notice seeks public comment on specific topics related to
enhancing the quality of software-related patents, and announces two
roundtable events, which will not only offer participants an opportunity to
provide oral comments on the topics presented in the Software Partnership
notice but also on the topics set forth in the present notice, to the
extent they apply to software-related patents.

   Comment Deadline: To be assured of consideration, written comments must
be received on or before March 15, 2013. No public hearing will be held.

SUPPLEMENTARY INFORMATION: The USPTO is committed to enhancing the quality

of issued patents and the efficiency of patent prosecution. To further this
goal, the USPTO has undertaken a number of internal initiatives over the
past several years. For example, the USPTO routinely provides its examiners
with training on topics such as obviousness under 35 U.S.C. 103 and
statutory subject matter under 35 U.S.C. 101 in order to provide clear
guidance regarding the impact of significant new case law on the patent
examination process. Patent examiners also receive training on 35 U.S.C.
112 to address concerns about the proper interpretation of claim language,
the clarity of claim terms, and the adequacy of the specification to
support functional claim limitations. Additionally, the USPTO has
implemented a new quality measurement system that comprehensively evaluates
examination quality. One component of this system is an external quality
survey that obtains input from applicants and practitioners on the
perceived quality of the patent examination process.

   The USPTO has also undertaken initiatives that involve working with the
public to enhance the examination process. For example, examiners
participate in workshops focusing on compact prosecution and holding
effective interviews with applicants. Also, the USPTO works with experts in
industry to provide technical training for patent examiners and updates on
developments and innovations in their field. This training initiative
enhances examiners' insight in their fields, enabling them to better
understand intended claim scope and make better informed patentability
decisions.

I. Purpose of This Notice

   This notice is directed to furthering the Office's dialog with the
public about ways to enhance patent quality. Specifically, the topics set
forth in the "Topics for Public Comment" section of this notice are
potential practice changes that applicants can employ to augment the
quality of issued patents. The public is invited to comment on whether
these practices should be employed by applicants at the drafting stage of
a patent application in order to facilitate examination and bring more
certainty to the scope of issued patents.

II. Topics for Public Comment

   The USPTO is seeking input on whether the following practices should be
used by applicants during the preparation of an application to place the
application in a better condition for examination. When patent applications
are filed in the best possible condition for examination, examiners can
better focus the examination on substantive patentability issues.
Specifically, the USPTO is seeking input on whether adoption of the
following practices by applicants early in the process would assist the
public in determining the scope of claims as well as the meaning of claim
terms in the specification after a patent is granted.

A. Clarifying the Scope of the Claims

   The boundaries of patent protected subject matter should be clearly
delineated and the scope of each claim made clear on filing of a patent
application to facilitate examination and the publishing and patenting of
claims that best serve the public notice function. In this regard, the
USPTO is seeking public comment on advantages and disadvantages of
applicants employing the following practices when preparing their patent
applications:

   1. Presenting claims in a multi-part format by way of a standardized
template that places each claim component in separate, clearly marked, and
designated fields. For instance, a template may facilitate drafting and
review of claims by separately delineating each claim component into
separate fields for the preamble, transitional phrase, and each particular
claim limitation.

   2. Identifying corresponding support in the specification for each of

the claim limitations utilizing, for example, a claim chart or the
standardized template described above. This practice could be particularly
beneficial where claims are amended or where a continuing application
(continuation, divisional, continuation-in-part) is filed.

   3. Indicating whether examples in the specification are intended to be
limiting or merely illustrative.

   4. Identifying whether the claim preamble is intended to be a limitation
on claim scope.

   5. Expressly identifying clauses within particular claim limitations for
which the inventor intends to invoke 35 U.S.C. 112(f) and pointing out
where in the specification corresponding structures, materials, or acts are
disclosed that are linked to the identified 35 U.S.C. 112(f) claim
limitations.1

   6. Using textual and graphical notation systems known in the art to
disclose algorithms in support of computer-implemented claim limitations,
such as C-like pseudo-code or XML-like schemas for textual notation and
Unified Modeling Language (UML) for graphical notation.

B. Clarifying the Meaning of Claim Terms in the Specification

   The best source for determining the meaning of a claim term is the
specification. See Phillips v. AWH Corp., 415 F.3d 1303, 1315-16 (Fed. Cir.
2005). The specification should clearly define the claim language so that
the scope of each claim can readily be determined, ensuring the public
notice function of the patent claims is best served. In this regard, the
USPTO is seeking public comments on advantages and disadvantages of
applicants employing the following practices when preparing their patent
applications:

   1. Indicating whether terms of degree--such as substantially,
approximately, about, essentially--have a lay or technical meaning and
explaining the scope of such terms.

   2. Including in the specification a glossary of potentially ambiguous,
distinctive, and specialized terms used in the specification and/or claims,
particularly for inventions related to certain technologies, such as
software.

   3. Designating, at the time of filing the application, a default
dictionary or dictionaries (e.g., a technical dictionary and a
non-technical dictionary) to be used in ascertaining the meaning of the
claim terms.

III. Guidelines for Written Comments

   As discussed previously, the USPTO prefers to receive comments via
electronic mail. Information provided in response to this request for
comments will be made part of a public record and may be available via the
Internet. In view of this, parties should not submit information that they
do not wish to be publicly disclosed or made electronically accessible.
Parties who would like to rely on confidential information to illustrate a
point are requested to summarize or otherwise submit the information in a
way that will permit its public disclosure.

The following libraries, designated as Patent and Trademark Resource Centers
(PTRCs), provide public access to patent and trademark information received
from the United States Patent and Trademark Office (USPTO). This
information includes all issued patents, all registered trademarks, the
Official Gazette of the U.S. Patent and Trademark Office, search tools such
as the Cassis CD-ROM suite of products and supplemental information in a
variety of formats including online, optical disc, microfilm and paper.
Each PTRC also offers access to USPTO resources on the Internet and to
PubWEST (Web based examiner search tool), a system used by patent examiners
that is not available on the Internet.

Staff assistance and training is provided in the use of this information.
All information is available free of charge. However, there may be charges
associated with the use of photocopying and related services. Hours of
service to the public vary, and anyone contemplating use of these
collections at a particular library is urged to contact that library in
advance about its services and hours to avoid inconvenience.
