                  Patent Cooperation Treaty (PCT) Information

   For information concerning PCT member countries, see the notice
appearing in the Official Gazette at 1369 O.G. 5, on August 2, 2011.

   For information on subject matter under Rule 39 that a particular
International Searching Authority will not search, see Annex D of the PCT
Applicants' Guide.

European Patent Office as Searching and Examining Authority

   The European Patent Office (EPO) may act as the International Searching
Authority (ISA) or the International Preliminary Examining Authority (IPEA)
for an international application filed with the United States Receiving
Office or the International Bureau (IB) as Receiving Office where at least
one of the applicants is either a national or resident of the United States
of America. However, the use of the EPO is restricted. The EPO will not act
as an ISA for applications with one or more claims directed to a business
method. For the definition of what the EPO considers to be precluded
subject matter in the field of business methods, see PCT Applicants's
Guide, Annexes D(EP), E(EP) and the Official Notices (PCT Gazette) dated
May 6, 2010, page 94
(http://www.wipo.int/pct/en/official_notices/index.html). The EPO will act
as an IPEA only if it also acted as the ISA.

   The search fee of the European Patent Office was increased, effective
April 1, 2012, and was announced in the Official Gazette at 1377 O.G. 5, on
April 3, 2012.

Korean Intellectual Property Office as Searching and Examining Authority

The Korean Intellectual Property Office may act as the ISA or the IPEA for
an international application filed with the United States Receiving Office
or the International Bureau (IB) as Receiving Office where at least one of
the applicants is either a national or resident of the United States of
America. The announcement appears in the Official Gazette at 1302 O.G.
1261 on January 17, 2006.

   The search fee of the Korean Intellectual Property Office was decreased,
effective January 1, 2012, and was announced in the Official Gazette at
1373 O.G. 177, on December 27, 2011.

Australian Patent Office as Searching and Examining Authority

   The Australian Patent Office (IP Australia) may act as the ISA or the
IPEA for an international application filed with the United States
Receiving Office or the International Bureau (IB) as Receiving Office where
at least one of the applicants is either a national or resident of the
United States of America. The announcement appears in the Offical Gazette
at 1337 O.G. 265, on December 23, 2008. However, the use of IP Australia is
restricted. IP Australia will not act as an ISA for applications with one
or more claims directed to the fields of business methods or mechanical
engineering or analogous fields of technology as defined by specified areas
of the International Patent Classification System, as indicated in the
Official Gazette at 1337 O.G. 261 on December 23, 2008, in Annex A to the
agreement between the USPTO and IP Australia, IP Australia will act as an
IPEA only if it also acted as the ISA.

   The search fee of IP Australia was increased, effective July 1, 2012,
and was announced in the Official Gazette at 1380 O.G. 5, on July 3, 2012.

The Federal Service on Intellectual Property, Patents & Trademarks of
Russia as Searching and Examining Authority

   The Federal Service on Intellectual Property, Patents & Trademarks of

Russia (Rospatent) may act as the ISA or the IPEA for an international
application filed with the United States Receiving Office or the
International Bureau (IB) as Receiving Office where at least one of the
applicants is either a national or resident of the United States of
America. The announcement appears in the Official Gazette at 1378 O.G. 162,
on May 8, 2012.

   The search fee of Rospatent was increased, effective June 1, 2012, and
was announced in the Official Gazette at 1378 O.G. 162, on May 8, 2012.

Fees

   The transmittal fee for the USPTO was changed to include a basic portion
and a non-electronic filing fee portion, effective November 15, 2011, and
was announced in the Federal Register on November 15, 2011. Search fees for
the USPTO were changed, effective January 12, 2009, and were announced in
the Federal Register on November 12, 2008. The fee for filing a request for
the restoration of the right of priority was established, effective
November 9, 2007, and was announced in the Federal Register on September
10, 2007.

   International filing fees were decreased, effective January 1, 2012,
and were announced in the Official Gazette at 1373 O.G. 177, on December
27, 2011.

                   Notice of Maintenance Fees Payable

   Title 37 Code of Federal Regulations (CFR), Section 1.362(d) provides
that maintenance fees may be paid without surcharge for the six-month
period beginning 3, 7, and 11 years after the date of issue of patents
based on applications filed on or after Dec. 12, 1980. An additional
six-month grace period is provided by 35 U.S.C. 41(b) and 37 CFR 1.362(e)
for payment of the maintenance fee with the surcharge set forth in 37 CFR
1.20(h), as amended effective Dec. 16, 1991. If the maintenance fee is
not paid in the patent requiring such payment the patent will expire on
the 4th, 8th, or 12th anniversary of the grant.

   Attention is drawn to the patents that were issued on August 11, 2009

   35 U.S.C. 41 and 37 CFR 1.362(g) provide that if the required
maintenance fee and any applicable surcharge are not paid in a patent
requiring such payment, the patent will expire at the end of the 4th, 8th
or 12th anniversary of the grant of the patent depending on the first
maintenance fee which was not paid.

   15 U.S.C. 1059 provides that each trademark registration may be
renewed for periods of ten years from the end of the expiring period
upon payment of the prescribed fee and the filing of an acceptable
application for renewal. This may be done at any time within one year
before the expiration of the period for which the registration was
issued or renewed, or it may be done within six months after such
expiration on payment of an additional fee.

   On July 1, 2011, the United States Patent and Trademark Office (USPTO)
commenced a Patent Prosecution Highway pilot program based on Patent
Cooperation Treaty (PCT) work products (PCT-PPH pilot program) with the
Nordic Patent Institute (NPI).  The PCT-PPH pilot program enabled an
applicant who has received a written opinion or an international
preliminary examination report from the NPI as the International Searching
Authority (ISA) or International Preliminary Examining Authority (IPEA)
indicating that at least one claim in the PCT application has novelty,
inventive step and industrial applicability to have the corresponding
application filed in the USPTO be advanced out of turn for examination.
See notice titled "Patent Prosecution Highway Pilot Program between the
United States Patent and Trademark Office and the Nordic Patent Institute
based on Patent Cooperation Treaty Work Products," 1368 Off. Gaz. Pat.
Office 213 (July 26, 2011).  The USPTO indicated that the PCT-PPH pilot
program would terminate on June 30, 2012, but may be extended for an
additional time period thereafter.

   In order to adequately assess the feasibility of the PCT-PPH pilot
program, the USPTO and the NPI have agreed to collect more information
before any final decision on the program is made.  The pilot has been
extended indefinitely.

Patent Prosecution Highway Pilot Program between the United States Patent and Trademark Office and the Colombian Superintendence of Industry and Commerce

I. Background

The United States Patent and Trademark Office (USPTO) has established a 2010-2015 Strategic Plan to transform the USPTO into a more quality-focused, highly productive, responsive organization supporting a market-driven intellectual property system. One of the specific action items of the 2010-2015 Strategic Plan is to share search results with other intellectual property offices. By relying on the search results obtained via partnerships with other intellectual property offices, the USPTO can reduce duplication of efforts and decrease workload.

From July 2006 to January 2008, the USPTO partnered with the Japan Patent Office (JPO) to establish the first Patent Prosecution Highway pilot program (PPH). The PPH leverages accelerated examination procedures already available in both offices to allow applicants in both offices to obtain corresponding patents faster and more efficiently. The PPH also permits each office to benefit from the work previously done by the other office, in turn helping to reduce workload and improve patent quality. The USPTO and the JPO began full implementation of the PPH program on January 4, 2008.

The USPTO commenced a PPH pilot program with the Korean Intellectual Property Office (KIPO) and the Canadian Intellectual Property Office (CIPO) on January 28, 2008. The pilot program with KIPO ended on January 28, 2009, and full implementation of the PPH program began on January 29, 2009. The pilot program with CIPO ended on January 28, 2011, and full implementation of the PPH program began on January 29, 2011.

USPTO has also commenced separate PPH pilot programs with the United Kingdom Intellectual Property Office (UKIPO), IP Australia (IPAU), the European Patent Office (EPO), the Danish Patent and Trademark Office (DKPTO), the Intellectual Property Office of Singapore (IPOS), the German Patent and Trade Mark Office (DPMA), the National Board of Patents and Registration of Finland (NBPR), the Hungarian Intellectual Property Office (HIPO), the Russian Patent Office (Rospatent), the Spanish Patent and Trademark Office (SPTO), the Austrian Patent Office (APO), the Mexican Institute of Industrial Property (IMPI), the Israeli Patent Office (ILPO), the Taiwan Intellectual Property Office (TIPO), the Norwegian Industrial Property Office (NIPO), the State Intellectual Property Office of the People’s Republic of China (SIPO), and the Icelandic Patent Office (IPO), based on the same or similar framework as the PPH between the USPTO and JPO.

Following on these partnerships, the USPTO and the Colombian Superintendence of Industry and Commerce (SIC) have agreed to launch a PPH pilot program similar to the PPH pilot programs noted above.

II. Patent Prosecution Highway Pilot Program

The PPH was established to enable an applicant whose claims are determined to be allowable/patentable in the Office of First Filing (OFF) to have the corresponding application filed in the Office of Second Filing (OSF) advanced out of turn for examination while at the same time allowing the OSF to exploit the search and examination results of the OFF.

Where the USPTO is the OFF and the U.S. application contains claims that are determined to be allowable/patentable, the applicant may request accelerated examination at SIC for the corresponding application filed with SIC as the OSF. The procedures and requirements for filing a request with SIC for participation in the PPH pilot program will be available on September 1, 2012, from the SIC Web site at: http://www.sic.gov.co.

Where the USPTO is the OSF and the corresponding application filed with SIC as the OFF contains claims that are determined to be allowable/patentable in a substantive examination carried out in the name of SIC, the applicant may request participation in the PPH pilot program in the USPTO and request that the U.S. application be advanced out of turn for examination by order of the Director to expedite the business of the Office under 37 CFR 1.102(a). Note that the procedures for a petition to make special under the accelerated examination program set forth in MPEP 708.02(a) do NOT apply to a request for expedited examination by order of the Director to expedite the business of the Office under 37 CFR 1.102(a). The procedures and requirements for filing a request in the USPTO for participation in the PPH pilot program are set forth below.

A. Trial Period for the PPH Pilot Program

The PPH pilot program will commence on September 1, 2012, for a period of one year ending on August 31, 2013. The trial period may be extended for up to an additional year if necessary to adequately assess the feasibility of the PPH program. The USPTO and SIC will evaluate the results of the pilot program to determine whether and how the program should be fully implemented after the trial period. The offices may also terminate the PPH pilot program early if the volume of participation exceeds a manageable level, or for any other reason. Notice will be published if the PPH pilot program will be terminated before the August 31, 2013 date.

B. Requirements for Requesting Participation in the PPH Pilot Program in the USPTO

In order to be eligible to participate in the PPH pilot program, the following conditions must be met:

(1) The U.S. application is

    (a) a Paris Convention application that either
    (i) validly claims priority under 35 U.S.C. § 119(a) and 37 CFR 1.55 to one or more applications filed with SIC, or
    (ii) validly claims priority under 35 U.S.C. §§ 119(a)/365(a) to a Patent Cooperation Treaty (PCT) application that contains no priority claims;
    or
    (b) a national stage application under the PCT (an application which entered the national stage in the U.S. from a PCT international application after compliance with 35 U.S.C. § 371), in which the PCT application
    (i) validly claims priority under 35 U.S.C. § 365(b) to an application filed with SIC, or
    (ii) validly claims priority under 35 U.S.C. § 365(b) to a PCT application that contains no priority claims, or
    (iii) contains no priority claim;
    or
    (c) a so-called bypass application filed under 35 U.S.C. § 111(a) which validly claims benefit under 35 U.S.C. § 120 to a PCT application, in which the PCT application
    (i) validly claims priority under 35 U.S.C. § 365(b) to an application filed with SIC, or
    (ii) validly claims priority under 35 U.S.C. § 365(b) to a PCT application that contains no priority claims, or
    (iii) contains no priority claim.

The CO application whose claims are determined to be allowable/patentable does not have to be the application for which priority is claimed in the USPTO application (the basic application). The CO application can be an application explicitly derived from the basic application, e.g., a divisional application of the basic application. Note that where the CO application that contains the allowable/patentable claims is not the same application for which priority is claimed in the U.S. application, the applicant must identify the relationship between the CO application that contains the allowable/patentable claims and the CO priority application claimed in the U.S. application (e.g., CO application X that contains the allowable/patentable claims is a divisional application of CO application Y, which is the priority application claimed in the U.S. application).

Provisional applications, plant applications, design applications, reissue applications, reexamination proceedings, and applications subject to a secrecy order are excluded and not subject to participation in the PPH.

(2) The CO application(s) must have at least one claim that was determined by the SIC to be allowable/patentable. The applicant must submit a copy of the allowable/patentable claims from the CO application(s) along with an English translation thereof and a statement that the English translation is accurate if the claims are not in the English language. If the SIC office action does not explicitly state that a particular claim is allowable, the applicant must include a statement in the request for participation in the PPH pilot program or in the transmittal letter accompanying the request for participation that no rejection has been made in the SIC office action regarding that claim, and therefore, the claim is deemed allowable by the SIC.

(3) All the claims in each U.S. application for which a request for participation in the PPH pilot program is made must sufficiently correspond to or be amended to sufficiently correspond to the allowable/patentable claims in the CO application(s). A claim is considered to sufficiently correspond where, accounting for differences due to translations and claim format requirements, the claim in the U.S. application is of the same or similar scope as a claim indicated as allowable in the application filed in the SIC. A claim in the U.S. application which is narrower in scope than the claims indicated as allowable in the application filed in the SIC will also sufficiently correspond if presented as a claim dependent upon a claim which is of the same or similar scope as a claim indicated as allowable in the application filed in the SIC. The additional limitation that makes the claim in the U.S. application narrower in scope than the allowable/patentable claims in the application filed in the SIC must have support in the written description of the U.S. application.

A claim in the U.S. application which introduces a new/different category of claims to those claims indicated as allowable in the application filed in the SIC is not considered to sufficiently correspond. For example, if the only allowable/patentable claims in the application filed in the SIC are claims to a process of manufacturing a product, then any product claims in the U.S. application are not considered to sufficiently correspond, even if the product claims are dependent on process claims which sufficiently correspond to allowable/patentable claims in the application filed in the SIC.

The applicant is required to submit a claims correspondence table in English. The claims correspondence table must indicate how all the claims in the U.S. application correspond to the allowable/patentable claims in the applications filed in the SIC. Any dependent claims with additional limitations must be clearly identified in the claims correspondence table.

(4) Examination of the U.S. application for which participation in the PPH pilot program is requested has not begun.

(5) The applicant must file a request for participation in the PPH pilot program and a request that the U.S. application be advanced out of turn for examination by order of the Director to expedite the business of the Office under 37 CFR 1.102(a). A sample request form (PTO/SB/20CO) will be available from the USPTO Web site at http://www.uspto.gov/forms/ on September 1, 2012. Applicants are encouraged to use the USPTO request form. A petition fee under 37 CFR 1.17(h) is NOT required. See Notice Regarding the Elimination of the Fee for Petitions To Make Special Filed Under the Patent Prosecution Highway (PPH) Programs, 75 Fed. Reg. 29312 (May 25, 2010).

(6) The applicant must submit a copy of all the Office actions (which are relevant to patentability) from each of the CO application(s) containing the allowable/patentable claims that are the basis for the request, along with an English translation thereof and a statement that the English translation is accurate if the office actions are not in the English language. In addition, the applicant must submit copies of any office actions (which are relevant to patentability) from the CO application(s) issued after the grant of the request for participation in the PPH pilot program in the USPTO (especially where SIC might have reversed a prior holding of allowability).

(7) The applicant must submit an information disclosure statement (IDS) listing the documents cited by the SIC examiner in the SIC office action (unless such an IDS has already been filed in the U.S. application). The applicant must submit copies of all the documents cited in the SIC office action (unless the copies have already been filed in the U.S. application) except U.S. patents or U.S. patent application publications.

The request for participation in the PPH pilot program and all the supporting documents must be submitted to the USPTO via EFS-Web and indexed with the following document description: “Petition to make special under Patent Pros Hwy.” Information regarding EFS-Web is available at http://www.uspto.gov/patents/process/file/efs/. Any preliminary amendments and IDS submitted with the PPH documents must be separately indexed as a preliminary amendment and IDS, respectively.

Where the request for participation in the PPH pilot program and special status are granted, the applicant will be notified and the U.S. application will be advanced out of turn for examination. In those instances where the request for participation in the PPH pilot program does not meet all the requirements set forth above, the applicant will be notified and the defects in the request will be identified. The applicant will be given one opportunity to perfect the request in a renewed request for participation (which must be submitted via EFS-Web and indexed accordingly as noted above). Note that action on the application by the examiner will NOT be suspended (37 CFR 1.103) awaiting a reply by the applicant to perfect the request in a renewed request for participation. That is, if the application is picked up for examination by the examiner after the applicant has been notified of the defects in the request, any renewed request will be dismissed. If the renewed request is perfected and examination has not begun, the request and special status will be granted, the applicant will be notified and the U.S. application will be advanced out of turn for examination. If not perfected, the applicant will be notified and the application will await action in its regular turn.

(8) Request for participation in the PPH pilot program and special status granted in a parent application will not carry over to a continuing application. The applicant must fulfill all the conditions set forth above in order for special status to be granted in the continuing application.

If any of the documents identified in items (2), (6) and (7) above have already been filed in the U.S. application prior to the request for participation in the PPH pilot program, it will not be necessary for the applicant to resubmit these documents with the request for participation. The applicant may simply refer to these documents and indicate in the request for participation in the PPH pilot program when these documents were previously filed in the U.S. application.

C. Special Examining Procedures

Once the request for participation in the PPH pilot program and special status have been granted to the U.S. application, the U.S. application will be taken up for examination by the U.S. examiner before all other categories of applications except those clearly in condition for allowance, those with set time limits, such as examiner’s answers, and those that have been granted special status for “accelerated examination.”

Any claims amended or added after the grant of the request for participation in the PPH pilot program must sufficiently correspond to one or more allowable/patentable claims in the CO application(s). The applicant is required to submit a claims correspondence table along with the amendment (see B.(3) above). If the amended or newly added claims do not sufficiently correspond to the allowable/patentable claims in the CO application(s), the amendment will not be entered and will be treated as a non-responsive reply.

The PPH program does not absolve applicants of all their duties under 37 CFR 1.56 and 37 CFR 11.18. By complying with requirements B.(6) and (7) identified above, applicants would be considered to have complied with their duties to bring to the attention of the USPTO any material prior art cited in the corresponding foreign application(s) (see MPEP § 2001.06(a)). Applicants still have a duty of candor and good faith, including providing to the USPTO other information known to them to be material to patentability.

   The United States Patent and Trademark Office (USPTO) considers the
effects of the severe earthquakes in Northern Italy that occurred in May
2012, to be an "extraordinary situation" within the meaning of 37 CFR 1.183
and 37 CFR 2.146 for affected patent and trademark applicants, patentees,
reexamination parties, and trademark owners.  Since this catastrophic event
occurred outside the United States and did not result in a postal service
interruption in the United States Postal Service, the USPTO has no
authority to designate a postal service emergency as authorized by 35
U.S.C. 21(a).

   For patent applications and reexamination proceedings pending in the
USPTO as of May 29, 2012, having one or more inventors, an assignee, or a
correspondence address in areas of Northern Italy affected by the
earthquakes, in which a reply or response to an Office action (final,
non-final, or other), a notice of allowance, or other Office notice
(hereinafter collectively referred to as "Office communication") is
outstanding, and for which the statutory or non-statutory time period set
for response has not yet expired, the USPTO will, on applicant's request,
or a reexamination party's request, withdraw the Office communication and
reissue it.  The Office communication must have been outstanding on May 29,
2012.  The request must be made prior to expiration of the statutory or
non-statutory time period set for response and within sufficient time so
that withdrawal and reissuance of the Office communication occur prior to
expiration of the statutory or non-statutory time period (as permitted to
be extended under 37 CFR 1.136(a), or as extended under 37 CFR 1.550(c) or
37 CFR 1.956).  The request must be accompanied by a copy of this notice.
The inclusion of a copy of this notice will be treated as a representation
that the need for the reissuance of the Office communication was due to the
effects of the severe earthquakes in May 2012.  The request should be sent
via EFS-Web or by mail directed to Mail Stop Petition, Commissioner for

   For patentees who were unable to timely pay a patent maintenance fee due
to the effects of the severe earthquakes in May 2012, the USPTO will waive
the surcharge in 37 CFR 1.20(h) for paying a maintenance fee during the
six-month grace period following the window to pay the maintenance fee and
the surcharge in 37 CFR 1.20(i) for accepting a delayed maintenance fee
payment when the patentee files the maintenance fee payment with a petition
to accept a delayed maintenance fee under 37 CFR 1.378(c).  See 37 CFR
1.183.

   Patentees who seek to pay a maintenance fee during the six-month grace
period following the window to pay the maintenance fee with a request to
waive the surcharge in 37 CFR 1.20(h), must mail the payment and request
to:  Director of the United States Patent and Trademark Office, Attn:
Maintenance Fee, 2051 Jamieson Avenue, Suite 300, Alexandria, VA 22314; or
via facsimile to:  571-273-6500.

   The request must be accompanied by a copy of this notice.  The inclusion
of a copy of this notice with the payment of the maintenance fee during the
grace period will be treated as a representation that the late payment of
the fee was due to the effects of the severe earthquakes in May 2012, and
as a request for sua sponte waiver of the surcharge under 37 CFR 1.20(h).
This waiver may only be appropriately requested where the original window
of time to pay the maintenance fee without the surcharge required by 37 CFR
1.20(h) expired on or after May 29, 2012, and the delay in paying the fee
was due to the effects of the severe earthquakes in May 2012.

   The USPTO advises patentees who need to file a petition to accept a
delayed maintenance fee payment due to the effects of the earthquakes in
May 2012, where the maintenance fee payment was required to have been paid

after May 28, 2012, to promptly file a petition under 37 CFR 1.378(c)
(using USPTO form PTO/SB/66 - Petition to Accept Unintentionally Delayed
Payment of Maintenance Fee in an Expired Patent (37 CFR 1.378(c))
accompanied by the applicable maintenance fee payment (but not the
surcharge under 37 CFR 1.20(i)) and a copy of this notice.  The inclusion
of a copy of this notice will be treated as a representation that the delay
in payment of the maintenance fee was due to the effects of the severe
earthquakes in May 2012, and as a request for sua sponte waiver of the
surcharge under 37 CFR 1.20(i).  The petition must be filed by May 29,
2013, in order to be entitled to a waiver of the surcharge under 37 CFR
1.20(i).

   Patentees are reminded that a petition to accept a delayed maintenance
fee payment under 37 CFR 1.378(c) must be filed within twenty-four months
from the expiration date of the patent.  See 35 U.S.C. 41(c).  A petition
to accept a delayed maintenance fee payment under 37 CFR 1.378(c) due to
the effects of the severe earthquakes may be submitted via EFS-Web or by
mail directed to Mail Stop Petition, Commissioner for Patents, P.O. Box
1450, Alexandria, VA 22313-1450.  A petition to accept a delayed
maintenance fee payment filed later than twenty-four months after the

maintenance fee payment when the patentee files the maintenance fee payment

   For applicants who filed a nonprovisional application on or after May
29, 2012, and prior to June 30, 2012, without an executed oath or
declaration or payment of the basic filing fee, search fee, and/or
examination fee due to the severe earthquakes in May 2012, the USPTO will
waive the surcharge set forth in 37 CFR 1.16(f) for the late filing of the
oath or declaration or basic filing fee, search fee, and/or examination
fee. Patent applicants seeking waiver of the surcharge must include a copy
of this notice, along with the executed oath or declaration or the basic
filing fee, search fee, or examination fee.  The inclusion of a copy of
this notice will be treated as a representation that the late filing of the
oath or declaration or the basic filing fee, search fee, or examination
fee was due to the effects of the severe earthquakes in May 2012, and as a
request for sua sponte waiver of the surcharge under 37 CFR 1.16(f).  The
reply to the Notice to File Missing Parts requiring the oath or declaration

should be used, and must include a verified statement that the failure to

   The USPTO cannot grant waivers or extensions of dates or requirements

use must be filed and the associated fee(s); (2) the periods set forth in
15 U.S.C. 1058, 1141(k) for filing affidavits of continued use or excusable
nonuse and the associated fee(s); (3) the period set forth in 15 U.S.C.

   The United States Patent and Trademark Office (USPTO) is designating the
interruption in service of the United States Postal Service (USPS) in the
areas affected by the severe storms in Maryland, New Jersey, Ohio,
Virginia, West Virginia, and the District of Columbia beginning on Friday,
June 29, 2012, as a postal service interruption and emergency within the
meaning of 35 U.S.C. § 21(a) and 37 CFR 1.10(i) and 2.195(e).

   Postal services in Maryland, New Jersey, Ohio, Virginia, West Virginia,
and the District of Columbia have been impacted by the storms in varying
degrees beginning on June 29, 2012.  To determine whether a post office has
been closed or reopened, or postal services have been suspended or resumed
in a particular area due to the storms, contact the post office directly or
visit the USPS's Web site at:  http://www.usps.gov.  More specific
information should be available at
http://about.usps.com/news/service-alerts/welcome.htm.

   Once the USPS, through its Internet Web site, has notified the public
that this interruption in the service of the USPS has ended, the
designation of this interruption and emergency within the meaning of 35
U.S.C. § 21(a) and 37 CFR 1.10(i) and 2.195(e) will terminate without
further notice from the USPTO.

Patent-Related Correspondence

   37 CFR 1.10(i) addresses interruptions or emergencies in USPS "Express
Mail Post Office to Addressee" service that are designated by the Director
for patent-related correspondence.  Correspondence covered by 37 CFR 1.10
that would have been filed with the USPTO under 37 CFR 1.10 during this
USPS service interruption, but which was not filed due to the USPS service
interruption, should be filed promptly after the termination of the USPS
service interruption with a petition in accordance with 37 CFR 1.10(i)
using "Express Mail" service in accordance with 37 CFR 1.10.

   The provisions of 35 U.S.C. § 21(a) and 37 CFR 1.10(i) apply only to
postal interruptions and emergencies.  The provisions of 35 U.S.C. § 21(a)
and 37 CFR 1.10(i) do not provide for the granting of a filing date to
correspondence as of the date on which it would have been filed but for
other exigencies, such as the unavailability of an office or building
other than a USPS facility.  These provisions apply only if the post office
was closed or "Express Mail" service suspended in the affected areas on the
specified date due to the severe storms.

   37 CFR 1.10(i) provides that any person attempting to file correspondence
by "Express Mail Post Office to Addressee" service that was unable to be
deposited with the USPS due to an interruption or emergency in "Express
Mail" service which has been so designated by the Director may petition the
Director to consider such correspondence as filed on a particular date in
the Office.  37 CFR 1.10(i) specifically provides that:

   Any person attempting to file correspondence under this section that was
unable to be deposited with the USPS due to an interruption or emergency in
"Express Mail" service which has been so designated by the Director, may
petition the Director to consider such correspondence as filed on a
particular date in the Office, provided that:

Trademark-Related Correspondence

   37 CFR 2.195(e) and 2.198 address interruptions or emergencies in USPS
"Express Mail Post Office to Addressee" service that are designated by the
Director for trademark-related correspondence.  Correspondence covered by
37 CFR 2.198 that would have been filed with the USPTO under 37 CFR 2.198
during this USPS service interruption, but which was not filed due to the
interruption, should be filed promptly after the termination of the USPS
service interruption with a petition in accordance with 37 CFR 2.146 and
2.198.

   The provisions of 35 U.S.C. § 21(a) and 37 CFR 2.195(e) apply only to
postal interruptions and emergencies.  These provisions do not provide for
the granting of a filing date to correspondence as of the date on which it
would have been filed but for other exigencies, such as the unavailability
of an office or building other than a USPS facility.  These provisions
apply only if the post office was closed or "Express Mail" service
suspended in the affected areas on the specified date due to the severe
storms.

   Under 37 CFR 2.195(e) and 2.198, any person attempting to file
correspondence by "Express Mail Post Office to Addressee" service that was
unable to be deposited with the USPS due to the interruption or emergency
in "Express Mail" service in the areas designated in this notice may
petition the Director to consider such correspondence as filed on a
particular date in the Office.  The petition must:

      (1) Be filed promptly after the ending of the designated interruption
      or emergency in "Express Mail" service;

      (2) Include the original correspondence or a copy of the original
      correspondence; and

      (3) Include a statement which establishes, to the satisfaction of the
      Director, that (a) the correspondence would have been deposited with
      the USPS but for the designated interruption or emergency in "Express
      Mail" service, and (b) the correspondence or copy of the
      correspondence is the original correspondence or a true copy of the
      correspondence originally attempted to be deposited with the USPS on
      the requested filing date.

   Please note that under 37 CFR 2.101(b)(2), 2.102(a)(2), 2.198(a)(1) and
7.4(b)(2), the Express Mail procedures cannot be used for the following
types of correspondence:  applications for registration of marks;
amendments to allege use under 15 U.S.C. § 1051(c); statements of use under
15 U.S.C. § 1051(d); requests for extension of time to file a statement of
use under 15 U.S.C. § 1051(d); affidavits of continued use under 15 U.S.C.
§ 1058; renewal applications under 15 U.S.C. § 1059; requests to change or
correct addresses; combined filings under 15 U.S.C. §§ 1058 and 1059;
combined affidavits or declarations under 15 U.S.C. §§ 1058 and 1065;
responses to notices of irregularity under 37 CFR 7.14; requests for
transformation under 37 CFR 7.31; notices of opposition to applications
based on 15 U.S.C. § 1141f(a); and requests for extensions of time to
oppose applications based on 15 U.S.C. § 1141f(a).  Therefore, it would be

inappropriate to file a petition seeking a filing date as of the date of
deposit of these types of correspondence as Express Mail.

   The provisions of 37 CFR 2.198(e) on postal service interruptions or
emergencies apply only to "Express Mail Post Office to Addressee"
correspondence, and do not apply to correspondence with a certificate of
mailing pursuant to 37 CFR 2.197.  Therefore, the petition procedure set
forth in this notice is not appropriate for correspondence with a
certificate of mailing.  However, petitions concerning such correspondence
may be considered under 37 CFR 2.146 with the requisite showing of an
extraordinary situation, that justice requires relief, and that no other
party would be injured thereby.

(PTRCs), provide public access to patent and trademark information received
from the United States Patent and Trademark Office (USPTO). This
information includes all issued patents, all registered trademarks, the
Official Gazette of the U.S. Patent and Trademark Office, search tools such
as the Cassis CD-ROM suite of products and supplemental information in a
variety of formats including online, optical disc, microfilm and paper.
Each PTRC also offers access to USPTO resources on the Internet and to
PubWEST (Web based examiner search tool), a system used by patent examiners
that is not available on the Internet.

Staff assistance and training is provided in the use of this information.
All information is available free of charge. However, there may be charges
