                  Patent Cooperation Treaty (PCT) Information

   For information concerning PCT member countries, see the notice
appearing in the Official Gazette at 1369 O.G. 5, on August 2, 2011.

   For information on subject matter under Rule 39 that a particular
International Searching Authority will not search, see Annex D of the PCT
Applicants' Guide.

European Patent Office as Searching and Examining Authority

   The European Patent Office (EPO) may act as the International Searching
Authority (ISA) for an international application filed with the United
States Receiving Office or the International Bureau (IB) as Receiving
Office where at least one of the applicants is either a national or
resident of the United States of America. However, the EPO is no longer
a competent ISA, within the meaning of PCT Article 16(3), for
international applications filed by U.S. residents or nationals on or
after March 1, 2002, in the USPTO or IB as a Receiving Office, and where
the application contains one or more claims directed to the field of
business methods. For the definition of what the EPO considers to be
precluded subject matter in the field of business methods, applicants
should see the "Notice from the President of the European Patent
Office", dated November 26, 2001, and which was published as Annex A in
the "Notice Concerning EPO Competence to Act as PCT Authority" in the
Official Gazette at 1255 O.G. 878, on February 19, 2002.

   The European Patent Office may act as the International Preliminary
Examining Authority (IPEA) for an international application filed in the
United States Receiving Office or the International Bureau as Receiving
Office where at least one of the applicants is either a national or
resident of the United States of America, provided that the European
Patent Office acted as the International Searching Authority. However,
the EPO is no longer a competent IPEA, within the meaning of PCT Article
32(3), for international applications filed by U.S. residents or nationals
in the USPTO or IB as a Receiving Office where the corresponding demand is
filed with the EPO on or after March 1, 2002, and where the application
contains one or more claims directed to the field of business methods.

   The search fee of the European Patent Office was decreased, effective
January 1, 2012, and was announced in the Official Gazette at 1373 O.G.
177, on December 27, 2011.

Korean Intellectual Property Office as Searching and Examining Authority

   For use of the Korean Intellectual Property Office as an International
Searching Authority and International Preliminary Examining Authority for
international applications filed in the United States Receiving Office,
see the notice appearing in the Official Gazette at 1302 O.G. 1261 on
January 17, 2006.

   The search fee of the Korean Intellectual Property Office was decreased,
effective January 1, 2012, and was announced in the Official Gazette at
1373 O.G. 177, on December 27, 2011.

Australian Patent Office as Searching and Examining Authority

   The Australian Patent Office (IP Australia) may act as the International
Searching Authority (ISA) for an international application filed with the
United States Receiving Office or the International Bureau (IB) as
Receiving Office where at least one of the applicants is either a national
or resident of the United States of America. However, IP Australia is not a
competent ISA, within the meaning of PCT Artical 16(3), for international
applications filed by U.S. residents or nationals in the USPTO or IB as a
Receiving Office, and where the application contains one or more claims

directed to the field of business methods or mechanical inventions.

   IP Australia may act as the International Preliminary Examining
Authority (IPEA) for an international application filed in the United
States Receiving Office or the International Bureau as Receiving Office
where at least one of the applicants is either a national or resident of
the United States of America, provided that IP Australia acted as the
International Searching Authority. However, IP Australia is not a competent
IPEA, within the meaning of PCT Article 32(3), for international
applications filed by U.S. residents or nationals in the USPTO or IB as a
Receiving Office where the corresponding demand is filed with IP Australia
and where the application contains one or more claims directed to the
fields of business methods or mechanical engineering or analogous fields of
technology as defined by specified areas of the International Patent
Classification System, as indicated in Annex A to the agreement between the
USPTO and IP Australia. See the notice appearing in the Official Gazette
at 1337 O.G. 261 on December 23, 2008.

   For use of IP Australia as an International Searching Authority and
International Preliminary Examining Authority for international
applications filed in the United States Receiving Office, see the notice
appearing in the Official Gazette at 1337 O.G. 265 on December 23, 2008.

   The search fee of IP Australia was increased, effective January 1, 2012,
and was announced in the Official Gazette at 1373 O.G. 177, on December 27,
2011.

Fees

   The transmittal fee for the USPTO was changed to include a basic portion
and a non-electronic filing fee portion, effective November 15, 2011, and
was announced in the Federal Register on November 15, 2011. Search fees for
the USPTO were changed, effective January 12, 2009, and were announced in
the Federal Register on November 12, 2008. The fee for filing a request for
the restoration of the right of priority was established, effective
November 9, 2007, and was announced in the Federal Register on September 10,
2007.

   International filing fees were increased, effective January 1, 2012,
and were announced in the Official Gazette at 1373 O.G. 177, on December
27, 2011.

   The schedule of PCT fees (in U.S. dollars), as of January 1, 2012, is as

                   Notice of Maintenance Fees Payable

   Title 37 Code of Federal Regulations (CFR), Section 1.362(d) provides
that maintenance fees may be paid without surcharge for the six-month
period beginning 3, 7, and 11 years after the date of issue of patents
based on applications filed on or after Dec. 12, 1980. An additional
six-month grace period is provided by 35 U.S.C. 41(b) and 37 CFR 1.362(e)
for payment of the maintenance fee with the surcharge set forth in 37 CFR
1.20(h), as amended effective Dec. 16, 1991. If the maintenance fee is
not paid in the patent requiring such payment the patent will expire on
the 4th, 8th, or 12th anniversary of the grant.

   Attention is drawn to the patents that were issued on February 24, 2009
for which maintenance fees due at 3 years and six months may now be paid

   35 U.S.C. 41 and 37 CFR 1.362(g) provide that if the required
maintenance fee and any applicable surcharge are not paid in a patent
requiring such payment, the patent will expire at the end of the 4th, 8th
or 12th anniversary of the grant of the patent depending on the first
maintenance fee which was not paid.

   This concerns Craig J.J. Snyder of New York City, New York, an attorney
admitted to practice law in the State of New York, who is not a registered
practitioner and who is not authorized to practice patent law before the
United States Patent and Trademark Office ("USPTO").  In a reciprocal
disciplinary proceeding, the USPTO Director has ordered Mr. Snyder be
excluded from the practice of trademark and non-patent law before the United
States Patent and Trademark Office for violating 37 C.F.R. § 10.23(b)(6) via
37 C.F.R. § 10.23(c)(5)(i) when he was disbarred on ethical grounds from the
practice of law in the State of New York.

   The Supreme Court, Appellate Division, First Department of New York
issued an order disbarring Mr. Snyder based on uncontested evidence of
professional misconduct, namely, that Mr. Snyder converted to his personal
use settlement funds he was holding in escrow which totaled approximately
$244,000.  On March 8, 2010, Mr. Snyder pled guilty to grand larceny in the
third degree, in violation of Penal Law § 155.35, a class D felony.  On
April 19, 2010, Mr. Snyder was sentenced to a three year conditional
discharge and 200 hours of community service.

   This action is taken pursuant to the provisions of 35 U.S.C. §§
2(b)(2)(D) and 32, and 37 C.F.R. §§ 11.24 and 11.59.  Disciplinary

                   Notice of Public Reprimand and Probation

   This concerns Fred P. Lane of Wausau, Wisconsin, registered patent agent
(Registration No. 58,188).  The United States Patent and Trademark Office
("USPTO" or "Office") has publicly reprimanded Mr. Lane and placed him on
probation for twenty-four (24) months.  Mr. Lane is permitted to practice
patent law before the Office during his probationary period unless he is
subsequently suspended by order of the USPTO Director.

   A client retained Mr. Lane as his patent agent to prepare, file, and
prosecute a patent application seeking patent protection for the client's
invention.  Prior to accepting employment to represent the client before
the Office, Mr. Lane and the client signed two confidentiality and
nondisclosure agreements.  One was drafted by Mr. Lane; the other was
drafted by the client's independent counsel.  The confidentiality and
nondisclosure agreement drafted by the client's independent counsel stated
that Mr. Lane planned  "to participate in the design, assembly, manufacture
and intellectual property protection, including but not limited to a
United States patent, of a prosthetic valve clip ('Invention') for [the
client]."  It also stated that the client "shall be the sole owner of the
Invention and shall have the exclusive ownership of and right to use and
to license others to use the Invention."  Additionally, the client hired
Mr. Lane to help market the client's invention, and, in this capacity, Mr.
Lane met with third parties (e.g., medical manufacturing companies and
hospitals) on behalf of his client about the client's invention.

   During the course of the multi-year practitioner-client relationship,
Mr. Lane prepared and filed in the Office two provisional patent
applications and two non-provisional patent applications claiming benefit
to the provisional applications, each seeking protection for the client's
invention.  Each of these applications named the client, Mr. Lane, and a
retired mechanical engineer associated as an independent contractor with
Mr. Lane's firm, as joint inventors.  These applications were subsequently
assigned to a business entity formed, and solely owned, by the client.

   Mr. Lane also prepared and filed a third provisional patent application
naming only himself and the retired mechanical engineer as joint inventors.
This application was directed to a medical instrument similar to the
client's invention.  Mr. Lane prepared and filed a third non-provisional
application, which claimed priority to the third provisional application.
The third non-provisional application also named only Mr. Lane and the
engineer as joint inventors.  Neither Mr. Lane nor the retired mechanical
engineer regarded the client as an inventor of the invention disclosed and
claimed in the third provisional and non-provisional applications.  Mr.
Lane represents that he believed the invention disclosed and claimed in the
third provisional and non-provisional applications was outside the scope of
his agreement with the client.

   Mr. Lane was the prosecuting agent for all three non-provisional
applications. Mr. Lane did not obtain the client's consent after full
disclosure of the potential or actual conflict of interests that could
arise between him and the client if Mr. Lane (a) were to seek patent
protection for inventions similar to, or derivative of, the client's
invention and (b) were to name himself as a joint inventor on patent
applications seeking patent protection for such inventions.

   Mr. Lane represents that his failure to disclose such potential or
actual conflict of interests was not intentional.

   Mr. Lane represents that, prior to accepting employment to represent the
client before the Office, the client had independent legal counsel with
respect to a business relationship that resulted by hiring Mr. Lane's firm
to assist in developing, designing, assembling, manufacturing, and
marketing the client's invention.  Nevertheless, Mr. Lane did not obtain
the client's consent after full disclosure of the potential or actual

conflict of interests that could arise between Mr. Lane and the client as a
result of Mr. Lane also being hired to assist the client in such manner.
Mr. Lane represents that his failure to obtain the client's consent after
full disclosure of those potential or actual conflict of interests was not
intentional.

   A patent practitioner who names himself as a co-inventor with his client
may create a potential conflict of interest with the client and may be in
violation of the USPTO's Disciplinary Rules.  Hence, a patent practitioner
may be subject to disciplinary action if the patent practitioner, prior to
naming himself as an co-inventor, does not fully disclose the conflict of
interest to the client and obtain the client's consent after full
disclosure.  See In the Matter of Christopher H. Lynt (USPTO Disciplinary
Proceeding No. D2005-08) (two-year suspension) (registered patent attorney
reciprocally disciplined by the USPTO based on a finding by a Virginia
Circuit Court that practitioner had violated the Virginia Code of
Professional Responsibility's prohibition on using a confidence or secret
of a client to the disadvantage of a client where, without a former
client's authorization, the attorney filed a patent application naming
himself as a co-inventor with the former client and then later sought $2.6
million plus royalties in exchange for an assignment).  See also In the

D2006-04) (exclusion) (registered patent attorney reciprocally disciplined
by the USPTO based on a finding by the Supreme Court of Arizona that the

an ownership interest adverse to a client without a client's consent).

   This notice concerns Anup Tikku of San Jose, California, registered
patent attorney (Registration Number 42,185).  Mr. Tikku has been publicly
reprimanded by the United States Patent and Trademark Office ("USPTO" or
"Office") for violating 37 C.F.R. § 10.23(b)(6) by engaging in conduct that
adversely reflects upon a practitioner's fitness to practice.

   The State Bar Court of California issued a Stipulated Order of Reproval
dated June 20, 2011, publicly reprimanding Mr. Tikku, an attorney licensed
to practice law in the state of California, in connection with his plea of
nolo contendere to a violation of California Penal Code section 242/43,
subdivision (a) (battery), which was reported to Child Protective Services
by a teacher.  Respondent had been charged in connection with his conduct
in striking his child in such a fashion so as to leave visible bruising,
after he became frustrated with his child's refusal to complete a homework
assignment. Respondent, as part of his plea, was placed on probation for
two years.  On June 29, 2011, the Superior Court of the State of
California, County of Santa Clara expunged the conviction and terminated
the probation.

   This action is the result of a settlement agreement between Mr. Tikku
and the OED Director pursuant to the provisions of 35 U.S.C. § 2(b)(2)(D)
and 37 C.F.R. §§ 11.20, 11.26 and 11.59.  Disciplinary decisions involving

   This notice concerns Kenneth Brian Matlock of Walnut Creek, California,
a registered patent attorney (Registration No. 52,005).  Mr. Matlock has
been suspended for twenty-four months by the United States Patent and
Trademark Office ("USPTO" or "Office") for violating 37 C.F.R. § 10.77(c).
Mr. Matlock is eligible to request reinstatement after serving twelve
months of his 24-month suspension.  Mr. Matlock has also been placed on
probation for twenty four months.

   During his representation of certain clients before the Office, Mr.
Matlock allowed patent applications to become abandoned without those
clients' consent.  Mr. Matlock represents that his firm had significant
staffing problems during the time of the events at issue and that a new
office manager made several clerical and administrative errors that
contributed to the abandonments.  He further represents that, since the
events at issue, his firm has subsequently hired new personnel, including
a new office manager and intellectual property paralegal, and has
meticulously trained them in patent procedures.

   This action is the result of a settlement agreement between Mr. Matlock

Revised Requirements for the Patent Prosecution Highway (PPH) Program to Implement PPH 2.0 with Participating Offices

I. Background

Since July 15, 2011, the United States Patent and Trademark Office (USPTO) and seven other offices (i.e., IP Australia (IPAU), Canada (CIPO), Finland (NBPR), Japan (JPO), Russia (ROSPATENT), Spain (SPTO) and United Kingdom (UKIPO)) have participated in an enhanced PPH pilot program called “MOTTAINAI”. Under MOTTAINAI, participation in the PPH may be requested on the basis of search and examination results from any patent family application from any participating office, regardless of whether the participating office was the office of first filing. To implement the MOTTAINAI pilot, the USPTO revised its PPH requirements. See for example the notice available at http://www.uspto.gov/web/offices/com/sol/og/2011/week33/TOC.htm#ref13.

In order to further enhance the PPH program and to encourage greater usage of, and participation in, the PPH program, the USPTO and the above-identified MOTTAINAI participating offices, along with the European Patent Office (EPO), have agreed to implement PPH 2.0 by simplifying the PPH requirements and procedures in a consolidated and user-friendly framework, while at the same time ensuring that work sharing benefits to the offices are not diminished. The revised requirements for PPH 2.0 and the trial period are set forth below and supersede the PPH notices to implement the MOTTAINAI pilot programs between the USPTO and the seven MOTTAINAI participating offices. The PCT-PPH pilot program is not affected by the current notice and remains available to applicants under the existing guidelines. II. Trial Period for the PPH 2.0 Program

The PPH 2.0 program commenced on January 29, 2012, and will run for a period of one year ending on January 28, 2013. The PPH 2.0 participating offices are IPAU, CIPO, EPO, NBPR, JPO, ROSPATENT, SPTO and UKIPO. The revised requirements will apply to PPH requests filed in the USPTO on or after January 29, 2012, based on claims that have been determined allowable by one of the PPH 2.0 participating offices in a corresponding application filed in that office. The trial period may be extended for up to an additional year if necessary to adequately assess the feasibility of the PPH 2.0 program. The USPTO and the PPH 2.0 participating offices will evaluate the results of the PPH 2.0 program to determine whether and how the program should be implemented after the trial period. The offices may also terminate the PPH 2.0 program early if the volume of participation exceeds a manageable level, or for any other reason. Notice will be published if the PPH 2.0 program will be terminated before the January 28, 2013 date.

III. Revised Requirements for Requesting Participation in the PPH 2.0 Program in the USPTO

In order to be eligible to participate in the PPH 2.0 program in the USPTO, the following conditions must be met:

(1) At least one claim was determined by one of the PPH 2.0 participating offices to be allowable/patentable. The applicant will no longer need to submit a copy of the allowed claims from the application filed in the PPH 2.0 participating office or any English translation thereof.

(2) The U.S. application for which participation in the PPH 2.0 program is requested and the corresponding application filed in the PPH 2.0 participating office (with the allowable/patentable claim(s)) must have the same priority/filing date. In particular, the U.S. application (including national stage entry of a PCT application and a so-called bypass application filed under 35 U.S.C. § 111(a) which validly claims benefit under 35 U.S.C. § 120 to a PCT application):

    Case I – is an application that validly claims priority under 35 U.S.C. § 119(a) and 37 CFR 1.55 to one or more applications filed with the PPH 2.0 participating office (examples are provided in the ANNEX, Figures A, B, C and D),
    or
    Case II – is an application which is the basis of a valid priority claim under the Paris Convention for the application filed in the PPH 2.0 participating office (examples are provided in the ANNEX, Figures E, F and G),
    or
    Case III – is an application which shares a common priority document with the application filed in the PPH 2.0 participating office (examples are provided in the ANNEX, Figures H, I, J, K, L, M and N),
    or
    Case IV – and the application filed in the PPH 2.0 participating office are derived from/related to a PCT application having no priority claim (example is provided in the ANNEX, Figure O).

Provisional applications, plant applications, design applications, reissue applications, reexamination proceedings, and applications subject to a secrecy order are excluded and not subject to participation in the PPH 2.0 program.

(3) All claims on file, as originally filed or as amended, for examination under the PPH 2.0 program in the U.S. application must sufficiently correspond to one or more of those claims indicated as allowable in the application filed in the PPH 2.0 participating office. A claim is considered to "sufficiently correspond" where, accounting for differences due to translations and claim format, the claim in the U.S. application is of the same or similar scope as a claim indicated as allowable in the application filed in the PPH 2.0 participating office. A claim in the U.S. application which is narrower in scope than the claims indicated as allowable in the application filed in the PPH 2.0 participating office will also sufficiently correspond if presented as a claim dependent upon a claim which is of the same or similar scope as a claim indicated as allowable in the application filed in the PPH 2.0 participating office. The additional limitation that makes the claim in the U.S. application narrower in scope than the allowable/patentable claims in the application filed in the PPH 2.0 participating office must have support in the written description of the U.S. application.

A claim in the U.S. application which introduces a new/different category of claims to those claims indicated as allowable in the application filed in the PPH 2.0 participating office is not considered to sufficiently correspond. For example, if the only allowable/patentable claims in the application filed in the PPH 2.0 participating office are claims to a process of manufacturing a product, then any product claims in the U.S. application are not considered to sufficiently correspond, even if the product claims are dependent on process claims which sufficiently correspond to allowable/patentable claims in the application filed in the PPH 2.0 participating office.

The applicant is required to submit a claims correspondence table in English. The claims correspondence table must indicate how all the claims in the U.S. application correspond to the allowable/patentable claims in the application(s) filed in the PPH 2.0 participating office. Any dependent claims with additional limitations must be clearly identified in the claims correspondence table.

(4) Examination of the U.S. application for which participation in the PPH 2.0 program is requested has not begun.

(5) The applicant must file a request for participation in the PPH 2.0 program and a request that the U.S. application be advanced out of turn for examination by order of the Director to expedite the business of the Office under 37 CFR 1.102(a). Revised PPH request forms are available from the USPTO Web site at http://www.uspto.gov. Applicants are encouraged to use the USPTO request form. A petition fee under 37 CFR 1.17(h) is NOT required. See Notice Regarding the Elimination of the Fee for Petitions To Make Special Filed Under the Patent Prosecution Highway (PPH) Programs, 75 Fed. Reg. 29312 (May 25, 2010).

(6) The applicant must submit a copy of the office action issued just prior to the “Decision to Grant a Patent” (e.g., the latest “Notification of Reasons for Refusal”) from each of the application(s) filed in the PPH 2.0 participating office containing the allowable/patentable claims that form the basis for the request, along with an English translation thereof. The English translation may be a machine translation. The applicant will no longer need to provide a statement that the English translation is accurate if the office actions are not in the English language.

It will not be necessary for the applicant to submit a copy of the “Decision to Grant a Patent” and an English translation thereof. If the application filed in the PPH 2.0 participating office is a first action allowance, i.e., there is no office action just prior to the “Decision to Grant a Patent,” then the applicant should indicate on the request form that no office action from the application filed in the PPH 2.0 participating office is submitted since the application was a first action allowance.

If the copy of the office action (along with an English translation thereof if the office action is not in the English language) from the application filed in the PPH 2.0 participating office is available via the dossier access system, instead of submitting a copy of the office action, the applicant may request that the USPTO obtain such a copy of the office action (along with an English translation thereof if the office action is not in the English language) via the dossier access system. If the USPTO is not able to obtain a copy of the office action (along with an English translation thereof if the office action is not in the English language) via the dossier access system, the applicant will be notified and given an opportunity to submit a copy of the office action (along with an English translation thereof if the office action is not in the English language) from the application filed in the PPH 2.0 participating office. The English translation may be a machine translation.

If the USPTO finds the machine translation (submitted by the applicant or obtained by the USPTO via the dossier access system) is of such poor quality that it is difficult to understand, the applicant may be required by the USPTO to submit a manual translation into the English language of the office action from the application filed in the PPH 2.0 participating office.

The applicant must submit copies of any office actions (which are relevant to patentability) from the application(s) filed in the PPH 2.0 participating office issued after the grant of the request for participation in the PPH 2.0 program in the USPTO (especially where the PPH 2.0 participating office might have reversed a prior holding of allowability).

(7) The applicant must submit an information disclosure statement (IDS) listing the documents cited in the office action of the PPH 2.0 participating office (unless such an IDS has already been filed in the U.S. application). The applicant must submit copies of all the documents cited in the office action of the PPH 2.0 participating office (unless the copies have already been filed in the U.S. application) except U.S. patents or U.S. patent application publications.

The request for participation in the PPH 2.0 program and all the supporting documents must be submitted to the USPTO via EFS-Web and indexed with the following document description: “Petition to make special under Patent Pros Hwy.” Information regarding EFS-Web is available at http://www.uspto.gov/ebc/efs_help.html. Any preliminary amendment or IDS submitted with the PPH 2.0 documents must be separately indexed as a preliminary amendment or an IDS, respectively.

Where the request for participation in the PPH 2.0 program and special status are granted, the applicant will be notified and the U.S. application will be advanced out of turn for examination. In those instances where the request for participation in the PPH 2.0 program does not meet all the requirements set forth above, the applicant will be notified and the defects in the request will be identified. The applicant will be given one opportunity to perfect the request in a renewed request for participation (which must be submitted via EFS-Web and indexed accordingly as noted above). Note that action on the application by the USPTO will NOT be suspended (37 CFR 1.103) awaiting a reply by the applicant to perfect the request in a renewed request for participation. That is, if the application is picked up for examination after the applicant has been notified of the defects in the request, any renewed request will be dismissed. If the renewed request is perfected and examination has not begun, the request and special status will be granted, the applicant will be notified and the U.S. application will be advanced out of turn for examination. If the request is not perfected, the applicant will be notified and the application will await action in its regular turn.

(8) Although a request for participation in the PPH 2.0 program and special status granted in an application carries over to a request for continued examination (RCE) of the application, a request for participation in the PPH 2.0 program and special status granted in a parent application will not carry over to a continuing application. The applicant must fulfill all the conditions set forth above in order for special status to be granted in the continuing application.

If any of the documents identified in items (2), (6) and (7) above have already been filed in the U.S. application prior to the request for participation in the PPH 2.0 program, it will not be necessary for the applicant to resubmit these documents with the request for participation. The applicant may simply refer to these documents and indicate in the request for participation in the PPH 2.0 program when these documents were previously filed in the U.S. application.

IV. Special Examining Procedures

Once the request for participation in the PPH 2.0 program and special status have been granted to the U.S. application, the U.S. application will be advanced out of turn for examination.

Any claims amended or added after the grant of the request for participation in the PPH 2.0 program must sufficiently correspond to one or more allowable/patentable claims in the application(s) filed in the PPH 2.0 participating office. The applicant is required to submit, along with the amendment, a statement certifying that the amended or newly added claims sufficiently correspond to the allowable/patentable claims in the application(s) filed in the PPH 2.0 participating office. If the certification statement is omitted, the amendment will not be entered and will be treated as a non-responsive reply.

The PPH 2.0 program does not absolve applicants of all their duties under 37 CFR 1.56 and 37 CFR 11.18. By complying with requirements III.(6) and (7) identified above, applicants would be considered to have complied with their duties to bring to the attention of the USPTO any material prior art cited in the corresponding foreign application(s) (see MPEP § 2001.06(a)). Applicants still have a duty of candor and good faith, including providing to the USPTO other information known to them to be material to patentability.

             Public Use in Patent and Trademark Resource Centers

The following libraries, designated as Patent and Trademark Resource Centers
(PTRCs), provide public access to patent and trademark information received
from the United States Patent and Trademark Office (USPTO). This
information includes all issued patents, all registered trademarks, the
Official Gazette of the U.S. Patent and Trademark Office, search tools such
as the Cassis CD-ROM suite of products and supplemental information in a
variety of formats including online, optical disc, microfilm and paper.
Each PTRC also offers access to USPTO resources on the Internet and to
PubWEST (Web based examiner search tool), a system used by patent examiners
that is not available on the Internet.

Staff assistance and training is provided in the use of this information.
All information is available free of charge. However, there may be charges
associated with the use of photocopying and related services. Hours of
service to the public vary, and anyone contemplating use of these
collections at a particular library is urged to contact that library in
advance about its services and hours to avoid inconvenience.
