Patent Cooperation Treaty (PCT) Information For information concerning PCT member countries, see the notice appearing in the Official Gazette at 1369 O.G. 5, on August 2, 2011. For information on subject matter under Rule 39 that a particular International Searching Authority will not search, see Annex D of the PCT Applicants' Guide. European Patent Office as Searching and Examining Authority The European Patent Office (EPO) may act as the International Searching Authority (ISA) for an international application filed with the United States Receiving Office or the International Bureau (IB) as Receiving Office where at least one of the applicants is either a national or resident of the United States of America. However, the EPO is no longer a competent ISA, within the meaning of PCT Article 16(3), for international applications filed by U.S. residents or nationals on or after March 1, 2002, in the USPTO or IB as a Receiving Office, and where the application contains one or more claims directed to the field of business methods. For the definition of what the EPO considers to be precluded subject matter in the field of business methods, applicants should see the "Notice from the President of the European Patent Office", dated November 26, 2001, and which was published as Annex A in the "Notice Concerning EPO Competence to Act as PCT Authority" in the Official Gazette at 1255 O.G. 878, on February 19, 2002. The European Patent Office may act as the International Preliminary Examining Authority (IPEA) for an international application filed in the United States Receiving Office or the International Bureau as Receiving Office where at least one of the applicants is either a national or resident of the United States of America, provided that the European Patent Office acted as the International Searching Authority. However, the EPO is no longer a competent IPEA, within the meaning of PCT Article 32(3), for international applications filed by U.S. residents or nationals in the USPTO or IB as a Receiving Office where the corresponding demand is filed with the EPO on or after March 1, 2002, and where the application contains one or more claims directed to the field of business methods. The search fee of the European Patent Office was increased, effective January 1, 2011, and was announced in the Official Gazette at 1361 O.G. 180, on December 28, 2010. Korean Intellectual Property Office as Searching and Examining Authority For use of the Korean Intellectual Property Office as an International Searching Authority and International Preliminary Examining Authority for international applications filed in the United States Receiving Office, see the notice appearing in the Official Gazette at 1302 O.G. 1261 on January 17, 2006. The search fee of the Korean Intellectual Property Office was increased, effective November 1, 2011, and was announced in the Official Gazette at 1372 O.G. 71, on November 8, 2011. Australian Patent Office as Searching and Examining Authority The Australian Patent Office (IP Australia) may act as the International Searching Authority (ISA) for an international application filed with the United States Receiving Office or the International Bureau (IB) as Receiving Office where at least one of the applicants is either a national or resident of the United States of America. IP Australia may act as the International Preliminary Examining Authority (IPEA) for an international application filed in the United States Receiving Office or the International Bureau as Receiving Office where at least one of the applicants is either a national or resident of the United States of America, provided that IP Australia acted as the International Searching Authority. However, IP Australia is not a competent IPEA, within the meaning of PCT Article 32(3), for international applications filed by U.S. residents or nationals in the USPTO or IB as a Receiving Office where the corresponding demand is filed with IP Australia and where the application contains one or more claims directed to the fields of business methods or mechanical engineering or analogous fields of technology as defined by specified areas of the International Patent Classification System, as indicated in Annex A to the agreement between the USPTO and IP Australia. The search fee of IP Australia was increased, effective August 1, 2011, and was announced in the Official Gazette at 1369 O.G. 184, on August 23, 2011. Fees The transmittal fee for the USPTO was changed to include a basic portion and a non-electronic filing fee portion, effective November 15, 2011, and was announced in the Federal Register on November 15, 2011. Search fees for the USPTO were changed, effective January 12, 2009, and were announced in the Federal Register on November 12, 2008. The fee for filing a request for the restoration of the right of priority was established, effective November 9, 2007, and was announced in the Federal Register on September 10, 2007. International filing fees were increased, effective November 1, 2011, and were announced in the Official Gazette at 1372 O.G. 71, on November 8, 2011. Patent Cooperation Treaty Update The International Bureau of the World Intellectual Property Organization has informed the United States Patent and Trademark Office, that due to changes in the exchange rate of the U.S. dollar with regard to the Swiss franc, the dollar amounts of certain fees for international applications filed in the United States Receiving Office have been changed, effective January 1, 2012. The amount of these fees will be: International fees International filing fee $1,453.00 International filing fee-filed in paper with PCT EASY zip file or electronically without PCT EASY zip file $1,344.00 International filing fee-filed electronically with PCT EASY zip file $1,234.00 Supplemental fee for each page over 30 $16.00 The International Bureau of the World Intellectual Property Organization has informed the United States Patent and Trademark Office, that due to changes in the exchange rate of the U.S. dollar with regard to the Swiss franc, the dollar amount for the handling fee required by United States Patent and Trademark Office (USPTO) has changed with effect from January 1, 2012. The dollar amount of the handling fee required by United States Patent and Trademark Office when acting as an International Preliminary Examining Authority will be $219 beginning January 1, 2012. The International Bureau of the World Intellectual Property Organization has informed the United States Patent and Trademark Office that an increased dollar amount has been established for the search fees required by the Australian Patent Office, the European Patent Office, and the Korean Intellectual Property Office with effect from January 1, 2012. The dollar amount of the search fee required by the Australian Patent Office when acting as an International Searching Authority will be $1,833 beginning January 1, 2012. The dollar amount of the search fee required by the European Patent Office when acting as an International Searching Authority will be $2,370 beginning January 1, 2012. The dollar amount of the search fee required by the Korean Intellectual Property Office when acting as an International Searching Authority will be $1,101 beginning January 1, 2012.

Notice of Maintenance Fees Payable Title 37 Code of Federal Regulations (CFR), Section 1.362(d) provides that maintenance fees may be paid without surcharge for the six-month period beginning 3, 7, and 11 years after the date of issue of patents based on applications filed on or after Dec. 12, 1980. An additional six-month grace period is provided by 35 U.S.C. 41(b) and 37 CFR 1.362(e) for payment of the maintenance fee with the surcharge set forth in 37 CFR 1.20(h), as amended effective Dec. 16, 1991. If the maintenance fee is not paid in the patent requiring such payment the patent will expire on the 4th, 8th, or 12th anniversary of the grant. Attention is drawn to the patents that were issued on December 16, 2008 for which maintenance fees due at 3 years and six months may now be paid The patents have patent numbers within the following ranges: Utility Patents 7,464,413 through 7,467,417 Reissue Patents based on the above identified patents. Survey of Registered Practitioners in Patent Cases |
Survey of Registered Practitioners in Patent Cases The Office of Enrollment and Discipline (OED) will be conducting a survey of active registered practitioners pursuant to 37 C.F.R. § 10.11. The purpose of the survey is to ascertain whether the practitioners desire to remain on the register. The United States Patent and Trademark Office benefits from the survey by obtaining confirmation that OED's records regarding each practitioner's address and telephone number are correct, or by receiving updated information. In the past, the survey has prompted some individuals to advise OED of the deaths of other practitioners. At the present time, there are more than 41,750 active registered practitioners. A register of all active registered practitioners, also called the roster, is found on the Office website at https://oedci.uspto.gov/OEDCI/. This survey will not be conducted of the entire roster of 41,750 active registered practitioners at one time. Instead, the survey is being conducted of a portion of the active registered practitioners at a time. Information regarding future surveys will be posted on the OED website. A survey letter will be mailed on or about January 24, 2012, to active registered practitioners whose registration numbers are below 25,000. Enclosed with the survey letter will be a blue Data Sheet, which practitioners must complete and return to OED within forty-five (45) days of the date the survey is mailed. The survey will be mailed to the official address on the roster. This is the last address for which the Director of Enrollment and Discipline received separate notice. See 37 C.F.R § 11.11(a) Practitioners must reply to the survey letter even if the current contact information is correct. The name and address of any practitioner failing to reply and give any information requested by the Deputy General Counsel for Enrollment and Discipline and Director of Enrollment and Discipline within the 45-day time limit specified will be published in the Official Gazette. A further 30-day opportunity will be given to respond and provide the requested information. Thereafter, the names of practitioners failing to reply and give the requested information will be removed from the register and the names of individuals so removed will be published in the Official Gazette. See 37 C.F.R. § 10.11. The name of any individual so removed may be reinstated on the register as may be appropriate and upon payment of the fee set forth in 37 CFR § 1.21(a)(3). Practitioners can determine if they should receive a survey letter and Data Sheet by checking the roster on the Office website. A practitioner on the roster with a registration number below 25,000, should receive the survey letter and blue Data Sheet within one week of the mailing date of the survey, if the practitioner receives mail at the address on the roster. If a practitioner does not receive the survey within one week of the mailing date of the survey, the practitioner should contact OED via mail addressed to: Mail Stop OED, Director of the Office of Enrollment and Discipline, P.O. Box 1450, Alexandria, VA 22313-1450, or via e-mail addressed to: OED@USPTO.gov. If an individual's name is not on the roster, and the individual's registration number is below 25,000, the individual's name has been endorsed as inactive on the roster. Individuals whose names are endorsed as inactive include those who failed to reply to previous surveys, or requested to be removed from the roster, as well as individuals employed by the Office. No survey will be sent to these individuals. Practitioners having a registration number higher than 25,000 are not in the current survey. Accordingly, it is not necessary for them to call or advise OED that they did not receive the survey. A survey will be sent to them in the future. Practitioners should check and verify their mailing address information regularly. Practitioner contact information must be updated within 30 days of any change. Additional Courtesy Electronic Mail Addresses Now Permitted for Trademark Correspondence As part of efforts by the United States Patent and Trademark Office ("USPTO") to improve the experience of trademark applicants and registrants and to benefit from the advantages of increased electronic processing, effective November 19, 2011, the USPTO began permitting the submission of more than one electronic mail (e-mail) address for receipt of duplicate courtesy copies of trademark-related correspondence sent from the USPTO by e-mail, in addition to the single official correspondence address. Providing the additional addresses is entirely optional, available to those who find it helps them to manage more effectively their communications with the USPTO. For example, these courtesy copies will improve communication for correspondents in trademark cases who would like additional points of contact (such as law firm docketing staff) immediately notified about the USPTO's actions. Trademark applicants must provide an address to which correspondence can be mailed in order to receive a filing date (37 CFR § 2.21(a)(2)). Applicants may submit an e-mail address and authorize the USPTO to use that address for Office actions, notices, or other correspondence concerning an application or registration (37 CFR § 2.18; Trademark Manual of Examining Procedure, 8th edition, October 2011 ("TMEP") § 304.03). Such e-mail correspondence provides convenience for applicants and registrants, as well as efficiencies for the USPTO. Previously, because Trademark Rule 2.18(a)(6) provides that the USPTO will officially correspond with only one address in an ex parte matter, and because of information technology limitations, the USPTO limited e-mail communication with an applicant or registrant to a single e-mail address. In response to requests from trademark applicants and registrants, the USPTO has made the necessary changes in its electronic systems and now allows the designation of one primary e-mail address for trademark-related correspondence and up to four secondary e-mail addresses for duplicate courtesy copies of the correspondence. Although the USPTO will send e-mail correspondence to all of the addresses listed, the primary address will differ from the secondary addresses in how the USPTO will treat undelivered e-mail. If an e-mail sent to the primary address is returned as undeliverable, the USPTO will send a paper copy to the correspondence address of record (TMEP § 403). The USPTO will not attempt to resend correspondence when a duplicate courtesy e-mail sent to a secondary address is returned as undeliverable. Reference Collections of U.S. Patents Available for Public Use in Patent and Trademark Resource Centers The following libraries, designated as Patent and Trademark Resource Centers (PTRCs), provide public access to patent and trademark information received from the United States Patent and Trademark Office (USPTO). This information includes all issued patents, all registered trademarks, the Official Gazette of the U.S. Patent and Trademark Office, search tools such as the Cassis CD-ROM suite of products and supplemental information in a variety of formats including online, optical disc, microfilm and paper. Each PTRC also offers access to USPTO resources on the Internet and to PubWEST (Web based examiner search tool), a system used by patent examiners that is not available on the Internet. Staff assistance and training is provided in the use of this information. All information is available free of charge. However, there may be charges associated with the use of photocopying and related services.
