                  Patent Cooperation Treaty (PCT) Information

   For information concerning PCT member countries, see the notice
appearing in the Official Gazette at 1350 O.G. 73, on January 12, 2010

   For information on subject matter under Rule 39 that a particular
International Searching Authority will not search, see Annex D of the PCT
Applicants' Guide.

European Patent Office as Searching and Examining Authority

   The European Patent Office (EPO) may act as the International Searching
Authority (ISA) for an international application filed with the United
States Receiving Office or the International Bureau (IB) as Receiving
Office where at least one of the applicants is either a national or
resident of the United States of America. However, the EPO is no longer
a competent ISA, within the meaning of PCT Article 16(3), for
international applications filed by U.S. residents or nationals on or
after March 1, 2002, in the USPTO or IB as a Receiving Office, and where
the application contains one or more claims directed to the field of
business methods. For the definition of what the EPO considers to be
precluded subject matter in the field of business methods, applicants
should see the "Notice from the President of the European Patent
Office", dated November 26, 2001, and which was published as Annex A in
the "Notice Concerning EPO Competence to Act as PCT Authority" in
the Official Gazette at 1255 O.G. 878, on February 19, 2002.

   The European Patent Office may act as the International Preliminary
Examining Authority (IPEA) for an international application filed in the
United States Receiving Office or the International Bureau as Receiving
Office where at least one of the applicants is either a national or
resident of the United States of America, provided that the European
Patent Office acted as the International Searching Authority. However,
the EPO is no longer a competent IPEA, within the meaning of PCT Article
32(3), for international applications filed by U.S. residents or nationals
in the USPTO or IB as a Receiving Office where the corresponding demand is
filed with the EPO on or after March 1, 2002, and where the application
contains one or more claims directed to the field of business methods.

   The search fee of the European Patent Office was increased, effective
January 1, 2011, and was announced in the Official Gazette at 1361 O.G.
180, on December 28, 2010.

Korean Intellectual Property Office as Searching and Examining Authority

   For use of the Korean Intellectual Property Office as an International
Searching Authority and International Preliminary Examining Authority for
international applications filed in the United States Receiving Office,
see the notice appearing in the Official Gazette at 1302 O.G. 1261 on
January 17, 2006.

   The search fee of the Korean Intellectual Property Office was increased,
effective January 1, 2011, and was announced in the Official Gazette at
1361 O.G. 180, on December 28, 2010.

Australian Patent Office as Searching and Examining Authority

   The Australian Patent Office (IP Australia) may act as the International
Searching Authority (ISA) for an international application filed with the
United States Receiving Office or the International Bureau (IB) as
Receiving Office where at least one of the applicants is either a national
or resident of the United States of America. However, IP Australia is not a
competent ISA, within the meaning of PCT Artical 16(3), for international
applications filed by U.S. residents or nationals in the USPTO or IB as a
Receiving Office, and where the application contains one or more claims

directed to the field of business methods or mechanical inventions.

   IP Australia may act as the International Preliminary Examining
Authority (IPEA) for an international application filed in the United
States Receiving Office or the International Bureau as Receiving Office
where at least one of the applicants is either a national or resident of
the United States of America, provided that IP Australia acted as the
International Searching Authority. However, IP Australia is not a competent
IPEA, within the meaning of PCT Article 32(3), for international
applications filed by U.S. residents or nationals in the USPTO or IB as a
Receiving Office where the corresponding demand is filed with IP Australia
and where the application contains one or more claims directed to the
fields of business methods or mechanical engineering or analogous fields of
technology as defined by specified areas of the International Patent
Classification System, as indicated in Annex A to the agreement between the
USPTO and IP Australia. See the notice appearing in the Official Gazette
at 1337 O.G. 261 on December 23, 2008.

   For use of IP Australia as an International Searching Authority and
International Preliminary Examining Authority for international
applications filed in the United States Receiving Office, see the notice
appearing in the Official Gazette at 1337 O.G. 265 on December 23, 2008.

   The search fee of IP Australia was increased, effective January 1, 2011,
and was announced in the Official Gazette at 1361 O.G. 180, on December 28,
2010.

Fees

   The transmittal fee and search fees for the USPTO were changed,
effective January 12, 2009, and were announced in the Federal Register on
November 12, 2008. The fee for filing a request for the restoration of the
right of priority was established, effective November 9, 2007, and was
announced in the Federal Register on September 10, 2007.

   International filing fees were increased, effective November 1, 2010, and
were announced in the Official Gazette at 1360 O.G. 5, on November 2, 2010.

   The schedule of PCT fees (in U.S. dollars), as of January 1, 2011, is

                  Notice of Maintenance Fees Payable

   Title 37 Code of Federal Regulations (CFR), Section 1.362(d) provides
that maintenance fees may be paid without surcharge for the six-month
period beginning 3, 7, and 11 years after the date of issue of patents
based on applications filed on or after Dec. 12, 1980. An additional
six-month grace period is provided by 35 U.S.C. 41(b) and 37 CFR 1.362(e)
for payment of the maintenance fee with the surcharge set forth in 37 CFR
1.20(h), as amended effective Dec. 16, 1991. If the maintenance fee is
not paid in the patent requiring such payment the patent will expire on
the 4th, 8th, or 12th anniversary of the grant.

   Attention is drawn to the patents that were issued on April 8, 2008
for which maintenance fees due at 3 years and six months may now be paid

   Patent owners must establish small entity status according to 37 CFR
1.27 if they have not done so and if they wish to pay the small entity
amount.

months, 7 years and six months, and 11 years and six months are set forth
in the most recently amended provisions in 37 CFR 1.20(e)-(g). To obtain

   35 U.S.C. 41 and 37 CFR 1.362(g) provide that if the required
maintenance fee and any applicable surcharge are not paid in a patent
requiring such payment, the patent will expire at the end of the 4th, 8th
or 12th anniversary of the grant of the patent depending on the first
maintenance fee which was not paid.

   Bambi F. Walters of Williamsburg, Virginia, a registered patent attorney
(Registration Number 45,197). The United States Patent and Trademark Office
("USPTO") has publicly reprimanded Ms. Walters for violating 37 C.F.R.
§§ 10.23(b)(5) and 10.23(b)(6) because she was: (1) publicly reprimanded by
the North Carolina State Bar for the unauthorized practice of law in
Virginia; and (2) prohibited by the Superior Court Division of the North
Carolina General Court of Justice from appearing in North Carolina state

SUMMARY: The United States Patent and Trademark Office ("USPTO" or "Office")
is preparing a preliminary plan to review its existing significant regulations
in response to the President's Executive Order 13563 on Improving Regulation
and Regulatory Review. The purpose of this regulatory review is to determine
whether any of these regulations should be modified, streamlined, expanded,
or repealed in order to make the Office's regulatory program more effective
and less burdensome. More effective and less burdensome regulations will help
the Office in its mission to foster innovation and competitiveness through
providing high quality and timely examination of patent and trademark
applications, guiding domestic and international intellectual property
policy, and delivering intellectual property information and education
worldwide. The Office is asking the public to provide ideas and information
about preparing such a review plan and to help the Office identify which
regulations should be reviewed.

SUPPLEMENTARY INFORMATION:

   On January 18, 2011, President Obama issued Executive Order 13563,
Improving Regulation and Regulatory Review. In the Executive Order, the
President stated:

         Our regulatory system must protect public health, welfare,
         safety, and our environment while promoting economic growth,
         innovation, competitiveness, and job creation. It must be

         based on the best available science. It must allow for
         public participation and an open exchange of ideas. It must
         promote predictability and reduce uncertainty. It must
         identify and use the best, most innovative, and least
         burdensome tools for achieving regulatory ends. It must take
         into account benefits and costs, both quantitative and
         qualitative. It must ensure that regulations are accessible,
         consistent, written in plain language, and easy to understand.
         It must measure, and seek to improve, the actual results of
         regulatory requirements.

E.O. 13563, 76 FR 3281, at Section 1(a). The Executive Order directed
agencies to develop and submit, within 120 days, preliminary plans for
reviewing their existing "significant regulations" (as that term is defined
in Executive Order 12866) and determining whether and how such regulations
could be made more effective and less burdensome. The Executive Order also
directed agencies to provide the public with an opportunity to participate
in the regulatory process and to provide comments on the development of such
a plan, and further directed that timely on-line access to the rule making
docket be provided so that the public had the opportunity to comment on all
pertinent parts of the rule making docket.

   As the Office begins work on a preliminary plan for reviewing its existing
significant regulations, it is requesting that the public participate in that
process. The Office is asking the public to provide comments on how such a
plan should be developed, what such a plan should include, which significant
regulations should be reviewed, and how those regulations might be improved.
The Office recognizes that the intellectual property community and the public
in general will have useful information and opinions about how USPTO
regulations can be reviewed and improved in order to best achieve its mission
of promoting innovation and competition. This request for comments will help
the Office gather information that will inform its decisions about developing
a plan for reviewing the Office's existing significant regulations.

   The Office welcomes any comments that you think might be helpful in
developing a plan for reviewing significant USPTO regulations. Some
questions that may be helpful to consider in preparing such comments include:

   1.  What is the best way for the Office to identify which of its
       significant regulations should be modified, streamlined, expanded,
       or repealed? What process should the Office use to select rules
       for review and how should it prioritize such review?

   2.  What can the Office, relative to its regulation process, do to reduce
       burdens and maintain flexibility for the public while promoting its
       missions?

   3.  How can the Office ensure that its significant regulations promote
       innovation and competition in the most effective and least burdensome
       way? How can these Office regulations be improved to accomplish this?

   4.  Are there USPTO regulations that conflict with, or are duplicative of,
       regulations from other agencies?  If so, please identify any such
       rules and provide any suggestions you might have for how this conflict
       or duplication can be resolved in order to help the Office achieve its
       mission more effectively.

   5.  How can the Office best encourage public participation in its rule
       making process? How can the Office best provide a forum for the open
       exchange of ideas among the Office, the intellectual property
       community, and the public in general?

   These questions are not intended to be an exhaustive list of topics for
public comment. While the Office welcomes and values all comments from the
public in response to this request, these comments do not bind the Office to
any further actions related to the comments, and the Office may not respond

   The United States Patent and Trademark Office (USPTO) considers the
effects of the earthquake and resulting tsunami in Japan on March 11, 2011,
to be an "extraordinary situation" within the meaning of 37 CFR 1.183 and
37 CFR 2.146 for affected patent and trademark applicants, patentees,
reexamination parties, and trademark owners. Since this catastrophic event
occurred outside the United States and did not result in a postal service
interruption in the United States Postal Service, the USPTO has no authority
to designate a postal service emergency as authorized by 35 U.S.C. 21(a).

   For patent applications and reexamination proceedings pending in the USPTO
as of March 11, 2011, having one or more inventors, an assignee, or a
correspondence address in areas of Japan affected by the earthquake and
tsunami, in which a reply or response to an Office action (final, non-final,
or other), a notice of allowance, or other Office notice (hereinafter
collectively referred to as "Office communication") is outstanding, and for
which the statutory or non-statutory time period set for response has not yet
expired, the USPTO will, on applicant's request, or a reexamination party's
request, withdraw the Office communication and reissue it. The request must

   For patentees who were unable to timely pay a patent maintenance fee due
to the effects of the earthquake and resulting tsunami on March 11, 2011, the
USPTO will waive the surcharge in 37 CFR 1.20(h) for paying a maintenance fee
during the six-month grace period following the window to pay the maintenance
fee and the surcharge in 37 CFR 1.20(i) for accepting a delayed maintenance
fee payment when the patentee files the maintenance fee payment with a
petition to accept a delayed maintenance fee under 37 CFR 1.378(c). See 37

   Patentees who seek to pay a maintenance fee during the six-month grace
period following the window to pay the maintenance fee with a request to
waive the surcharge in 37 CFR 1.20(h), must mail the payment and request to:

Fee, 2051 Jamieson Avenue, Suite 300, Alexandria, VA 22314; or via facsimile

   The request must be made by using form PTO/SB/425 (when available) or by

copy of this notice with the payment of the maintenance fee during the grace
period will be treated as a representation that the late payment of the fee

This waiver may only be appropriately requested where the original window of
time to pay the maintenance fee without the surcharge required by 37 CFR

Delayed Payment of Maintenance Fee in an Expired Patent (37 CFR 1.378(c))
accompanied by the applicable maintenance fee payment (but not the surcharge
under 37 CFR 1.20(i)) and either a copy of this notice or form PTO/SB/425.
The inclusion of a copy of this notice will be treated as a representation
that the delay in payment of the maintenance fee was due to the effects of
the earthquake and resulting tsunami of March 11, 2011, and as a request for
sua sponte waiver of the surcharge under 37 CFR 1.20(i). The petition must
filed by March 11, 2012, in order to be entitled to a waiver of the surcharge
under 37 CFR 1.20(i).

   Patentees are reminded that a petition to accept a delayed maintenance fee
payment under 37 CFR 1.378(c) must be filed within twenty-four months from
the expiration date of the patent. See 35 U.S.C 41(c). A petition to accept a
delayed maintenance fee payment filed later than twenty-four months after the
expiration date of the patent must be filed under 37 CFR 1.378(b) and include
a showing that the delay in payment was unavoidable. A petition to accept a

surcharge set forth in 37 CFR 1.16(f) for the late filing of the oath or
declaration or basic filing fee, search fee, and/or examination fee. Patent

petition fee (set by regulation, rather than statute) to revive the abandoned

The Electronic Official Gazette of the U.S. Patent and Trademark Office - Patents (eOG:P) provides the information in electronic format on CD-ROM. The eOG:P is published every Tuesday and includes bibliographic information, a representative claim, and a drawing (if applicable) of each patent issued that week. Patents are accessible by type of patent (utility, plant, etc.), classification (class or class/subclass), patentee name, and geographical location. Links enable users to "jump" to a specific patent from these various indexes. The eOG:P is sold as an annual subscription or as single copies.

Subscriptions are $430.00 per year, with single copies available for $20.00. For single copy purchases, please specify date and volume/issue number. Order forms are available in MS Word® or Adobe® Acrobat® format.
