Patent Cooperation Treaty (PCT) Information For information concerning PCT member countries, see the notice appearing in the Official Gazette at 1350 O.G. 73, on January 12, 2010. For information on subject matter under Rule 39 that a particular International Searching Authority will not search, see Annex D of the PCT Applicants' Guide. European Patent Office as Searching and Examining Authority The European Patent Office (EPO) may act as the International Searching Authority (ISA) for an international application filed with the United States Receiving Office or the International Bureau (IB) as Receiving Office where at least one of the applicants is either a national or resident of the United States of America. However, the EPO is no longer a competent ISA, within the meaning of PCT Article 16(3), for international applications filed by U.S. residents or nationals on or after March 1, 2002, in the USPTO or IB as a Receiving Office, and where the application contains one or more claims directed to the field of business methods. For the definition of what the EPO considers to be precluded subject matter in the field of business methods, applicants should see the "Notice from the President of the European Patent Office", dated November 26, 2001, and which was published as Annex A in the "Notice Concerning EPO Competence to Act as PCT Authority" in the Official Gazette at 1255 O.G. 878, on February 19, 2002. The European Patent Office may act as the International Preliminary Examining Authority (IPEA) for an international application filed in the United States Receiving Office or the International Bureau as Receiving Office where at least one of the applicants is either a national or resident of the United States of America, provided that the European Patent Office acted as the International Searching Authority. However, the EPO is no longer a competent IPEA, within the meaning of PCT Article 32(3), for international applications filed by U.S. residents or nationals in the USPTO or IB as a Receiving Office where the corresponding demand is filed with the EPO on or after March 1, 2002, and where the application contains one or more claims directed to the field of business methods. The search fee of the European Patent Office was decreased, effective April 1, 2010, and was announced in the Official Gazette at 1354 O.G. 2, on May 4, 2010. Korean Intellectual Property Office as Searching and Examining Authority For use of the Korean Intellectual Property Office as an International Searching Authority and International Preliminary Examining Authority for international applications filed in the United States Receiving Office, see the notice appearing in the Official Gazette at 1302 O.G. 1261 on January 17, 2006. The search fee of the Korean Intellectual Property Office was increased, effective January 1, 2010, and was announced in the Official Gazette at 1350 O.G. 72, on January 12, 2010. Fees The transmittal fee and search fees for the USPTO were changed, effective January 12, 2009, and were announced in the Federal Register on November 12, 2008. The fee for filing a request for the restoration of the right of priority was established, effective November 9, 2007, and was announced in the Federal Register on September 10, 2007. International filing fees were increased, effective January 1, 2010, and were announced in the Official Gazette at 1350 O.G. 72, on January 12, 2010. Notice of Maintenance Fees Payable Title 37 Code of Federal Regulations (CFR), Section 1.362(d) provides that maintenance fees may be paid without surcharge for the six-month period beginning 3, 7, and 11 years after the date of issue of patents based on applications filed on or after Dec. 12, 1980. An additional six-month grace period is provided by 35 U.S.C. 41(b) and 37 CFR 1.362(e) for payment of the maintenance fee with the surcharge set forth in 37 CFR 1.20(h), as amended effective Dec. 16, 1991. If the maintenance fee is not paid in the patent requiring such payment the patent will expire on the 4th, 8th, or 12th anniversary of the grant. Attention is drawn to the patents that were issued on Aug. 14, 2007 for which maintenance fees due at 3 years and six months may now be paid. Conducting an Interview with a Registered Practitioner Acting in a Representative Capacity This notice changes the procedure for registered practitioners, when acting in a representative capacity, to show authorization for the interview by signing and filing an Applicant Initiated Interview Request Form (PTOL-413A), thereby eliminating the requirement that a power of attorney or authorization to act in a representative capacity be filed in the subject application in order to conduct the interview. Under the current procedure for conducting a personal or telephonic interview, an interview request form (PTOL-413A) should be submitted by the person intending to conduct the interview (MPEP 713.04). Interviews had not generally been granted persons who lack proper authority from the principal (37 CFR 1.32(a)(3)) or the attorney or agent of record in the form of a paper on file in the application, such as a power of attorney or an authorization to act in a representative capacity (Form PTO/SB/84) (MPEP 713.05). However, as the interview request form provides for the practitioner to set forth his or her name, signature and registration number, the Office will accept this as an indication that he or she is authorized to conduct an interview on behalf of the principal, which is consistent with the provisions of 37 CFR 1.34. An interview concerning an application that has not been published under 35 U.S.C. § 122(b) with an attorney or agent not of record who obtains authorization through use of the interview request form will be conducted based on the information and files supplied by the attorney or agent in view of the confidentiality requirements of 35 U.S.C. § 122(a) (MPEP 405). Practitioners are reminded that they cannot authorize other registered practitioners to conduct interviews without the consent of the principal after full disclosure, in accordance with 37 CFR 10.57(c). Nothing in this notice authorizes a third party or its representative to conduct an interview, or take other action not specifically permitted by the rules of practice (e.g., 37 CFR 1.99, 1.291, and 1.292) in an application for patent. The use of the provisions of 37 CFR 1.34 by a third party or its representative to conduct an interview, or take other action not specifically permitted by the rules of practice in an application for patent, will be considered a violation of 37 CFR 11.18 and may result in disciplinary action if done by a practitioner. Notice of Reprimand Steven Horowitz of New York, New York, registered patent attorney (Registration Number 31,768). Mr. Horowitz has been publicly reprimanded by the United States Patent and Trademark Office ("USPTO" or "Office") for violating 37 C.F.R. § 10.112(a) by depositing, at times, unearned fees for patent legal services into his business/operating account; 37 C.F.R. § 10.112(c)(3) by not keeping sufficiently formal accounting records for the deposits into and disbursement from his business/operating account; and 37 C.F.R. § 10.23(b)(6) by submitting checks to the USPTO that were returned for insufficient funds. Mr. Horowitz signed and submitted to the Office eight (8) checks drawn on his business/operating account that were returned for insufficient funds. The returned checks totaled Three Thousand, Five Hundred and Sixty-Nine Dollars ($3,569.00). He made good on all the checks, and the clients involved do not appear to have been harmed. Mr. Horowitz represents that a family illness, in part, adversely affected his management of his law office. Since this matter has been brought to his attention by the Office of Enrollment and Discipline, he has taken the following remedial action: he has consulted with another licensed attorney and has become thoroughly versed in the rules of ethics regarding financial recordkeeping and the segregation of client funds; the financial institution where he opened and maintains a trust account has agreed to provide a report to the New York State Lawyer's Fund for Client Protection whenever a check from Mr. Horowitz's trust account is returned for insufficient funds, see generally 22 N.Y.C.R.R. § 1300.1 (and the financial institution's report that a check has been returned for insufficient funds will typically trigger an audit of his trust account by the Bar of the State of New York); he established and maintains both a ledger book with separate pages for each client and an electronic accounting system for client funds; he employs a part-time bookkeeper and retained the services of a law practice management consultant, which he continues to consult on as needed basis. The following mitigating factors were taken into consideration: (a) Mr. Horowitz has been a registered patent practitioner for over 25 years and has no prior disciplinary history; (b) Mr. Horowitz unequivocally accepted responsibility for his mistakes and is deeply remorseful; and (c) Mr. Horowitz's current means of handling client funds exceeds USPTO ethical requirements. Those mitigating factors are reflected in the agreed-upon discipline imposed in this case. This action is the result of a settlement agreement between Mr. Horowitz and the OED Director pursuant to the provisions of 35 U.S.C. § 2(b)(2)(D) and 37 C.F.R. §§ 11.26 and 11.59. Notice of Suspension Jeffrey K. Seto of Salem, Virginia registered patent agent (Registration No. 43,419). Mr. Seto has been suspended for sixty (60) months by the United States Patent and Trademark Office ("USPTO" or "Office") for violating 37 C.F.R. §§ 10.23(a) (engaging in disreputable or gross misconduct), 10.23(b)(4) (engaging in conduct involving dishonesty, fraud, deceit, or misrepresentation), 10.23(b)(5) (engaging in conduct that is prejudicial to the ex parte patent prosecution process before the Office), 10.23(b)(6) (engaging in conduct that adversely reflects on the practitioner's fitness to practice before the Office), 10.40 (failing to withdraw and/or withdraw in a timely manner from representing client), and 10.77(c) (neglecting matters entrusted to a practitioner). Under the terms of the settlement agreement, Mr. Seto is eligible to request reinstatement after serving forty-eight (48) months of his 60-month suspension subject to certain conditions and, if reinstated, Mr. Seto will be permitted to practice before the Office unless the stay of any remaining portion of his suspension is subsequently lifted. In June 2008, the USPTO re-hired Mr. Seto as a patent examiner. Mr. Seto, however, did not withdraw from representing numerous clients who had matters pending before the Office and, instead, continued to represent some of his former clients before the Office in the prosecution of patent and trademark application while employed by the Office. Hence, Mr. Seto violated 37 C.F.R. §§ 10.23(a), 10.23(b)(5) and 10.23(b)(6) by (i) prosecuting patent applications and aiding another practitioner in the prosecution of patent and trademark applications before the Office while employed by the Office and (ii) practicing trademark law in the Commonwealth of Virginia while not a licensed attorney. He also violated 37 C.F.R. §§ 10.40 by failing to withdraw and/or failing to withdraw in a timely manner from representing clients before the Office upon being re-hired by the USPTO as patent examiner and 10.23(b)(4) by misrepresenting to the USPTO that he had submitted a request to withdraw, or was in the process of submitting a request to withdraw, in pending matters. Mr. Seto also violated 37 C.F.R. §§ 10.23(b)(4) and 10.23(b)(6) by submitting four checks totaling one thousand, one hundred and eighty dollars ($1,180.00) to the USPTO that were returned for being drawn on insufficient funds and 37 C.F.R. § 10.77(c) by not timely informing clients of Office communications and allowing patent applications to become abandoned. This action is taken pursuant to a settlement agreement between Mr. Seto and the USPTO pursuant to the provisions of 35 U.S.C. §§ 2(b)(2)(D) and 32, and 37 C.F.R. §§ 11.26 and 11.59. The practice for requiring an applicant to restrict an application to one invention in such situations is known as restriction practice. The Office is considering changes to restriction practice to improve the quality and consistency of restriction requirements made by Office personnel. Chapter 800 of the Manual of Patent Examining Procedure (MPEP) sets forth the Office's practices for reviewing applications for restriction purposes. The Office is considering revising restriction practice to improve the quality and consistency of restriction requirements. The Office is seeking suggestions from the public regarding possible changes to restriction practice because this is a significant area of concern for the Office, applicants, and the public. Thus, the Office is soliciting comments from the public concerning several aspects of restriction practice. First, the Office is asking for comments on what should be included in an Office action that sets forth a restriction requirement. Second, because unwarranted restriction requirements can result in delays in prosecution, expenditure of excess claim fees, and/or the need to file multiple divisional applications, the Office is inviting suggestions from the public as to how to improve the process for traversing or requesting reconsideration of a restriction requirement to achieve more consistent, accurate, timely, and cost-effective review. requirements between related product inventions or related process inventions have been problematic, and thus is inviting public comments on the changes under consideration to clarify what is necessary in order to restrict between such inventions. Fourth, the Office is also considering some changes with regard to restrictions involving claims with Markush groupings, and invites public comment on these changes as well as any other suggestions regarding the treatment of Markush claims. Fifth, the Office is considering changes to rejoinder practice in an effort to simplify what claimed inventions would be eligible for rejoinder upon the determination that all elected claims are allowable, and invites public comments on these changes. Finally, the Office invites comments specifically pointing out other areas in which restriction practice could be improved. The Office has previously recognized the need to consider changes to restriction practice. Pursuant to the Office's 21st Century Strategic Plan, the Office sought public comment on a number of issues to help guide the scope and content of a study of changes that would be needed to implement a Patent Cooperation Treaty (PCT) style "Unity of Invention" standard in the United States. See Notice of Availability of and Request for Comments on Green Paper Concerning Restriction Practice, 70 FR 32761 (June 6, 2005). The public comments suggested broadening the scope of the study beyond just a PCT-style Unity of Invention standard in an effort to determine the best practice for restriction. Based on the public comments, the Office identified four options for modifying restriction practice. The Office studied the ease of implementation and workload/pendency impacts of these four options in an effort to achieve an appropriate balance between the priorities of the USPTO user community and limited USPTO resources. However, after reviewing the business case analyses, the Office determined that none of the options would satisfactorily achieve the desired balance. Thereafter, as part of its ongoing efforts to enhance patent quality and reduce pendency in accordance with the 21st Century Strategic Plan, the Office published a notice proposing to change certain rules of practice pertaining to claims that use Markush or other alternative language and requested public comment on the proposed changes to the rules of practice. See Examination of Patent Applications That Include Claims Containing Alternative Language, 72 FR 44992 (Aug. 10, 2007), 1322 Off. Gaz. Pat. Office 22 (Sept. 4, 2007). The Office is not issuing a final rule based upon the changes proposed in that previous rule making notice. The Office is instead publishing this notice to seek input from the public concerning restriction practice. As discussed previously, the Office is considering changes to Office practice and policy with regard to restriction requirements. The Office is requesting public input on restriction practice. The Office is not presently proposing any changes to the rules pertaining to restriction practice, and this notice is not a notice of proposed rule making. 1. What should be included in an Office action that sets forth a restriction requirement? The MPEP currently explains that two criteria must be met to require restriction between patentably distinct inventions, i.e., the inventions must be independent or distinct as claimed, and there must be a serious burden on the examiner if restriction is not required. See MPEP § 803. The Office is considering clarifying the MPEP to indicate that a restriction requirement (including an election of species requirement) must always set forth the reasons why the inventions are independent or distinct and why there would be a serious burden in the absence of a restriction requirement. The Office is considering changes to the burden requirement, an area fundamental to restriction practice. The rationales set forth in the current MPEP to support the burden prong are based on the prior art search (i.e., the inventions have acquired a separate status in the art in view of their different classification; the inventions have acquired a separate status in the art due to their recognized divergent subject matter; and the inventions require a different field of search (for

example, searching different classes/subclasses or electronic resources, or employing different search queries)). See MPEP § 808.02. The Office is considering whether to revise the MPEP to indicate that there would be a serious burden if restriction is not required when the prior art applicable to one invention would not likely be applicable to another invention (e.g., because of a different field of art or different effective filing date). The Office is also considering whether to revise the MPEP to specify that "a serious burden on the examiner" encompasses search burden and/or examination burden. Typically, the burden prong has been viewed as referring to the burden imposed by searching for patentably distinct inventions. However, the determination of whether a claimed invention is allowable requires both a search of the prior art and an examination of the application to determine whether the claimed invention meets the statutory requirements for patentability. The burden imposed by the examination of patentably distinct inventions is, in many cases, as serious as the burden imposed by searching for such inventions. Therefore, the Office is considering explaining that in addition to the rationales currently set forth in the MPEP, a serious burden in support of a restriction requirement may be based on the rationale that the inventions are likely to raise different non-prior art issues under 35 U.S.C. 101 and/or 35 U.S.C. 112, first paragraph. In this situation, a serious search burden and/or examination burden may exist where issues relevant to one invention are not relevant to the other invention. The MPEP currently provides for election of species practice when an application includes a generic claim along with separate claims to different species that fall within the scope of that generic claim and that may be patentably distinct. See MPEP § 806.04. The Office is considering revising the MPEP to indicate that in setting forth the species from which an applicant is required to elect, the examiner should group together species that are not patentably distinct from each other, the examiner should require election of either a single species or a single grouping of patentably indistinct species, and the applicant should not be required to elect a specific species within a grouping of patentably indistinct species. 2. What practice changes would result in more effective ways to seek higher level review of restriction requirements? In various forums, members of the public have expressed overall dissatisfaction with the effectiveness of traversing or requesting reconsideration of requirements for restriction. Unwarranted restriction requirements can result in delays in prosecution, expenditure of excess claim fees, and/or the need to file multiple divisional applications to avoid dedication of unclaimed subject matter to the public. The Office invites suggestions from the public as to how to improve the traversal or request for reconsideration process within the framework of the current rules (see 37 CFR 1.143 and 1.144) to achieve more consistent, accurate, timely, and cost-effective review. 3. How could the Office clarify requirements for restriction between related product inventions or related process inventions where the relationship is not specifically provided for in MPEP Chapter 800? The Office is considering providing for a new section in the MPEP to address restriction between related product inventions or related process inventions not otherwise provided for in MPEP §§ 806 through 806.05(j). See, e.g., MPEP § 806.04 et seq. for restricting between inventions in a genus/species relationship; MPEP § 806.05(c) for an explanation of the requirements to restrict between inventions in a combination/subcombination relationship; MPEP § 806.05(d) for restricting between subcombinations disclosed as usable together; and MPEP § 806.05(j) for restricting between an intermediate and a final product. Specifically, the Office is considering explaining that to support a requirement for restriction between two or more related product inventions, or between two or more related process inventions, that are not otherwise provided for in MPEP §§ 806 through 806.05(j), there must be two-way distinctness (see MPEP § 802.01) and a serious burden if restriction were not required. The Office is considering explaining that for such related product inventions or such

related process inventions, the inventions are distinct if: (1) The inventions as claimed have mutually exclusive characteristics (see MPEP §§ 806 through 806.05(f)); (2) the inventions as claimed are not obvious variants over each other; and (3) each invention as claimed can be made by, or used in, a materially different process or product. In an effort to reduce the number of improper requirements for restriction between related product inventions or related process inventions, the Office is considering explaining that where claims of an application define the same essential characteristics of a single invention, e.g., the claims vary from each other only in breadth or scope (ranging from broad to detailed), the examiner should not require restriction between such claims. 4. How could the Office modify Markush practice? The Office is considering whether to revise Markush practice in three particular ways. First, if the examiner determines that the elected species is allowable, the Office is considering specifying that the examination of the Markush-type claim will be extended to the extent necessary to determine the patentability of the claim, i.e., to determine whether any nonelected species is unpatentable for any reason (35 U.S.C. 101, 102, 103, or 112, or nonstatutory double patenting). If a nonelected species is determined to be unpatentable, the Markush-type claim would be rejected, and the search and examination would not be extended to cover all nonelected species. Next, the Office is considering revising the treatment of amended Markush-type claims to clarify that whether an Office action may be made final is determined by whether the conditions in MPEP § 706.07 for making a second or subsequent Office action final are met and is not dependent upon whether the examiner previously required a provisional election of species. Lastly, the Office is considering situations where restriction may be proper between a subcombination and a combination when a subcombination sets forth a Markush grouping of alternatives. In particular, the Office is referring to a subcombination that (1) encompasses two or more subcombination embodiments within its scope, and (2) lists those embodiments using Markush-type claim language, i.e., lists the embodiments as a group of alternatives from which a subcombination embodiment is selected. For example, the Office is considering whether restriction would be proper between a subcombination claim to an individual DNA molecule selected from a list of alternative embodiments and a combination claim to an array comprising a plurality of DNA molecules wherein one or more of the DNA molecules are selected from the list of alternative embodiments set forth in the subcombination claim. In such a situation, the combination claim does not require all the elements of any particular claimed subcombination to be present in the claimed array. Apart from these specific considerations, the Office invites suggestions from the public regarding changes to the practice of requiring election/restriction of Markush claims in a manner that balances the interests of the Office and those of the public in the context of the current statutory and regulatory framework. 5. How could the Office improve rejoinder practice? The Office is considering changes to rejoinder practice as part of an effort to institute more uniform treatment of claims directed to nonelected subject matter upon the determination that all claims to the elected invention are allowable. The Office is considering whether to define "rejoinder" as the practice of withdrawing a restriction requirement as between some or all groupings of claims and reinstating certain claims previously withdrawn from consideration that occurs when the following conditions are met: (1) All claims to the elected invention are allowable; and (2) it is readily apparent that all claims to one or more nonelected inventions are allowable for the same reasons that the elected claims are allowable. Claims that meet the second condition for rejoinder may include, for example, those that (1) properly depend from an allowable elected claim; (2) include all of the limitations of an allowable elected claim; or (3) require no further search and/or examination. Claims that may not be eligible for rejoinder would

include, for example, those that require additional consideration of the prior art or raise utility, enablement, or written description issues not considered during examination of the allowable elected claims. Separately, the Office is also considering instructing examiners that when all claims directed to an elected invention are allowable, nonelected claims must be considered for rejoinder and withdrawal of the restriction requirement. In making this decision, examiners must reevaluate both aspects of the restriction requirement, i.e., whether the nonelected invention(s) as now claimed are independent or distinct from the claim(s) to the allowable elected invention and whether there would be a serious burden if the nonelected inventions were rejoined. 6. What other areas of restriction practice can the Office improve and how? While the Office has set forth particular restriction practice issues for which comments are specifically being requested, the Office is in this request for comments inviting comments on any area in which restriction practice could be improved. SUMMARY: The United States Patent and Trademark Office (USPTO) is clarifying its treatment of letters submitted by applicants and patentees stating that the USPTO's patent term adjustment determination indicated on a notice of allowance, issue notification, or patent, is greater than what the applicant or patentee believes is appropriate. The USPTO will place these letters in the file of the application or patent without further review. The USPTO will no longer review these letters or issue certificates of correction on the basis of a review of these letters. If the applicant or patentee wants the USPTO to reconsider its patent term adjustment determination, the applicant or patentee must use the procedures set forth in 37 CFR 1.705 for requesting reconsideration of a patent term adjustment determination. A patentee may also file a terminal disclaimer disclaiming any period considered in excess of the appropriate patent term adjustment. However, the USPTO does not require an applicant or patentee to file either a request for reconsideration under 37 CFR 1.705 or a terminal disclaimer when the patent term adjustment indicated on a notice of allowance, issue notification, or patent is greater than what the applicant or patentee believes is appropriate. SUPPLEMENTARY INFORMATION: The Manual of Patent Examining Procedure (MPEP) was revised in 2004 to indicate that if a notice of allowance indicates a patent term adjustment that is longer than expected, the applicant may wait until the patent issues, and if the patent issues with a value that is incorrect, request a certificate of correction. See MPEP § 2733. The MPEP does not specify what action the USPTO will take in response to such a request for a certificate of correction. The USPTO is, in this notice, clarifying when the USPTO will change the patent term adjustment determination indicated on a patent via a certificate of correction under either 35 U.S.C. 254 or 255. The USPTO, however, has determined that it is not appropriate to provide a patent term adjustment recalculation via a certificate of correction under 35 U.S.C. 254 or 255. A certificate of correction is permissible under 35 U.S.C. 254 only for a mistake in a patent that "is clearly disclosed by the records of the Office." See 35 U.S.C. 254. While the applicable patent term adjustment is ascertainable from the records of the USPTO, a revised patent term adjustment determination requires a complex calculation and is not "clearly disclosed" by the records of the USPTO. In addition, a certificate of correction is permissible under 35 U.S.C. 255 only for "a mistake of a clerical or typographical nature, or of minor character." See 35 U.S.C. 255. Thus, the USPTO has long maintained that a request for a certificate of correction under either 35 U.S.C. 254 or 255 is not an appropriate venue

for seeking a change to the patent term adjustment indicated on a patent. See Revision of Patent Term Extension and Patent Term Adjustment Provisions, 69 FR 21704, 21707 (Apr. 22, 2004) (final rule) ("Petitions under [37 CFR] 1.182 or 1.183, or requests for a certificate of correct under either 35 U.S.C. 254 and [37 CFR] 1.323 or 35 U.S.C. 255 and [37 CFR] 1.324, are not substitute fora to obtain reconsideration of a patent term adjustment determination indicated in a notice of allowance if an applicant fails to submit a request for reconsideration within the time period specified in [37 CFR] 1.705(b), or to obtain reconsideration of a patent term adjustment determination indicated in a patent if a patentee fails to submit a request for reconsideration within the time period specified in [37 CFR] 1.705(d)"). The patent term adjustment provisions of 35 U.S.C. 154(b) provide for the establishment of procedures for patent term adjustment determinations, including providing the applicant one opportunity to request reconsideration of any patent term adjustment determination. See 35 U.S.C. 154(b)(3). It would render the provisions of 35 U.S.C. 154(b)(3) superfluous if patent term adjustment determinations could be revised at any time during the life of the patent via a certificate of correction under 35 U.S.C. 254 or 255. In addition, the patent term adjustment provisions of 35 U.S.C. 154(b) are designed to have patent term adjustment issues to be resolved shortly after a patent issues by providing a period of one hundred and eighty days from the grant of the patent for seeking court review of the USPTO's patent term adjustment determination (rather than the six-year statute of limitations otherwise applicable for actions under the Administrative Procedures Act). See 35 U.S.C. 154(b)(4). It would negate the purpose of the one hundred and eighty day period in 35 U.S.C. 154(b)(4) to allow patent term adjustment determinations to be revised at any time during the life of the patent via a certificate of correction under 35 U.S.C. 254 or 255. Therefore, it is not appropriate to issue a certificate of correction under 35 U.S.C. 254 or 255 to revise the patent term adjustment indicated in a patent unless it is being revised for consistency with: (1) the patent term adjustment determined via a decision on a request for reconsideration under 37 CFR 1.705; or (2) the total patent term adjustment indicated on the Patent Application Information Retrieval (PAIR) screen that displays the patent term adjustment calculation for the patent. Accordingly, the USPTO is clarifying that it will treat letters submitted by applicants and patentees stating that the USPTO's patent term adjustment determination indicated on a notice of allowance, issue notification, or patent is greater than what the applicant or patentee believes is appropriate by placing these letters in the file of the application or patent without comment. The USPTO will no longer review these letters or issue certificates of correction under either 35 U.S.C. 254 or 255 on the basis of a review of these letters. In addition, the USPTO will not grant a request for a certificate of correction under either 35 U.S.C. 254 or 255 to revise the patent term adjustment indicated in a patent, except in the two situations discussed previously. If a patentee submits a request for a certificate of correction under either 35 U.S.C. 254 or 255 to revise the patent term adjustment indicated in a patent that includes changes in the patent for which a certificates of correction would be appropriate, the request for a certificate of correction will not be granted unless the patentee submits a new request for a certificate of correction that does not also attempt to revise the patent term adjustment indicated in the patent. If the applicant or patentee wants the USPTO to reconsider its patent term adjustment determination, the applicant or patentee must use the procedures set forth in 37 CFR 1.705 for requesting reconsideration of a patent term adjustment determination, whether the USPTO's patent term adjustment determination is greater than or less than the adjustment that the applicant or patentee believes to be appropriate. A patentee may also file a terminal disclaimer at any time disclaiming any period considered in excess of the appropriate patent term adjustment. See 35 U.S.C. 253 and 37 CFR 1.321. However, the USPTO does not require an applicant or patentee to file either a request for reconsideration under 37 CFR 1.705 or a terminal disclaimer when the patent term adjustment indicated on a notice of allowance, issue notification, or patent is greater than what the applicant or patentee believes is appropriate. Reference Collections of U.S. Patents and Trademarks Available for Public Use in Patent and Trademark Depository Libraries The following libraries, designated as Patent and Trademark Depository Libraries (PTDLs), provide public access to patent and trademark information received from the United States Patent and Trademark Office (USPTO). This information includes all issued patents, all registered trademarks, the Official Gazette of the U.S. Patent and Trademark Office, search tools such as the Cassis CD-ROM suite of products and supplemental information in a variety of formats including online, optical disc, microfilm and paper. Each PTDL also offers access to USPTO resources on the Internet and to PubWEST (Web based examiner search tool), a system used by patent examiners that is not available on the Internet. Staff assistance and training is provided in the use of this information. All information is available free of charge. However, there may be charges associated with the use of photocopying and related services. The Electronic Official Gazette of the U.S. Patent and Trademark Office - Patents (eOG:P) provides the information in electronic format on CD-ROM. The eOG:P is published every Tuesday and includes bibliographic information, a representative claim, and a drawing (if applicable) of each patent issued that week. Patents are accessible by type of patent (utility, plant, etc.), classification (class or class/subclass), patentee name, and geographical location. Links enable users to "jump" to a specific patent from these various indexes. The eOG:P is sold as an annual subscription or as single copies.
Subscriptions are $430.00 per year, with single copies available for $20.00. For single copy purchases, please specify date and volume/issue number. Order forms are available in MS Word® or Adobe® Acrobat® format.
