Dear Sir or Madam:

In response to the above referenced complaint, please be advised:

• The Complainers were given full written disclosure of services rendered both before and after the moneys for said services was received.
• The deliverables were completed in a timely manner.
• Complainers indemnified Synergy, in writing, for all services delivered.
• A disclaimer accompanied the prior art search, which stated, "?there are over one hundred and twenty five thousand classifications for the five million patents that have already been issued. In addition, there are over one hundred thousand new patents issued every year in the United States alone. A preliminary patent search does not uncover literature, publications, patent applications that have been abandoned, and inventions in the United States in which the patent applications are pending?"
• We have made numerous requests to Complainers to send us the prior art they are referring to. To date, that information has not been conveyed to us.
• We have complied with Complainers request to take their information off our Web Site.

The documentation to support these statements is available upon request as well as a detailed chronological history of our dealings with the Complainers. Based on the above, there is no justification by Complainers to receive any moneys for services they requested and we delivered.
