Invention Promoter's Name: New Product Advisory Group also NILOSI, Inc. Complainant's Name: Ms. Torri L. Plemmons & Ms. Kathryn Sink Response: Ms. Plemmons states that false and exaggerated claims were made. Simply untrue, have Ms. Plemmons forward her contracts to you, whereupon you will read, and she signed to the contrary. New Products ventures are expensive and highly risky. She knew it, acknowledged it and agreed with it. Ms. Plemmons is stating falsehoods throughout. NPAG did not promote products, they outsourced services from independent professionals to perform certain services that the client could have contracted for on her own. She contracted with NPAG for and received a professionally prepared 1) Disclosure document (filed on her behalf), 2) Marketing info pertaining to her product, 3) a patent search & opinion, completed by a Registered Patent Attorney (not in our employ), 4) a provisional patent application, prepared by a Registered Patent Attorney. 5) A manufacturers search/submission package (letters, envelopes, etc.) 6) Web site and web site marketing. And 7) An optional, independent negotiation agreement, (which was cancelled by Ms. Plemmons in January of 2002 via registered letter) Once these services were performed, (and they were performed quickly, efficiently, professionally and signed for) it was the Ms. Plemmons turn to attempt to find someone who thought as much of her product as she did. I have many emails from Ms. Plemmons declaring her happiness with the work, however, once it seemed that SHE was going to give up, then someone had to be to blame so that is NPAG. Ms. Plemmons, like so many, lasted a little while, but once discouragement set it, she was finished. Ms. Plemmons did find several people interested in the product, however I believe it was her that has chosen not to pursue it because of financial reasons. There are no guarantees in inventing and no guarantees were made. Does she have a good idea? Everyone I have polled thinks so. But that's not all it takes, it takes persistence and hard work. This is made reference to in her contract for services, which she acknowledges and clearly understood. Although NPAG does not market products they did forward drawings and a description of the product to the manufacturers whom they thought might have an interest and indeed were, but in a completed product, which Ms. Plemmons did not have. Once interest was attained Ms. Plemmons needed schematics and I referred her to a technologist who did a great deal of work and got stiffed by Ms. Plemmons. I did not contract with her concerning this and she wanted NPAG to pay the bill because a manufacture in Florida (that she contacted) didn't like the work. Ms. Plemmons refers to a Mr. Mercer as a partner. Mr. Mercer as at NPAG as an independent contractor and will fully support the fact that Ms. Plemmons is simply exagerrating her position because her attempt at the "American dream" has not failed, but she simply has given up. Ms. Plemmons clearly has put a falsehood in her last paragraph (as well as throughout) stating that she requested a name from me. Not only did she get that but called and spoke with the individual, except the answer wasn't to her liking. The other name I was to give her (she did not call back) recently had a major article done by the Raleigh N & O newspaper concerning her product and her plight to become successful. The biggest difference in this woman and Ms. Plemmons is that this woman has not given up (4 1/2 yrs) and believes in her idea. It is patented and her agent is currently negotiating with major manufacturers. Like many people, Ms. Plemmons has simply given up and cannot accept the fact that she failed because of 1) lack of persistency or 2) manufacturers did not think as well of her product as she did or 3) no money. Enclosed are emails from Ms. Plemmons well after ALL the services had been completed along with work from the technologist she hired. It is obvious proof that a great deal of work has been done for her, but she wasn't willing to do her part AND she wasn't unhappy. For the record NPAG & NILOSI, Inc. have been out of business and bankrupt as of February 1, 2002. I recommend that you do NOT post this on your website, simply because most of what Ms. Plemmons states is untrue. I don't believe any government agency should get involved in believing everyone that writes in and cries about something. The fact is here is that Ms. Plemmons can poll 1000 people about her idea and probably 995 (1000 if they own pets) will think it is a good idea. Now what? What to do? And 9 out of 10 professionals will tell her to do what I told her to do, she simply gave up and it's all my fault. Bunk! Sincerely, /s/ H. Randal Wilson |
