Dear Sir or Madam:

I am the President of Davison Design & Development, Inc. and write to respond to the complaint submitted by Mr. Guay.

Mr. Guay was a client of Davison in late 2003 and 2004. Mr. Guay approached Davison with an idea for a new product. He contracted for research services and received a report of the research conducted. Davison has never received a complaint from him about the sufficiency or timeliness of the research.

Mr. Guay also contracted for Davison to design and construct a product sample. The contract was for the design and construction of a single product sample. Nothing in the submission or any of the contracts indicated that Davison was going to construct multiple product samples of different designs for Mr. Guay.

The sample was designed and he was provided with a full color rendering of the design. Mr. Guay signed the rendering of the design to indicate his approval and to permit Davison to continue its work. He also returned a feedback form giving Davison high marks for its work on his project. A copy of the design rendering and feedback form bearing his signature is enclosed. The image of the actual product design and the name of the product have been obscured to protect the confidentiality of the design, as required by contract.

His complaint that Davison could not find more than two companies to consider his product idea is simply false. With Mr. Guay's permission, the product sample was presented to two potential licensees. Mr. Guay singed a document authorizing the shipment and presentation.

A copy of the singed document is enclosed. After both of these companies declined to license the product, Davison offered to present the product sample to another company. Mr. Guay refused to permit Davison to move forward with another presentation.

Davison has fully complied with all contractual obligations and has performed its obligations with the complete approval of Mr. Guay. His complaint appears to be based upon the fact that his product idea was not licensed, which is completely outside of Davison's control.

Mr. Guay also requested in his complaint that Davison return the prototype that he sent to Davison. The complaint letter is his first and only request for the return of the prototype and it will be promptly returned.

In 2003-2004, Davison helped 39 clients license their product ideas. Yet, because of the provisions of law establishing this forum, an individual can attempt to defame a company despite being given explicit, plain-language disclosures and contracts and approving of the work done by Davison. This complaint is yet another example of the abusive and oppressive nature of the regulations that permit the publication of consumer complaints in this forum. Once again, the regulations concerning this forum do injury to the exchange of truthful information concerning invention development.
