Trademark Daily XML Files - Weekly Status Report
The following is a status update for all inquiries.

*The format of the Weekly Status Report will appear as follows:
1. Each inquiry is given a USPTO Control # for tracking purposes.
2. The summary portion of “Status of Inquiries” will be “grouped” by the current status.
3. The detail portion of the report will be in sequence Control # (for easier reference).~~~
Any inquiries that require additional research and/or response are considered outstanding inquiries and will appear in red, bold and italicized.

Requirements and Proposed Schedule for the updated Trademark Daily Applications product – Control #61
Requirements:
Proposed Schedule:
- September 1, 2004 – The updated Daily Application DTD and Documentation to be released. Test files will be made available during the month of September 2004.
- October 8, 2004 – Proposed parallel process to include the updated Daily Application product along with the current production product to take place October 8, 2004 through December 31, 2004.
12/03/2004:
It has been noted that the data content has been cleaned up Significantly in the updated/new Applications “C” files. Inquires continue to arrive. These inquiries will continue to be thoroughly addressed throughout the parallel process.
NOTE: The Trademark Applications Daily XML Element Documentation (v2.0 – “C”) includes the following color identification to show differences from the Trademark Applications Daily XML Element Documentation (v.12 – “B”).
Black – Existing in both “B” and “C”.
Red – New in “C”.
Blue – XML tags that are the same in “B” and “C” but re-ordered in “C”.
Green – Information that has a different definition in “C” than was present in “B”.- January 3, 2005 – Proposed deployment of the updated Daily Application product into production.
NOTE: Once the updated Daily Application product is accepted and placed into production, the Monthly Status File and the Monthly Contractor Reports will be discontinued in a timely manner.

04/16/2004:
"The U.S. Patent and Trademark Office is processing paper Madrid filings within a week of receipt and electronic applications within hours. Information is generally viewable on the USPTO website within 24 hours of the completion of Trademark processing. In addition to the work done on Madrid filings at the USPTO, there is also processing at the International Bureau of WIPO. Thus, in certain circumstances pendency is influenced by any backlogs that might develop at WIPO."

Control #215:
In the interest of economy, can something be done to filter out records from the application daily “C” files that have not undergone any change? We find recurring serial numbers where there are no detectable difference in the record.
Further clarification:
Applications can move from location A, within the trademark area, at 9:00 AM to Location B, Location B then moves the application to another location or even back to location A during the same workday – these moves are electronically captured and maintained within the USPTO thus causing a flag setting to be changed without changing any data content. This could also take place if applications were corrected erroneously and then returned to their original state.

Control #216:
Madrid application changes are not being disseminated. Serial No.: 71/431251 has had many <Madrid-history-events> recently added to it, yet the last update from was June 11, 2004. There were 2 updates this month on April 1st and 12th yet we did not receive these in any of the daily files.
The XML "C" retrospective dated March 31st, 2005 contains the Madrid information up to January 20th, 2005.This error was corrected Wednesday, April 27, 2005 and disseminated in the “C” file dated April 28, 2005.

Control #223:
We have a question in regards to the following serial number 73-376,873. We received the USPTO Status Code of 710 and a cancellation-date of February 12, 2005. We have not however, received this record with an action-key of '53'.
On TARR you have that the record status as Registration canceled under Section 8. As well you have within the prosecution history 2005-02-12 - Canceled Section 8 (10-year)/Expired Section 9. We have the information from the Prosecution History, but this never has come into us as an official gazette transaction as Cancelled. I have looked at all the gazettes from the 2/15 to present and it does not appear in any of them. When the mark is Canceled Section 8 (10-year)/Expired Section 9, will we receive the information as an official gazette transaction (action-key of '53')? Could you let us know when this will be published in the Official Gazette?

Control #224:
There appears to be a rather large gap in serial numbers (78623100 through 78624377) missing from the 24 Hour Box dated May 9, 2005.
Can you let us know if these should've been present?
The May 9, 2005 24 hour box file was recreated to include these missing serial numbers and made available on May 12, 2005.

Control #226:
The character > is not being represented correctly inside the Applications XML daily file. We are receiving the following: <mark-identification>&gt;<</mark-identification>
This should be: <mark-identification>><</mark-identification>
You can verify this mark on TARR which is displayed correctly, the Serial No. is 78/308645. This problem affects all marks (approximately 231) using the > character.
