Trademark Trial and Appeal Board (TTAB)

Trademark Trial and Appeal Board News and Notices ...

  • Stakeholder Forum: The TTAB will host an external stakeholder forum on March 3, 2016, from 1 to 3 pm, EST, to discuss the “look and feel” of TTABVUE, the TTAB’s electronic docket system. The goal of this year’s TTABVUE Users’ Forum is to address issues related to presentation and formatting of the electronic docket as well as search and other functions involved in using the system. The forum will be open to anyone who wishes to attend in person and also will be available in webinar. We only ask that you register your intent to attend by sending an email with your contact information to TTABRSVP@uspto.gov. See the Agenda for more information about the Forum Schedule and Speakers and the "Save the Date" for more information.
  • Stadium Tours: The USPTO is pleased to partner with law schools across the country to showcase actual PTAB AIA trial proceedings and actual TTAB appeal and opposition proceedings.  In addition to the Board proceedings, the USPTO and partner law schools will offer educational sessions about practice before the Boards.  Specifically, the Board judges will share tips for successful advocacy, and experienced Board practitioners will discuss strategies for winning before the TTAB and PTAB.  Click to see the program schedule along with detailed information about each law school venue.
  • TTAB is preparing an updated Standard Protective Order. The Order may be viewed, and comments and suggestions may be made, at TTAB IdeaScale for consideration by the TTAB.
  • The TTAB has posted a dashboard in the USPTO Data Visualization Center. Please visit the center and connect to the TTAB Dashboard, or use the link below in the Board Receipts and Issued Decisions box. Comments on the dashboard are welcome and should be forwarded to TTABdashboard@uspto.gov (link sends e-mail).

About the Trademark Trial and Appeal Board (TTAB)

The TTAB is an administrative board that hears and decides adversary proceedings between two parties, namely, oppositions (party opposes a mark after publication in the Official Gazette ) and cancellations (party seeks to cancel an existing registration). The TTAB also handles interference and concurrent use proceedings, as well as appeals of final refusals issued by USPTO Trademark Examining Attorneys within the course of the prosecution of trademark applications.

The Chief Administrative Trademark Judge is Gerard F. Rogers. The TTAB Video, No. 13, provides an overview of proceedings before the TTAB.

The Trademark Trial and Appeal Board Manual of Procedure (TBMP)

The TBMP provides practitioners with basic information generally useful for litigating cases before the TTAB. The manual does not modify, amend, or serve as a substitute for any existing statutes, rules, or decisional law and is not binding upon the TTAB, its reviewing courts, the Director of the USPTO, or any part of the USPTO. Rather, the TBMP merely describes current practice and procedure under the applicable authority, as of the manual's issue date.

The most recent version of the TBMP issued in June 2015 may be accessed from the TTAB website under "Policies, Procedures and FAQs." For archival purposes, earlier editions of the TBMP are posted there as well under, specifically under "TBMP Archives."

Electronic System for Trademark Trial and Appeals (ESTTA)

Use ESTTA to institute new TTAB proceedings and file documents in existing TTAB proceedings on-line. SYSTEM AVAILABILITY: Check Current Server Status and Planned Outages before beginning the filing process. Because unexpected problems can occur, you should keep filing deadlines in mind and allow plenty of time to resolve any issue which might arise. The Board will provide general assistance to ESTTA filers (see contact information below), but we cannot guarantee that any problem will be resolved prior to a deadline. Except when filing extensions of time to oppose or oppositions to Madrid Protocol applications, ESTTA filing is optional. If ESTTA filing is not possible prior to a deadline for any reason, parties should submit their filings in paper.

Trademark Trial and Appeal Board Inquiry System (TTABVUE)

Use TTABVUE to view a TTAB proceeding file by entering the proceeding number, or search for proceedings by application number, registration number, mark, party, correspondent.
