  • Facsimile Transmission. The Office prefers that responses to Office Actions be sent using the Response to Office form on the TEAS web site. This form now accepts formatted text, including text from WordPerfect and Microsoft Word documents. If you are unable to use the Response to Office Action form, you may "fax" correspondence related to trademark applications that have previously been filed with the Office to the facsimile numbers listed below. However, first please use TARR to determine the location of your application. Do not send correspondence on the same topic to multiple locations. If you have a question about where you should send your correspondence, please contact the Trademark Assistance Center. We will send back a confirmation that the Office has received the communication.

  • Post-Publication Amendments. You should fax requests for amendments after publication (i.e., either after the examining attorney has “approved” an application for publication or the actual publication of the mark in the Official Gazette) to "Post-Publication Amendments/Corrections," at 571-270-9007. Requests to correct minor typographical errors, inquiries regarding the procedure for submitting a post-publication amendment, or questions regarding the status of a post-publication amendment can be e-mailed to TMPostPubQuery@uspto.gov. Do not send any actual amendments to this mailbox.

  • Certificate Of Facsimile Transmission. Under 37 C.F.R. §2.197, facsimile correspondence will be considered to be timely filed, even if received after the due date, if the correspondence is: (1) transmitted to the Office by facsimile on or before the due date; and (2) accompanied by a certificate attesting to the date of transmission. 64 Fed. Reg. 33056, 33063 (June 21, 1999). See TMEP §§306.05 et seq. regarding the certificate of transmission procedure under 37 C.F.R. §2.197.

    The following wording is suggested for the certificate of transmission: I hereby certify that this correspondence is being transmitted by facsimile to the United States Patent and Trademark Office on the date shown below.
