U.S. Patent and Trademark Office to Hold Conference on State Sovereign Immunity and Intellectual Property

The U.S. Patent and Trademark Office (USPTO), in conjunction with the American Intellectual Property Law Association and the Intellectual Property Section of the American Bar Association, will be holding a one-day conference to study recent Supreme Court decisions concerning the sovereign immunity of states and federal intellectual property rights. The conference will be held March 31 in Washington, D.C., and will be made up of respected legal academics as well as state and federal officials. The panel members for the conference are some of the country’s leading constitutional and intellectual property scholars.

Panelists at the conference sessions will consider current legislative proposals to address the Florida Prepaid cases as well as explore a broader range of related questions, including: the actions a state could constitute waiver of its immunity; patent, copyright, and trademark rights of states; immunity of states from suits for damages in federal court and the likelihood that infringements by states will increase; and the remedies available to private citizens in state courts and whether such suits undermine the uniformity sought in intellectual property laws.
