Subject: Proposed Language of Sec. 1.53(c)(3)(ii)



The proposed language of Sec. 1.53(c)(3)(ii) does not account for the
pending extension provided in proposed Sec. 1.7(b).  Clarification in the
comments of the final rule, or correction. is respectfully requested.

If the full pendency of a provisional is intended, then the following is
offered as suggested rule language for 1.53(c)(3)(ii):

    (ii)    Expiration of the period of pendency of the provisional
application filed under 
        paragraph (c) of this section.
