Comments on August 2007 Examination of Patent Applications That Include Claims Containing Alternative Language

The USPTO has published two notices concerning examination of claims that contain alternative language.  The first was the August 2007 notice of proposed rule making entitled Examination of Patent Applications That Include Claims Containing Alternative Language (NPRM), first published in the Federal Register at 72 Fed. Reg. 44992 (August 10, 2007) and then published in the Official Gazette at 1322 Off. Gaz. Pat. Office 22 (September 4, 2007).  The second was the March 2008 request for comments on the proposed rule and initial regulatory flexibility analysis of the proposed rule, also entitled Examination of Patent Applications That Include Claims Containing Alternative Language (IRFA), first published in the Federal Register at 73 Fed. Reg. 12679 (March 10, 2008) and then published in the Official Gazette at 1329 Off. Gaz. Pat. Office 41 (April 1, 2008).

It is hoped that the public will review this list of comments to determine if it is complete. If any person or organization has submitted a comment prior to October 23, 2007 in response to the August 2007 NPRM, or prior to April 10, 2008 in response to the March 2008 IRFA, but the comment is not included in this listing, please submit the comment by electronic mail message to kathleen.fonda@uspto.gov , or contact Kathleen Kahler Fonda, by telephone at (571) 272-7754.

Each comment is attributed to the individual submitting the comment unless the comment indicates that it is made on behalf of an organization.  Within each category, comments responsive to the August 2007 NPRM are grouped separately from comments responsive to the March 2008 IRFA.
