Survey of Registered Practitioners in Patent Cases (June 2014)

The Office of Enrollment and Discipline periodically conducts a mandatory survey of active registered practitioners pursuant to 37 C.F.R. § 11.11. The purpose of the survey is to ascertain whether the practitioners desire to remain on the register.  The United States Patent and Trademark Office benefits from the survey by obtaining confirmation that OED's records regarding each practitioner's address and telephone number are correct, or by receiving updated information. Practitioners who fail to respond may be subject to administrative suspension.

A survey letter was mailed on June 30, 2014, to active registered practitioners whose registration numbers are between 35,000 and 39,999.  Enclosed with the survey letter was a blue Data Sheet, which practitioners must complete and return to OED within forty-five (45) days of the date the survey is mailed. The survey was mailed to the official address on file with OED.  Practitioners must reply to the survey letter even if the current contact information is correct.

Lack of Response to Survey by Registered Practitioners in Patent Cases

Pursuant to 37 C.F.R. § 10.11, the Office of Enrollment and Discipline (OED) conducted a survey of the active registered practitioners whose registrations numbers are below 25,000.  The purpose of the survey, begun on July 31, 2012, was to ascertain whether these practitioners wish to remain on the register.  OED received numerous responses.  Most practitioners responding to the survey provided information that enabled OED to confirm and update records regarding the responding practitioner’s address and telephone number.  Other practitioners requested removal of their names from the register of attorneys and agents.   As of December 12, 2012, OED did not receive any response or communication from over 900 practitioners. Removal of Registered Practitioners

Practitioners who failed to reply and give the requested information to the Survey were previously removed from the register.  Click here for more information.

Reinstatement Procedure

Practitioners who have been administratively suspended from the Register of Patent Attorneys and Agents may apply for reinstatement by completing the Reinstatement Data Sheet (FORM PTO 107R) along with the requisite fees.  Such fees include the reinstatement fee of $100 under 37 CFR § 1.21(a)(9)(ii), along with the delinquency fee of $50 under 37 CFR § 1.21(a)(9)(i).

Practitioners whose names have been removed or administratively suspended from the Register of Patent Attorneys and Agents for more than five years must, in addition to the above, take and pass the registration examination unless they submit a showing to the satisfaction of the Director of Enrollment and Discipline that they continue to possess the legal qualifications necessary to render patent applicants valuable service.  See 1064 O.G. 12.
