Update to Content of the Registration Examination

 

The United States Patent and Trademark Office will be updating the content of the registration examination by updating the source material and including sources beyond the MPEP to conform the content of the examination to current practice.  The questions on the examination will correspond to the updated source material.  The update is expected to occur in April, 2011.

 

Source of Questions and Answers

The update in the content of the registration examination will be accompanied by an update in the source material for the questions.  The source for the questions and answers will be the Manual of Patent Examining Procedure (MPEP), Edition 8, Revision 8, as well as other published USPTO policy and procedure reference materials.  The source materials are identified at http://www.uspto.gov/ip/boards/oed/exam/reg_exam_source_material.jsp. In the future, OED will post notices at http://www.uspto.gov/ip/boards/oed/index.jsp#heading-5 that the source materials used for the examination are being updated.

 

When any source material for the examination questions is updated, the source material will be provided to registration candidates taking the examination in PDF format on the computers at the examination site.  The source materials also will be provided to those taking the USPTO administered examination.  The Office will revise the General Requirements Bulletin to conform to this change. 

 

Inconsistency Between MPEP and Other Source Materials

The applicable laws, rules and procedures as set forth in the published USPTO policy and procedure reference material will control in the event of a conflict with the MPEP, Edition 8, Revision 8.

 

Continued Administration of Current Examination

Until the content of the examination is updated in April, 2011, the examination will continue to be administered using the same questions and answers currently used, wherein MPEP, Edition 8, Revision 4 is the source for the questions and answers. 

 

Candidates approved by the Office of Enrollment and Discipline to take the examination and wishing to take the currently administered examination before the content of the examination is updated must take the examination before the update occurs.  Therefore, they must schedule a date, time and place to take the examination with the test administrator, Prometric, before the update occurs in April, 2011.  After the content of the examination is updated, the currently administered examination will no longer be available for candidates. 

 

Effective Date of Change

At this time, it is anticipated that the update will occur some time sometime in April, 2011.  It is anticipated that in or about mid-February the USPTO will know the exact date in April, 2011 when the update will occur.  At that time the USPTO will announce the last date in April, 2011 when the current examination will be administered and the first date in April, 2011 when the examination will first be given containing updates in the question content and the source of questions.
