Explanation of complaint between customer and invention promoter: On 06-06-06 I signed a contract with Kessler Corporation to employ them to find a manufacturer for my newly patented invention (D519,413S) a toboggan. The contract states Kessler Corporation will select manufacturers who they believe will be interested in my invention and send descriptive material to them. The manufacturers they selected were surfboard, snowboard and furniture manufacturers who couldn’t possibly be interested in toboggans to send descriptive materials to.
I filed a complaint with the Toledo, Ohio Better Business Bureau. Kessler Corporation’s response to that was they now claimed that I was the one who had selected the manufacturers they had sent descriptive materials to, which is absolutely not true. I had absolutely no control over the manufacturers they selected. I did suggest they send descriptive materials to plastic toboggan manufacturers, which they did not do.
Kessler Corporation first contacted me through the US mail. The first offer they sent me was dated 4-25-06. I paid Kessler Corporation $975 for their services by personal check.
By selecting manufacturers that would have no interest in a toboggan, Kessler Corporation has clearly breached the contract between us. Also by making false statements to the Better Business Bureau and other agencies in order to avoid paying me a refund they have demonstrated that they are a corporation, which lacks integrity.
At this time I am certain that I will never recover the $975 I paid them. I believe it is only right that other potential clients be made aware of the dishonest practices of Kessler Corporation.
In that light, I would appreciate it if you would make public my complaint against them. Enclosed is a copy of the contract.
