Subject to the terms and conditions of policy, the USPTO grants registered users the non-exclusive, right to use the USPTO Public Key Infrastructure software (the "SOFTWARE"), (including any updates or modifications intended to form part of the SOFTWARE) solely for the purposes of using the USPTO Electronic Business Center.

Title
The SOFTWARE will remain the sole and exclusive property of the USPTO including any related copyright, trademark, patent, and other rights.

Restricted Use
Registered users may download or make additional copies for their personal use for each computer where the SOFTWARE is to be used. Users may make copies for back-up or archival reasons only for each computer where the SOFTWARE is installed. Users may not modify or otherwise copy the SOFTWARE. Users may not reverse engineer, de-compile or disassemble the SOFTWARE. Users may make one copy of the SOFTWARE documentation for each copy of the SOFTWARE licensed. Users shall hold the SOFTWARE in confidence for the benefit of the USPTO and shall not transfer the SOFTWARE to any person or computer that does not have the right to it.

Limited Warranty
The USPTO warrants that the SOFTWARE will perform in substantial accordance with the delivery of the Electronic Business Center services. This warranty is void if failure of the SOFTWARE is a result of accident, abuse or misapplication.

Customer Remedies
The USPTO's sole liability and user's exclusive remedy under this policy, shall be, at the USPTO's option, either to repair or replacement of SOFTWARE that does not meet the limited warranty.

No Other Warranties
To the extent permitted by law, the USPTO disclaims all other warranties and conditions, either express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose, with respect to the SOFTWARE and the accompanying written materials.

No Liability for Consequential Damages
In no event shall the USPTO be liable for any consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption or loss of business information) arising out of the use of or inability to use the SOFTWARE.

Export Restrictions
Export of the SOFTWARE outside of the United States of America may require approval of the appropriate Government export and import authorities.

U.S. Government Restricted Rights
Use, modification, reproduction, release, display or disclosure by the Government of the U.S.A. of the SOFTWARE and documentation contained in this package is subject to the restrictions of this Agreement in accordance with Federal regulations at 48 C.F.R. Section 12.12 and Subsection 227.7202-3.

Transfer
Users have no transfer rights under this Agreement

Governing Law
This Agreement is governed by the laws of the United States.
