Reason for Sole Source:
Only one responsible source: the supplies or services needed by the agency are available from only one responsible source and no other type of supplies or services will satisfy the agency requirements.

The United States Patent and Trademark Office (USPTO) intends to issue a sole source award to Iron Mountain/National Underground Storage for leased space at its Boyers, PA limestone mine to serve as a secure, remote production operation and disaster recovery data center.
The Patent and Trademark Acquisition Guidelines (PTAG) specifically exempts USPTO from the Competition in Contracting Act (CICA - 41 USC 253), thereby eliminating the requirement for full and open competition. The USPTO completed market research in December, 2010 by positing a Request for Information on the Governmentwide point-of-entry, FedBizOpps, requesting information from offerors who may meet the requirements of this procurement. No responsible offerors were identified.
The USPTO currently leases space in the Iron Mountain facility, and the additional financial cost and risk to operation interruption to relocate the facility, coupled with a lack of evidence of alternative options provide the justification for awarding this contract to Iron Mountain on a sole source basis.
